• MFP-08~-001 -Request to modify the 6-foot vinyl perimeter fencing approved
with the final plat landscaping plan for Cardigan Bay Subdivision (FP-06-
040), by Liberty Associates, LLC.
1. SUMMARY AND ANALYSIS ~OF APPLICANT'S REQUEST

The applicant, Liberty Associates, LLC, has applied for a final plat modification to modify the 6-foot
vinyl perimeter fencing approved with the final platting of the Cardigan Bay Subdivision. The reason for
the modification is to avoid double'~fencing along the perimeter of the subdivision and maintain an open
view of the grassy field along the eastern property boundary (currently a LDS Church site). The applicant
wishes to remove the vinyl fencing;~requirements along the north, east and 285 feet along the south
perimeter boundaries. Except for approximately 165 feet of split rail and 6-foot solid fencing along the
southern perimeter (adjacent to Lof:13, Block 3), the existing 6-foot vinyl and 6-foot chain link fencing
was installed or in place prior to the landscape inspection for the Cardigan Bay Subdivision. It is
important to note all other fencing requirements for the Subdivision are in compliance with the approved
landscape plan.
The Unified Development Code (UDC) does not have a requirement for permanent perimeter fencing. On
the revised landscape plan submitt !d with the subject application, the applicant is proposing the existing
fencing (a combination of 6-foot vu1y1 and 6-foot chain link) substitute as the requirement for the
perimeter fencing approved on the `site. Staff is supportive of the applicants request because the existing
fencing still provides containment of construction debris on site and would eliminate the need to double
fence the perimeter of the development. Staff believes the existing fencing that surrounds the subject site
still meets the intent of the fencing;~approved with the final plat landscape plan.
The Cardigan Bay final plat was approved by City Council on September 12, 2006. The final plat
consisted of 28 residential lots and~~3 common lots on 11.5 acres of land; zoned R-4.
Cardigan Bay Subdivision is located approximately a half mile north of E. McMillan Road,
approximately a half mile south of E. Chinden Boulevard and approximately 750 feet west of N. Locust
Grove Road in Section 30, T. 4N~., R. lE.. The City Council approved the final plat on September 12,
2006.
2. SUMMARY RECOMMENDATION
Staff recommends that the City Council approve the applicant's request to modify the approved fencing
plan for Cardigan Bay Subdivision (MFP-08-001), as proposed by the applicant and attached in Exhibit A
of this staff report. ;
