HomeMy WebLinkAboutStaff ReportCITY OF MERIDIAN PLANNING DEPARTMENT STAFF REPORT FOR THE HEARING DATE OF MARCH 18, 2008 STAFF REPORT Hearing Date: March 18, 2008 E IDIAN*~^' TO: Mayor and City Council FROM: Bill Parsons, Associate City Planner MAR 0 ~ 2008 208-884-5533 City Of Meridian SUBJECT: Redfish Subdivision (a.k.a Whitefish Subdivision) - TE-08-001 City Clerk Office Request for approval of an 18 month time extension to obtain the City Engineer's signature on the final plat for Redfish Subdivision, by Jake Miller Staff has reviewed this application submittal and offers the following comments: APPLICATION SUMMARY The applicant, Jake Miller, has requested City Council approval of an 18 month time extension to obtain the City Engineer's signature on the final plat for the Redfish Subdivision (a.k.a Whitefish Subdivision). It is important to note the project was preliminarily platted as the Redfish Subdivision however the development agreement for the site was recorded under the Whitefish Subdivision. The preliminary plat consisted of 5 commercial office building lots and 2 other lots on 2.52 acres in an L-O zoning district. The preliminary plat (PP-OS-021) was approved by City Council on July 12, 2005 and expired on July 12, 2006; however the applicant applied for, and the Planning Director granted, an 18- month time extension in accordance with UDC-11-6B-7C. With the previous time extension, the applicant was given two months to enter into a Development Agreement for the site. The subject Development Agreement was recorded on October 19, 2006, as Instrument No. 106165912, records of Ada County Idaho. Furthermore, the administrative time extension expired on January 12, 2008, which has initiated the request for the second time extension for the project (the applicant submitted the subject time extension request prior to the project expiring). The applicant states the primary reason for the subject time extension is to resolve the issue of the sewer not being made available to the subject property. The applicant believes that the sewer should have been stubbed to the property with the approval of the Baldwin Park Subdivision to the north and east of the site. Currently, the applicant is working with Public Works to address the sewer concern and find a resolution to proceed with final platting for the subject site. The City of Meridian's Unified Development Code (UDC 11-6B-7C) allows the Director to authorize a single extension of time to record the final plat, not to exceed 18 months, when the applicant files a written request for an extension prior to the expiration of the plat. Additional time extensions up to 18 months as determined and approved by the City Council maybe granted. With all extensions, the City may require compliance with the current provisions of the UDC as a condition for granting a time extension (UDC 11-6B-7C). Staff believes that there are no additional conditions that should be added to those approved by the City Council with the final plat for this subdivision; the previous plat conditions should be complied with as part of the subject approval. LOCATION The property is located at 4120 N. Linder Road, in the NW '/ of Section 36, T.4N., R.1 W. STAFF RECOMMENDATION Staff recommends approval of an eighteen month time extension to obtain the City Engineer's signature for Redfish Subdivision (a.k.a Whitefish Subdivision) to expire on July 12, 2009.
