We respectfully ask you to reconsider the ruling for the rezoning application RZ-07-019 on Lanark 3163.
We understand your ruling on the accompanying Conditional Use Permit application CUP-07-019
however we feel that your decision concerning the rezoning application may have been in error.
The reason we feel that this issue needs to be reconsidered is that it would be in the city's best interest to
have a office or retail establishment located there to act as a buffer from the industrial businesses behind
it on Lanark. The City Council must have agreed since on February 6~' of 2007 they voted to approve a
rezone request RZ-06-010 from I-L to C-G of 2.20 acres across Lanark Street. This property is directly
north of our client's 1.389 acre property separated only by Lanark Street.
Our client's property located at 3163 Lanark has two commercial buildings already built and the denial of
the rezone request wilt greatly affect our client's ability to find a tenant for this building.
Since the only public opposition was for the Conditional Use and not the rezone, we do not understand
the denial of the rezone application. We feel the ruling was arbitrary and capricious because it appears it
was denied simply because the City Council did not agree with the Conditional Use. We therefore
respectfully request that you reconsider this ruling. .
