11, A list of the mailing addresses of all property owners within
three hundred feet (300') of the external boundaries of the
land being considered. This list must be obtained from the
City of Meridian Planning & Zoning Department. Please request
list seven days prior to submitting application.

12. Characteristics of subject property which prevent compliance
with the requirements of this Ordinance.
These lots have 3 unusual easements that do not allow the
planting of trees or other shrubs:
a. Bower Street has an original townsite 80' right-of-way.
b. Ada County Highway District has an additional ten-foot-
wide easement to allow for a street drainage drainfield.
c. Along the entire west property line, Nampa-Meridian
Irrigation District has a 40' easement.
Also, in regard to the 3" caliper trees, the applicant will
make every effort to provide the required size. However, due
to the fact that many nurseries are reporting a shortage or
complete lack of 3" caliper trees, we are requesting a
reduction in the minimum tree caliper size to 2".
13. Minimum requirements of this Ordinance that need to be reduced
to permit proposed use.
Ordinance requires one 3" caliper tree per 1,500 s.f. of
asphalt. Applicant requests reduction from 37 trees to 25
trees, with reduction in caliper from 3" to 2". Due to the
easements involved, we feel we have maximized the number of
trees provided on the site. This variance requests a
reduction in the required trees to 25 two-inch caliper trees.
14. Difficulty or hardship which would result if requirements of
this Ordinance were applied to subject property.
The property is hindered by unusual drainage and irrigation
easements. If the Ordinance is applied to this property, the
lot becomes non-functional and won't meet the requirements of
the business.

15. Unusual or peculiar circumstances which indicate that
regulations of this Ordinance should not be strictly complied
with.
Other properties are not burdened with these easements and
rights-of-way. Also. in regard to the 3" caliper requirement,
desirable species are not able to be obtained at this time.
16. Statement that special conditions and circumstances exist
which are peculiar to the land, structure or buildings
involved which are not applicable to other lands, structures
or buildings in the same district.
The property has drainage and irrigation easements which are
peculiar to the land. Special circumstances also exist in the
fact that 3" caliper trees may not be available at the time
occupancy is needed for the building which is under
construction.
17. Statement that a literal interpretation of the provisions of
this Ordinance shall deprive the applicant of rights commonly
enjoyed by other properties in the same district under terms
of this Ordinance.
A literal interpretation of the provisions of the Ordinance
will make the property unusable by the intended tenant, and a
certificate of occupancy will not be issued if the site does
not comply with City Ordinances.
18. Statement that special conditions or circumstances exist that
were not a result of the applicant's action.
The circumstances of this property (in regard to easements)
were the result of governmental actions, not those of the
applicant. Nurseries in the valley are reporting
unavailability of certain species in the 3" caliper size.
19. Statement that granting the variance requested shall not
confer on the applicant any special privilege that is denied
by this Ordinance to other lands, structures or buildings in
the same district.
Granting of the variance will not give the applicant any
special privilege that is denied by this ,Ordinance to other
lands, structures or buildings in the same district. The
variance would render this lot usable, allowing a business to
exist and resulting in property tax revenue to the City of
• •
Meridian. The viability of any business on these parcels,
given the conditions of the easements, would be questionable.
20. Relationship of the proposed variance to the Meridian
Comprehensive Plan.
The Comprehensive Plan provides for the most efficient use of
land and maximizing the landscaping with that usage.
21. A fee established by the Council -
($250.00 + $1.73 for each certified mailing to be sent (26)
$294.98 Total Eee)
22. A statement of how the granting of the variance would
convenience the applicant and how the applicant would profit
therefrom, which statement shall also represent whether profit
and convenience is the sole reason why the variance is
requested.
The variance would profit both the applicant and the City of
Meridian. The applicant gets to relocate its business from
poise to Meridian (the center of the Treasure Valley),
Meridian gets jobs, a clean business, and property tax revenue
it so desperately needs. Profit and convenience are not the
sole reason the variance is requested.
23. A signed affidavit stating that the property will be posted by
the applicant 1 week before the public hearing. Posting must
contain name of applicant, description of zoning amendment,
and time and date of public hearing. Official notices are
available at the Planning & Zoning Department or at City Hall.
The applicant will post a notice of public hearing one week
prior to the time and date of said public hearing.

particularly described as follows:
Commencing at the Northwest comer of said Lot 8, Block 1, of Meridian Business Park; thence
South 00° 18' S7" West 85,25 feet to a point; thence
South 00° 31' 11" West 252.03 feet to a point on the Westerly boundary of said Lot 6; thence
