Location: north side of Victory Road, just west of Meridian Road.
Applications: Annexation and zoning of 15.49 acres to C-N zoning.
Highlights of Proposed Development: Request to rezone 1.76 acres from L-O to C-N. T'he
applicant is requesting the rezone to allow retail and restaurant uses on this site. Comprehensive
Plan Map Amendment was approved by Council that now designates this property as Office.
Planning Commission Recommendation: approval at their November 1, 2007, public hearing.

Key Issue(s) of Discussion by Commission: Several Commissioners felt drive-through
establishments could impact the surrounding neighborhood; however no changes were
recommended to the staff report.
Key Commission Change(s) to Staff Recommendation: None
Written Testimony: Staff has received a few phone calls from neighbors in the vicinity that are
concerned about commercial uses and traffic on this site. In the request for reconsideration, the
applicant supplied additional information on the relationship between the subdivision and the
adjoining church and their joint efforts at traffic management.
Outstanding Issue(s) for City Council: Appropriateness of the proposed reap change and rezone.
Summary of City Council Public Hearing:.
i. In favor: Mike Crawford (asking for rezone for marketability of the proiect
ii. In opposition: Nathan Gardner (commented on increased traffic,decrease in property
values), Kelly Gunsweiller (access and church traffic through the neighborhood ,Kathy
James (felt deceived by the developer), Julie Bingham (neighborhood safety for children
with the increase in trafficl. Kelly Steves (not noticed for the hearing and the church access

Key Issues of Discussion by Council:
i. The permitted and conditional uses for the C-N zoning district
ii. The office uses were allowed along Meridian as Hart of a PUD use exception approval.
iii. Council wanted further explanation reeardin~ the transition from an office use to a
commercial use next to residential.
Council Decision: Council approved the site with a land use designation of Office rather than
Commercial.. Council denied the rezone request to commercial.
