Dear Mayor and Council;
As representative for Mr. Dan Wood, please accept this application for Timberfirlls Subdivision,
located on the south side of E. Ustick Road, west of Locust Grove Road in Meridian, Idaho,
Section 06, Township 3 North, Range 1 East of the Boise-Meridian. Timberfalls includes 14.31 acres
and has been designed with 561ots (50 residernial, 6 common) and includes a request for annexation
with a zoning designation of R-8 (Medium Density Residential). A density of 3.49 dwelling units per
acre is proposed. The current owner of record for the development is Ms. Wanda Stewart. Dan
Wood has this property under contract, and the property owner has provided a letter of wnsent
(signed affidavit) regazding the submittal of this application.
This letter is included with the application for the preliminary plat, annexation and zoning, together
with filing fees and various exhrbits.
The enclosed annexation and zoning, and preliminary plat, have been designed, and the applications
have been submitted in accordance with the requirements of the Meridian Zoning Ordinance. A
request to the Planning Director with the preliminary plat for width reduction to the landscape buffer
on Ustick Road is the lone exception to this. The developmem has also been designed to be in
compliance with the invent of the Meridian City Comprehensive Plan.
Specific Comprehensive Plan policies that support the requested zone change include:
• Population Growth Goal 1, Objective A, Action 6 (New residential development with provided
Urban Services);
• Natural Resources Goal 1, Objective A3, Encourage infill, Action 8 (Infill contiguous
development;
Services Goal II, Objective A, Transportation, Action 6 (Street connections between subdivisions);
• Land Use Goal III, Ensure public services, Objective A, Action 1 (Development projects planned
public services); Goal IV, Objective C, Encourage residential infill, Action 1(compatibifity), 3
{usable open space), 5 (sidewalks, curbs, gutters,etc.), Objective D, Transportation Corridors,
Action 2 (Restrict curb cuts/access on collectors); Goal V, Objective A, Quality Housing, Action

10 (Infill of vacant lots at densities sirr»laz to surrounding developmern), Objective C, Quality,
Action 1 (Require common area);
An R-8 zoning designation is being requested with this annexation and the subdivision plat will contain
lots ranging in size from a minimum 6,500 squaze feet to approximately 15,000 squaze feet. All streets
will be public and will be construct, along with curb, gutter and sidewallcs, to Ada Coumy I3ighway
District and Meridian City standards. Sewer and water service is readily available and will be provided
by the City of Meridian. Drainage will be handled by surface and subsurface methods and will be
designed to the standazds of all appropriate regulatory agencies. A pressure urgation system through
the Nampa-Meridian Irrigation District will be provided for all lots within the development. The
developer is requesting at this time to receive secondary imgation water service from the City of
Meridian.
The development has been designed to include landscaping at the entrance and along the Ustick Road
frontage of this development. Common area lots are included within the development, including a 1.25
acre open space lot (Lot 6, Block 3) located in the center of the subdivision All common landscape
area lots will be landscaped by the developer and owned and maintained by a Homeowners Association
that will be established for the subdivision A draft set of Restrictive Covenants designating the HOA
has been submitted with this application.
In all, Thnberfalls will be a quality and compatible addition to this area of Meridian. The requested
zoning to R-8 will benefit the public interest by providing desirable housing needs to this azea of the
City while allowing for the cominued improvement and expansion of city services and an increase in
the City's tax base. This application submittal includes all items listed within the preliminary plat and
annexation checklists. We look forward to working with you and your staff and request approval of
this project.

RE: TimberFalls Subdivision -Request for Landscape Buffer Width Reduction
Dear Mr. Hawkins-Clark;
As representative for Mr. Dan Wood, please accept this request for a reduction in width to the required
landscape buffer size in the frontage on Ustick Road for Timberfalls Subdivision, located on the
south side of E. Ustick Road, west of Locust Grove Road in Meridian, Idaho, Section 06, Township 3
North, Range 1 East of the Boise-Meridian. Specifically, we request a reduction in buffer size, as
listed in Section 7.4 of the Landscape Ordinance from the required 25 feet on a minor arterial (CTstick
Road) to 20 feet.
Section 7.5 of the Ordinance, Width Reduction, states that "In a development where the required street
buffer width results in an otherwise unavoidable hardship to the property, a written request for a buffer
reduction maybe submitted to the Planning Director. The request must demonstrate evidence of the
hardship caused by the required street buffer and propose a specific alternative width. In no case shall
the width be reduced to less than ten (10) percent of the depth of the lot without a Variance.
Irr the case of Timberfalls Subdivision, a 20 foot buffer (5 foot reduction) is being requested along
Ustick Road within a common lot. Due to the configuration of the parcel, the fact that it is bound on
three sides by existing subdivisions and because of the existing three (3) stub streets coming from
those subdivisions, a very tight lot layout is required. The addition of 5 extra feet within the buffer
would result in the loss of 5 feet in the layout and, more than likely, the loss of a buildable lot in
Block 1. Further, while the 5 feet could be made up over the rest of the development without losing
another buildable lot, the developer would be forced to take away area from the open space lot in the
center of the project, area that is better used serving the development as usable open space than
aesthetics in the buffer. Still further, the two subdivisions located on each side of the subject parcel
both were developed with 20 foot landscape buffers, so this developer would ask for the same
requirement in an effort to keep the entire length of this portion of Ustick Road between Locust Grove
and Meridian Road consistent. Also, the developer is not asking for a reduction to less than ten (10)
percent of the depth of the lot which, as stated in the above referenced Section, would require a
variance by the City Council.
Finally, the developer believes that there is an evident hardship that would result in his not being able
to develop his property in the same manner that others haue enjoyed on both sides of his property. A
reduction of 5 feet would not cause any damage, hazard or nuisance to surrounding property owners
and would not be detrimental to the health, safety or welfare of the public. We ask that you consider
this request and allow the buffer along Ustick Road to remain at the designed 20 foot width.
