BENTLEY P & Z COMMISSION JIM JOHNSON, Chairman TIM HEPPER JIM SHEARER GREG OSLUND MALCOLM MACCOY September 26, 1996 We have reviewed this submittal and offer the following comments, for your information and consideration as conditions of the Applicant during the hearing process: GENERAL COMMENTS 1. Any existing irrigation/drainage ditches crossing the property to be included in this project, shall be tiled per City Ordinance 11-9-605.M. Plans will need to be approved by the appropriate irrigation/drainage district, or lateral users association, with written confirmation of said approval submitted to the Public Works Department. 2. Any existing domestic wells and/or septic systems within this project will have to be removed from their domestic service per City Ordinance Section 5-7-517. Wells may be used for non-domestic purposes such as landscape irrigation. 3. Determine the seasonal high groundwater elevation, and submit a profile of the subsurface soil conditions, as prepared by a soil scientist, with street development plans. 4. Submit copy of proposed restrictive covenants and/or deed restrictions for review by the Meridian City Attorney. 5. Provide a statement as to whether the pressurized irrigation system in this development is to be owned and maintained by the Irrigation Dist. or the Homeowners Assoc. Indicate any FEMA Flood Plains affecting the area being platted, and detail plans for reducing or eliminating the boundary. 7. Please address in writing, each of the General and Site Specific Comments, within this memorandum, to the City Clerk's office prior to October 1, 1996. SITE SPECIFIC COMMENTS 1. This Final Plat does not conform to either the first or second version of a preliminary plat map in that a pedestrian walkway is required between the Finch Creek Subdivision (akeady recorded) and this parcel. The first preliminary plat showed a sidewalk stubbing into the Finch Creek Subdivision. A second version of the preliminary plat showed a 15- foot-wide gravel access road in a location that would be appropriate to match up with Finch Creek Subdivision. This latest version presented as a final plat shows a 25-foot- wide unencroachable easement on the southern boundary that only encompasses the area now occupied by the ditch and the headwall construction (see attached map). This 25 feet will not even allow a road for Nampa-Meridian Irrigation District to pass through, requiring them to back up over 800 feet along the ditch in Finch Creek Subdivision. The piping of the Finch Lateral will require daily inspections and cleaning of the inlet structure. The inlet structure is also equipped with a grate with openings of ± 12 inches wide, which poses an additional safety problem. Small children could easily pass through this grate. This walkway is vital to provide interconnection between the two subdivisions. Block lengths exceed 1,000 feet, which led to the requirement for this walkway. Lot 28 should be absorbed into Lot 29, Block 8, and made a part of the common area. The Applicant is to submit a revised preliminary plat along with details of the pedestrian walkway, Nampa- Meridian Irrigation District access road, and fencing for approval of the Public Works and Planning & Zoning Departments. It is not the City's responsibility to ensure Applicants recoup the cost of tiling ditches, which is required by Ordinance, when they are unable to meet the representations made in public hearings to get their zoning and plat approved. 2. Please provide the Public Works Department with documentation from the Nampa & Meridian Irrigation District that the existing Finch Lateral maintenance easement has been vacated, and proof that they approve and will accept the new proposed easemnq( location with the concept of having houses encroach within their easement. Please add or revise the following notes: LJ (1.) ...building setbacks and dimensional standards in this subdivision shall... (2.) ...line have an adjacent ten (10) foot.. . (4.) ...time of resubdivision. (5 .) ...drainage easement, unless shown otherwise. (10.) ...square feet, excluding garage. 4. Fill in the instrument number information for note number 11. 5. Is the License Agreement mentioned in plat note number 13 going to be recorded into Ada County Records? It would be a good idea so that it is brought up during title searches for future homeowners. 6. Developer shall provide the City of Meridian Building Department with compaction testing results across the lots receiving fill material during the relocation of the Finch lateral. 7. Lot 2, Block 8, doesn't meet the required minimum street frontage of 65.00 feet. 8. The non-encroachable Nampa-Meridian Irrigation District easement shown between Lots 9 and 10, Block 8, should only impact one lot so that a fence may be placed on the lot line. 9. The development agreement needs to be revised for this subdivision per the approval of the City Attorney and P&Z Administrator. The revisions proposed by the Applicant in a letter dated September 17, 1996, may or may not be used. 10. The Applicant's September 17, 1996 letter also complains of an apparent "change in policy" of requiring full engineering drawings to be submitted with the final plat. As this requirement has existed in the Zoning & Development Ordinance since 1984, the Applicant's remarks are inappropriate. Since the transmittal included with the final plat indicated plans had already been submitted when indeed they had not, it is apparent this requirement was known. The Applicant has submitted two prior final plats in the last year, complying with this policy. 11. Permanent, six-foot-high perimeter fencing is required to be in place prior to obtaining building permits. C: \OFFICE\W PW IN\ W PDOCS\BEDFORD3. The Applicant is to submit a revised preliminary plat along with details of the pedestrian walkway, Nampa-Meridian Irrigation District access road, and fencing for approval of the Public Works and Planning & Zoning Departments.
