I note that Bruce Freckleton and Shari Stiles have requested a de£crral until the October 1, 1996 meeting in order to review the construction drawings. In the past, it has been the City's practice not to accept construction drawings for review until the final plat had been approved by the City Council. I do not know what has precipitated this apparent change of policy where we now are required to submit full engineering drawings before the final plat can be approved. It seems like a case of having the cart before the horse. In any case, provided that the review and approval of our construction plans are not delayed by a deferral on the final plat. I can go along with Bruce's and Shari's request to table the final plat to October 1, 1996. Therefore, I will not be in attendance at tonight's meeting. In addition to the final plat to be heard at the October 1 meeting, I would like approval for the Development Agreement dated May 16, 1995 to modified as follows 1. Revise Line 7 of Paragraph 23 on Page 6 to read "...though those recreational facilities will be located in the third phase of Bedford Place...". 2. Revise Exhibit B as follows: a) Change the opening paragraph to read "This subdivision is for 160 single-family dwelling units with an overall density of 4.05 dwelling units per acre. The DEVELOPER shall:" b) Change paragraph 1 to delete "excluding Finch Lateral" as the Finch Lateral is already tiled as we committed subsequent to the Development Agreement. c) Delete paragraph 9 since it will be replaced by the tot -lot and basketball court referenced in paragraph 23 of page 6 If the Mayor, Council Members or any of the staff have questions regarding this request, please do not hesitate to call. Haley September 3, 1996 City of Meridian 33 East Idaho Meridian, Idaho 83642 Re: Bedford Place Subdivision No. 3 Dear Councilmen: I have reviewed the application for Bedford Place Subdivision No. 3 and find that it includes approximately 39 homes at a median value of $110,000. We also find that this subdivision is located in census tract 103.11 and in the attendance zone for Chief Joseph Elementary, Meridian Middle School and Meridian High School. Using the above information we can predict that these homes, when completed, will house 16 elementary aged children, 12 middle school aged children, and 11 senior high aged students. At the present time Chief Joseph Elementary is at 114°s of capacity. The Meridian School District will grant approval of this development, however this subdivision will cause increased over- crowding in all three schools. There is little opportunity to shift attendance boundaries since the surrounding schools are also well over capacity. The cost per student for newly constructed schools, excluding site purchase price and of site improvements, exceeds $5,000 per elementary student and $10,000 per middle or high school student. We are in a difficult position and need your help in dealing with the impact of growth on schools. My remarks are in the same order as their memo. General Comments Discussion 1. The ditches have already been tiled and the license agreements with Nampa Meridian Irrigation District (NMID) have been delivered to Meridian City Public Works. The eastern 60 feet of the Onweiler will be completed after the irrigation season. 2. N/A. There are no existing wells. 3. Enclosed is a report depicting the seasonal grotuid water for the monitor wells. 4. Please find attached a copy of the proposed CC&R's. 5. The pressurized irrigation system is to be owned and maintained by the Home Owner's Association. 6. N/A. There are no flood zones on this property. Site Specifics Discussion l . The, revised preliminary plat which was approved by both Planning & Zoning and City Council did not provide for a pathway, nor was it a requirement. (The pathway was originally required as a part of the open space/open ditch adjacent to the southern boundary. This concept was deleted when the neighbors to the south objected to the open ditch.) However, we are offering an alternative design which has been submitted to Shari Stiles. The inlet grate was installed per the requirements of Nampa Meridian Irrigation District. The developer is willing to install additional bars on the grate with the approval of Nampa Meridian Irrigation District. In reference to the block lengths, this final plat is in substantial conformance to the preliminary plat which was submitted and approved. 2. The license agreement for the Finch Lateral has previously been submitted to Public Works. The only areas within the easement that do not allow for structures are the non-encroachable areas as outlined on the plat. 3. Notes have been modified as requested. 4. Note 11 has been deleted. However, if a recording number is provided, the note will be added back. 5. The license agreement could be recorded at the discretion of Nampa Meridian Irrigation District. We will request that they do so. 6. The compaction test results were provided to Public Works during the week of September 23, 1996. 7. The plat will be revised to provide minimum frontage on Lot 2, Block 8. 8. The lot line between Lot 9/10, Block 8 will be revised. 9. Please direct your attorney to modify the development agreement as requested. 10. No response. 11 _ Shari Stiles indicated that fencing is not required unless between incompatible uses. This development borders other compatible developments. 12. Bonding (Letter of Credit) will be provided in the amount of $20,123.26 prior to signature of the final plat (per the attached). I believe that this is just an oversight, and the Parks Director has negotiated an agreement wirh Greg Johnson tha: he can only put into place if the findings of fact and conclusions of law are amended. Attached is a copy of Bill Gigray's January 18. 2000 memo to Mayor Corey. The language in question is the sentence that was added at the end of paragraph 2.51 Drainage to any public park shall only be allowed as specifically approved in writing by the Parks Director. Is there a process by which we can re insert this inoffensive language into the findings so that the parks department can give written approval of the currently designed drainagc system? The drainage is overflow drainagc which will rarely, if ever, have any impact upon the park. I am sorry that we did not catch this. but I believe that this was the language that the council contemplated at the time of approval. Would you please take a look at this and let me know if there is a process available for making this clerical amendment to the preliminary plat approval. Very truly yours, Michael T. Attached is a copy of B111 Gigray's January 18, 2000 memo to Mayor Corey. The language in question is rhe sentence that -as added at the tnd of paragraph 2.51: Drainage to any public park shall only be allowed as specifically approved in writing by the Parks Director. Is there a process by which we can re insert this inoffensive language into the findings so that the parks department can give written approval of the currently designed drainage sysrrrll? The drainage is overflow drainage which will rarely, if ever, have any impact upon the park. I am sorry that we did not catch this. but I believe that this was the language that the council contemplated at the time of approval. On June 2& 2000, the preliminary plat was approved with the following condition: 2.51 The preliminary plat map shows a drainage facility located in the proposed "City of Meridian Park. These facilities shall be relocated within the public right-of-way of S. ice Bear Way. The condition previously stated: 2.51 The preliminary plat map shoves a drainage facility located in the proposed "City of Meridian Park." These facilities shall be relocated within the public right-of-way of S. ice Bear Way. Drainage to any public park shall only be allowed as specifically approved in writing by the Parks Director. It is the last sentence of the condition that was dropped at the final approval of the preliminary plat. Throughout the preliminary plat process, it was the intention of the development to have some storm drain in the park site and work with the Parks Department on a system that was mutually agreed on. Since the time of preliminary plat approval, we have been working with the City Staff on a design that will accommodate the needs of the City Park while allowing the development to drain a portion of the site's storm drain (an overflow area) within the park site. Briggs Engineering, the Parks Director, and the City Engineer have a design that accommodates the needs of both parties and those plans have been submitted to the Parks Director and the City Engineer for their final review and approval. However, prior to City approval of the final plat for Bear Creek Subdivision No. 1, the conditions of preliminary plat need to be revised. We respectively request the preliminary plat be placed on the September 5th City Council agenda for the modification of the Condition of Approval 2.51 to allow drainage in the park provided the design is reviewed and approved by the Parks Director.
