S i ..i c i~ TFf v~ ~4~, ??~~ ~ w,~~ ~t ~ rr ^~ r B E D F O R D P L A C E a SUBDIVISION ..e io ~ ~ N O~ xvM DooM -noaav 'N m THIRD AMENDMENT TO MASTER DECLARATION OF COVENANTS, CONDITIONS, RESTRICTIONS ANA EASEMENTS FOR BEDFORD PLACE SUBDIVISION (For Bedford Place Subdivision No. 4) April 1, 1998 RECITALS WHEREAS, there has been recorded by Brighton Corporation, as Crrantor, a Master Declaration of Covenants, Conditions, Restrictions and Easements for Bedford Place Subdivision, dated July 1, 1995, recorded September 21, 1995, a.s Instrument No. 95068758, records of Ada County, Idaho (hereafter "Master Declaration"); WHEREAS, the Master Declaration allows for the annexation of additional property to Bedford Place Subdivision, which additional property, when annexed, is brought within the provisions of the Master Declaration; and WIiEREAS, the purpose of this Third Amendment is to annex the additional property hereafter described, and upon such annexation to subject such additional property to all of the terms, covenants, conditions, restrictions and easements contained in the Master Declaration. ARTICLE L PROPERTY COVERED The property which is covered by this Third Amendment and which shall be annexed under the Master Declaration is the real property described as follows (hereafter "Annexed Property"): Lots 2 through and including 13, Block 6; Lots 2 through and including 18, Block 7; and Lots 30 through and including 39, Block 8 of BEDFORD PLACE SUB- DIVISION NO. 4, according to the official plat thereof filed in Book of Plats at Pages and _ ,records of Ada County, Idaho. ARTICLE II. DEFINED TERMS Unless the context otherwise specifies or requires, 'she words and phrases in this Third Amendment shall have the same meaning as such words and phrases are defined in the Master Declaration. THIItD AMENDMENT TO MASTER DECLARATION -1 ARTICLE ~. ANNEXATION AND DECLARATION Pursuant to Section 12.01 of the Master Declaration, the Grantor hereby declares that the Annexed Property is annexed to Bedford Place Subdivision, and brought within the provisions of the Master Declaration, and is hereby made subject to all of the covenants, conditions, restrictions and easements of the Master Declaration. ARTICLE IV. OWNERS ASSOCIATION A.s provided in Section 12.01 of the Master Declaration, upon the annexation of the Annexed Property, the Owners of the Lots within the Annexed Property shall become members of Bedford Place Owners Association, Inc. (as de5ned in the Master Declaration) with all rights privileges and obligations as all other members. ARTICLE V. EFFECTIVE DATE This Third Amendment shall be effective from and after the date it is recorded in the official Records of Ada County, Idaho.
