For good and valuable consideration, the receipt of which is hereby acknowledged, the parties agree as follows: Beaz Creek L.L.C., has provided 6 street light poles, concrete pole bases, fixtures, bulbs, and components to the residential development known as Bear Creek Subdivision No. 3 in Meridian, Idaho. The parties acknowledge that 6 street light poles and appurtenances were specially ordered items, not customarily used in residential developments in Meridian,• Idaho. 2. Bear Creek L.L.C., or it's assigns, agree to replace, repair and provide any required maintenance of any of the above mentioned street lights, and/or appurtenances thereof; that may hereafter be broken, damaged, or deteriorated, or require maintenance, at its own expense; and it is further agreed that Bear Creek L.L.C., or its heirs, successors and assigns, shall keep the lights operational at all times, it being understood by the City that bulbs, and/or ballast, do ,bum out and that the City will allow reasonable time to replace them. It is agreed that the City of Meridian authorize and pay for the electrical service to be supplied to the 6 street lights located in Beaz Creek Subdivision No. 3 in the usual and customary manner. 4. It is agreed that the City of Meridian, because Idaho Power Company will not maintain the bulbs and ballast or provide any maintenance, will enter into a Schedule 40 Agreement with Idaho Power Company, and not a Schedule 41 Agreement, which in proper cases provide that Idaho Power Company would provide maintenance, bulbs, and ballast. It is also agreed that lighting served under the Schedule 40 Agreement must be controlled by a photo electric device of the "fail o$" type. It is understood and agreed that Beaz Creek L.L.C. will assign its rights and obligations hereunder to Bear Creek Subdivision No. 3 when said Homeowners Association is formed and operational. These conditions shall be considered in full, unless ealpressly modified or deleted by motion of the Meridian City Council: LOCATION & SURROUNDING USES The subject property is located east of S. Stoddard Road, south of ~V. Overland Road, and north of W. Victory Road. The parcel(s) is currently zoned R-4. This is the third phase of the overall Bear Creek Preliminary Plat which includes 326 residential lots on 150.79 acres. The Ridenbaugh Canal borders the property an the south. Ells Run Subdivision, as well as acreages with single-family homes in Ada County, border the development to the east. The property is located in an area designated as single-family residential in the Comprehensive Plan. SITE SPECIFIC COMMENTS 1. Applicant is to meet all terms of the approved preliminary plat and development agreement 2: Applicant has indicated previously that the pressurized irrigation system within this development is to be owned and maintained by the Nampa & Meridian Irrigation District. The applicant shall be required to provide a backup source to the pressurized irrigation system. If a well or surface source is not available, asingle-point connection to the City of Meridian's 7/13/01 HUB OF TREASURE VALLEY Page 4 of 4 Works Department. 2. Any existing domestic wells and/or septic systems within this project will have to be removed from their domestic service per City Ordinance Section 9-1-4 and 9-4-8. Wells may be used for non-domestic purposes such as landscape irrigation. 3. 100-watt, high-pressure sodium streetlights will ~ required at locations designated by the Public Works Department. All streetlights shall be installed at subdivider's expense. Typical locations are at street intersections and/or fire hydrants. Final design locations and quantity are determined after power designs are completed by Idaho Power Company. The street light contractor shall obtain an approved design and permit from the Public Works Department prior to commencing installations. 4. Submit "Final" letter from the Ada County Street Name Committee, approving the subdivision and street names. Make any corrections necessary to conform. 5. Coordinate fire hydrant placement with the City of Meridian's Water Works Superintendent. 7. Provide five-foot-wide sidewalks in accordance with City Ordinance Section 12-5-2.K. 7/13/01
