These conditions shall be considered in full, unless expressly modified or deleted by motion of the Meridian City Council: LOCATION & SURROUNDING USES The subject property is located east of S. Stoddard Road, south of W. Overland Road, and north of W. Victory Road. The parcel(s) is currently zoned R-4. This is the first phase of the overall Bear Creek Preliminary Plat which includes 326 residential lots on 150.79 acres. The Ridenbaugh Canal borders the property on the south. Elk Run Subdivision as well as other acreages with single-family homes in Ada County border the development to the east. The property is located in an area designated assingle- family residential in the Comprehensive Plan. SITE SPECIFIC COMMENTS 1. Applicant is to meet all terms of the approved preliminary plat and development agreement. 2. Applicant has indicated previously that the pressurized irrigation system within this development is to be owned and maintained by the Nampa & Meridian Irrigation District. The applicant shall be required to provide a backup source to the pressurized irrigation system. If a well or surface source is not available, a single point connection to the City of Meridian's domestic water system will be allowed for the development but not for the park area due to its size. In the event that domestic water is used as a backup source, common areas within the development will be a subject to City of Meridian water assessments. Payment of water assessment fees for the common areas is required prior to city signatures on the final plat map. 3. Compaction test results must be submitted to the Meridian Building Department for all lots receiving engineered backfill. 4. The design of drainage areas shall ensure that water is retained only during 25-yeasr storm events for a period of time not to exceed 24-hours. Street signs are to be in place, water system shall be approved and activated, pressurized irrigation system approved and activated, drainage lots constructed, fencing and gates installed, and road base approved by the Ada County Highway District prior to applying for building permits. All development improvements shall be installed and approved prior to obtaining certificates of occupancy. A letter of credit or cash surety in the amount of 110% will be required for all fencing, pathways, landscaping, pressurized irrigation, sanitary sewer, water, etc., prior to signature on the final plat. 6. Applicant shall be responsible to construct a temporary trash containment fencing around the outside perimeter of this subdivision, and permanent non-combustible fencing along the common area lot line for the Ridenbaugh Canal and along that portion of Lot 2, Block 8 that borders building lots, except where the City has expressly agreed, in writing, that such fencing is not necessary. No gates will be allowed in said fence. Fencing is to be in place prior to applying for building permits. 7. Please add or revise the following notes: (1.) ...lot drainage agape over the twelve... (10.) (complete the recording information of the development agreement) (12) (add Lot 4, Block 5 and Lot 24, Block 12) (13) (remove the park Lot 2, Block $ from this note. Easements for drainage facilities within the park shall be shown iri their specific locations on the plat, and not as a blanket easement covering the entire park area.) (14) (create a note detailing the ownership and maintenance responsibilities for the drainage facilities within the park Lot 2, Block 8) What is the purpose of Lot 1, Block 9? If this lot is necessary, add it the list of lots in note 12 and possibly not 13. 9. Remove or complete the partial boundary bearing and distance calls shown adjacent to north of Lot 3, Block 8, and Lot 1, Block 7 on sheet 2, and east of Lot 1, Block 9 on sheet 1. 10. Add an arrow symbol to the plat legend that depicts front of house orientation. Place symbol on Lot 1, Block 3, toward W. Calderwood Street. An arrow is required because less than minimum street frontage is shown on the S. Beartooth Way side. 11. Graphically depict ten-foot-wide easements for public utilities, drainage, and irrigation along the eastern boundary of Lot 1, Block 6, and eastern boundary of Lot 13, Block 8, and northern boundary of Lot 3, Block 5. Additional width is required due pressurized irrigation pipelines. 12. Graphically depict five-foot-wide easements for public utilities, drainage, and irrigation along the northern boundary of Lot 9, Block 1, the southern boundary of Lot 1, Block 5, the eastern boundary of Lot 1, Block 12, and the southern boundary of Lot 10, Block 15. These lot lines will be side lot lines against future phases of this development.\ FP-00-021 Bear Creek Subdivision No. 1 Mayor and Council • October 12, 2000 Page 3 13. Lot 2, Block 3 doesn't meet the minimum 80 foot frontage required in an R-4 Zone. Make adjustments necessary to bring this lot into conformance. 14. Detailed landscaping plans for all common areas, including species, size, quantities, and locations, and pathway details must be submitted for approval to the Planning & Zoning Department prior to City Engineer signing Final Plat. 15. Sanitary sewer service to this site will be via a temporary lift station pumping to an existing gravity sewer main located in Overland- Road. The lift station shall be designed to the City of Meridian's standards and specifications. The developer and/or homeowner's association shall retain ownership and maintenance responsibilities of the lift station. The developer may enter into an operation and maintenance agreement with the City of Meridian. Applicant will be responsible to construct lateral sewer mains to and through this proposed development. Subdivision designer to coordinate main sizing and routing with the Public Works Department. Black Cat trunk development fee of $1,500.00 per dwelling unit shall be assessed against this development. Payment of the trunk development fee is required prior to signature on the final plat map by the City Engineer. 16. Water service to this site will be via extensions of existing mains installed in adjacent developments, as well as from the new domestic well site within this development. Applicant will be responsible to construct the water mains to and through this proposed development. Subdivision designer to coordinate main sizing and routing with the Public Works Department. 17. Applicant's engineer will be required to submit a signed, stamped statement certifying that all street finish centerline elevations are set a minimum of three feet above the highest established normal groundwater elevation. 18. Sidewalks are to provide a clear five-foot-wide walkway pathway without encroachment of mailbox structures. 19. Applicant shall be required to install non-sight-obscuring fencing along both sides of the pedestrian pathways, as well as bollards at both ends to prevent vehicular traffic. Fences are required to be in place prior to issuance of building permits. Deed restrictions and specific restrictions in the Restrictive Covenants will be required that prohibit lot owners adjacent to pedestrian pathways from erecting solid site-obscuring fences paralleling the pathway fencing. 20. The soils investigation report dated May 31, 1999 submitted with the application indicates that additional groundwater monitoring should be performed at an interval of every 10 days between June 7th through September 1, 1999. Provide the Public Works Department with all additional groundwater monitoring data collected from the date of the original report to the present. 21. Developer shall be required to construct, at his expense, a public parking lot on the east side of Lot 2, Block 8 as shown on the preliminary plat. Developer shall be required to construct, at his expense, a functional irrigation system in accordance with the Meridian Parks and Recreation Department and Public Works Department specifications within the public park located on Lot 2, Block 8. He shall also be required to seed the park with grass. 23. Submit copies of proposed restrictive covenants and deed restrictions for review by the City Attorney's office. 24. Staffis failure to cite specific ordinance provisions or terms of the approved preliminary plat does not relieve Applicant of responsibility for compliance. GENERAL REQUIREMENTS All irrigation ditches, laterals or canals, exclusive of natural waterways, intersecting, crossing or lying adjacent and contiguous to the area being subdivided shall be tiled per City Ordinance 12-4-13. Plans will need to be approved by the appropriate irrigation/drainage district, or lateral users association, with written confirmation of said approval submitted to the Public Works Department, 2. Any existing domestic wells and/or septic systems within this project will have to be removed from their domestic service per City Ordinance Section 9-1-4 and 9-4-8. Wells may be used for non-domestic purposes such as landscape irrigation. Two-hundred-fifty watt and One-hundred-watt, high-pressure sodium streetlights will be required at locations designated by the Public Works Department. All streetlights shall be installed at subdivider's expense. Typical locations are at street intersections and/or fire hydrants. Final design locations and quantity are determiped after power designs are completed by Idaho Power Company. Street light contractor to obtain design and permit from the Public Works Department prior commencing installations. 4. Submit "Final" letter from the Ada County Street Name Committee, approving the subdivision and street names. Make any corrections necessary to .conform. 5. Coordinate fire hydrant placement with the City of Meridian's Water Works Superintendent. 6. Provide five-foot-wide sidewalks in accordance with City Ordinance Section 12-5-2.K. 7. If possible, respond in writing to this memorandum by noon on October 17, 2000. Submit three copies of the revised Final Plat Map to the Public Works Department for compliance review prior to development plan approval.
