CPA-07-009 Request to amend the Text of the Comprehensive Plan by defining the 4 designations proposed on the Future Land Use Map and include residential uses within the existing text for neighborhood centers. 1. SUMMARY DESCRIPTION OF APPLICANT'S REQUEST The subject Comprehensive Plan Amendment (CPA) applications propose to amend both the Text and the Map of the 2002 Comprehensive Plan. The applicant, the City of Meridian Planning Department, is proposing to amend the Map for the South Meridian Area to expand the Area of City Impact (AOCI) and designate future land uses on property that will eventually be within city limits. The area of the proposed Map amendment is identified in Exhibits A.l and A.2. The proposed future land use map ("Preferred Alternative," Exhibit A.2) is the result of an eight month planning process driven primarily by public and stakeholder involvement. ACHD is currently preparing a transportation study for the subject area that will identify needed system improvements based on three future land development scenarios; Communities in Motion - Community Choices, Communities in Motion - Trend, and Meridian - proposed land uses. Since the application was submitted, in December, 2006, ACHD conducted a comprehensive transportation system analysis based on the Meridian - proposed land uses. As a result of the findings of the transportation system analysis (which indicated the need for significant system increases that are not currently planned) and outstanding concerns about the results of the public involvement process, staff prepared a revised future land use map ("Staff Response," Exhibit A.ll). The changes proposed in the "Staff Response" aim to (1) minimize impacts on the transportation system in south Meridian, and (2) more closely align with the recommendations of public meeting attendees throughout the process. Concurrently, the Planning Department is requesting to amend the Text of the Comprehensive Plan to add 4 new designations to the Future Land Use Map and include residential uses in neighborhood centers. The four new proposed land use designations are as follows: Very Low Density Residential, Medium High Density Residential, Neutraceutical Overlay, and Mixed Use - Employment (see Section 4, Application & Property Facts, and Section 8, Analysis, for more detail). The accompanying text amendment coincides with land use designations proposed in the "Staff Response" future land use map. If approved, these text changes will apply throughout the City and AOCI. South Meridian Area CPA-07-002 & CPA-07-009 CITY OF MERIDIAN PLANNING DEPARTMENT STAFF REPORT FOR THE HEARING DATE OF APRIL 5, 2007 2. SUMMARY RECOMMENDATION Staff has provided a detailed analysis of the requested CPA applications below. Staff recommends approval of CP A-07-009 per the Analysis in Section 8 and the Findings listed in Exhibit D of this staff report. Staff also recommends approval of CP A-07-002 per the same analysis and findings with the changes indicated in the "Staff Response" Future Land Use Map. However, Staff recommends that the subject CPA's be continued until April 19, 2007 to allow the public and interested entities time to review and provide comment on the "Staff Response." Continuation to April 19, 2007, will also allow the Commission adequate time to review the proposed CPA's in detail prior to making a recommendation. NOTE: The Commission is allowed to recommend amendments to the Comprehensive Plan for text changes at any time. The Commission is only allowed to recommend amendments to the Comprehensive Plan map every six (6) months. The last amendment to the land use map recommended by the Commission was on September 21, 2006, which exceeds the minimum six month requirement between that and the current request. After making a recommendation on the subject application, the Commission will have to wait at least six months before recommending any additional changes to the Map. 3. PROPOSED MOTION Continuance I move to continue Pile Numbers CPA-07-002 and CPA-07-009, to the hearing date of April 19, 2007, for the following reason(s): (1) To allow the public adequate time to review and provide comment on the proposed changes to the "Staff Response" future land use map; and (2) To allow the Commission adequate time to review the proposed CPA's in detail prior to making a recommendation. Recommend Approval I move to recommend approval to the City Council of Pile Numbers CPA-07-002 and CPA-07- 009, as presented in the staff report for the hearing date of April 5, 2007. Recommend Denial I move to recommend denial to the City Council of Pile Numbers CP A-07 -002 and CP A-07 -009, as presented in the staff report for the hearing date of April 5, 2007, for the following reasons: (you should state specific reasons for deniaL) 4. APPLICATION AND PROPERTY FACTS a. Site Address/Location: The effected area is south of the existing AOCI between McDermott Road and ~ mile west of Cloverdale Road, which is an extension of the current eastern AOCI boundary. The southern terminus of the suggested boundary extends east from the comer of Lake Hazel Road and McDermott Road to the mid-mile between Linder Road and Meridian Road, at which point it turns south. It proceeds south to the half mile between Columbia Road and Hubbard Road. Prom there, it turns east and continues to ~ mile west of Cloverdale Road. (See Exhibit A.l for project boundary.) b. Owners: South Meridian Area CPA-07-002 & CPA-07-009 CITY OF MERIDIAN PLANNING DEPARTMENT STAFF REPORT FOR THE HEARJNG DATE OF APRIL 5, 2007 There are many property owners within the area proposed for the map amendment. See Future Land Use Map, Preferred Alternative, in Exhibit A2 of this staff report for properties included within the project boundary. c. Applicant: City of Meridian, Planning Department 660 E. Watertower Street, Ste. 202 Meridian, ID 83642 d. Representative: Matt Ellsworth, Associate City Planner e. Present Zoning: RUT, RR, and Rl in Ada County f. Present Comprehensive Plan Designation: Most of the properties that are included in the subject application do not currently have land use designations assigned to them and are outside of the current Area of City Impact. However, a few parcels, most of which were the subject ofCPA-06-003 (Southeast CPA), are currently included within the boundary of the City's Future Land Use Map. These properties are primarily designated Low Density Residential, with some Medium Density Residential, Mixed-Use Community, Mixed-Use Regional, and Public/Quasi-public use designations. g. Description of Applicant's Request for a Comprehensive Plan Map Amendment (CPA-07- 002): 1. Preferred Alternative: The purpose of this application is to amend the City of Meridian Future Land Use Map. Components of the request include (1) expanding the Area of City Impact (AOCI) per the South Meridian study area boundary shown in Exhibit Al and (2) designating future land uses throughout the study area. 2. Staff Response: The purpose of this request is still the same; to amend the City of Meridian Future Land Use Map. Components of the request include (1) expanding the AOCI per the Study Area Boundary shown in Exhibit AI, and (2) designating future land uses throughout the study area. Staff recommends the designation of future land uses as shown in Exhibit All ("Staff Response). The recommended changes from the future land use map initially proposed (Exhibit A2) respond to information that came forward since the submittal of the subject application in December, 2006. h. Description of Applicant's Request for a Comprehensive Plan Text Amendment (CPA-07- 009): The requested text changes coincide with the proposed Staff Response future land use map and serve two purposes: . To add four new designations to the Future Land Use Map: Very Low Density Residential, Medium High Density Residential, Neutraceutical Overlay, and Mixed Use - Employment. . To ensure that residential uses are included in neighborhood centers. This will mandate more diverse land uses (than, for example, commercial and office), ensure transit supportive densities, and create an appropriate number of rooftops to support commercial businesses in neighborhood centers. 1. Applicant's Statement/Justification for a Comprehensive Plan Map Amendment (CPA-07- 002): "The proposed amendment provides an improved guide to future growth and development in the City in that there is currently not an adopted plan for this area. The land in South Meridian Area CPA-07-002 & CPA-07-009 CITY OF MERIDIAN PLANNING DEPARTMENT STAFF REPORT FOR THE HEARING DATE OF APRIL 5, 2007 the area is primarily zoned Rural Residential (RR) and Residential 1 (Rl) in Ada County, which allow for one unit per ten acres and one unit per acre respectively. With City services extending south of 1-84 near Linder Road in spring 2007, and the Ten Mile Interchange programmed for construction in 2009, this area will experience considerable development pressure in the near future. The proposed amendment outlines future land uses that are compatible with one another and that respect the wishes of current residents and land owners. It provides a guide to both decision makers and developers as new projects are planned and the area begins to urbanize." Note: Justification for a Comprehensive Plan Map Amendment is the same for both the Preferred Alternative and Staff Response. J. Applicant's Statement/Justification for a Comprehensive Plan Text Amendment (CPA-07- 009): . "The addition of the Very Low Density Residential designation allows the City to grow as recommended by affected residents throughout the South Meridian Planning Process. It will preserve the rural feel of areas so designated while providing more diversity in housing choices (larger, estate lots) and allowing long-term preservation of agricultural land and open space. . The Medium High Density Residential designation' allows for transit supportive densities at intensities that are more appropriate for areas such as South Meridian. It also corresponds more specifically to the R-15 zone than any land use designation currently recognized by the City. . The Neutraceutical Overlay allows the opportunity to locate and create businesses that are mutually beneficial to/with the agricultural and growing operations that currently existing in South Meridian. At the same time, it will help to create living wage jobs in western Ada County. . The Mixed Use - Employment designation responds to the need for job creation in Meridian. Mixed Use - Employment areas, unlike the existing Mixed Use designations, emphasize employment uses over retail. Any retail uses proposed must serve the employment uses in these areas." 5. PROCESS FACTS . Planning Process a. Public Meeting I: Study area boundary identification - April 12, 2006 (Exhibit A8) The purpose of the first public meeting in the South Meridian Planning Process was to discuss community identity and priorities of area residents. One hundred seventy six people attended the meeting, and seventy six comment forms were submitted by meeting attendees. After reviewing the results of a dot mapping exercise in which participants indicated (1) where they live and (2) the community with which they most closely identify, City Council established the study area boundary (Exhibit A2) on April 18, 2006. b. Public Meeting 2: Visioning - July 20, 2006 (Exhibit A9) The purpose of the second public meeting in the South Meridian Planning Process was to further refine the vision of residents and stakeholders for the planning area. Seventy people attended the meeting and participated in workgroups that considered development patterns, the transportation network, community amenities, future business and employment opportunities, and the overall preferred character of the area. Responses provided by meeting attendees South Meridian Area CPA-07-002 & CPA-07-009 CITY OF MERIDIAN PLANNING DEPARTMENT STAFF REPORT FOR THE HEARING DATE OF APRIL 5, 2007 stressed sound planning, responsible growth, ruralJagriculturallifestyle preservation, and adequate infrastructure provision (roads in particular) as the most important elements for the area. Based on input received in the first two public meetings, the project team developed three alternative land use maps to present to the public at a third public meeting (Exhibit AS, Exhibit A6, and Exhibit A 7). The alternatives each focused on specific land use elements or community components to continue the dialogue and further refine the future land use map for the area. One alternative emphasized low density residential development, one emphasized job creation, and the third proposed transit supportive densities along major transportation corridors. c. Public Meeting 3: Alternatives - September 20,2006 (Exhibit AlO) The purpose ofthe third meeting was for the public to review the alternative land use maps and provide direction to the project team about appropriate future land uses in the study area. A majority of participants (59%) stated a preference for the land use alternative that emphasized low density residential development patterns. Parks and open space were identified as a priority for many area residents. Participants also reiterated a desire for smaller-scale commercial service provision (to meet day-to-day shopping needs) in the study area. Some attendees encouraged the creation of employment opportunity areas in South Meridian. Note: All three public meetings were noticed by post cards mailed to every address in the study area, emai/, and media release. . Subject Application a. The subject application will in fact constitute a Comprehensive Plan Future Land Use Map Amendment as determined by City Ordinance. By reason of the provisions of the Unified Development Code, Title 11, Chapter 5, a public hearing is required before the Commission and City Council on this matter. b. The subject application will in fact constitute a Comprehensive Plan Text Amendment as determined by City Ordinance. By reason of the provisions of the Unified Development Code, Title 11, Chapter 5, a public hearing is required before the Commission and City Council on this matter. c. Newspaper notifications for CPA-07-002 were published on: March 19, 2007, and April 2, 2007 d. Newspaper notifications for CPA-07-009 were published on: March 19, 2007 and April 2, 2007 e. The Public Service Announcement for CP A-07 -002 was aired on: March 9, 2007 and March 30, 2007 f. The Public Service Announcement for CPA-07-009 was aired on: March 15, 2007 and March 30,2007 6. LAND USE a. Existing Land Use(s): Rural residential properties and agricultural land. b. Description of Character of Surrounding Area: Mostly rural residential properties and agricultural land, with a few urban residential subdivisions on the outskirts of the project boundary. d. History of Previous Actions: South Meridian Area CPA~07-002 & CPA-07-009 CITY OF MERIDIAN PLANNING DEPARTMENT STAFF REPORT FOR THE HEARING DATE OF APRil. 5, 2007 :> Meridian's existing AOCI boundary to the south was last updated upon adoption ofthe Comprehensive Plan in 2002. :> A Comprehensive Plan Map Amendment for Southeast Meridian was approved on October 24, 2006 (CP A-06-003). This CPA extended future land uses within the City of Meridian south to Columbia Road, west to Meridian Road and east to Eagle Road and modified some of the existing land use designations on the map along Amity Road, between Meridian Road and Eagle Road. (The geographic area of the subject South Meridian CPA entirely encompasses the area impacted by the Southeast Meridian CPA.) e. Existing Constraints and Opportunities: 1. Public Works Location of sewer: Sewer will be provided to the properties encompassed by this Comprehensive plan in three distinct sewer sheds. All sheds will be serviced by a separate regional lift station with pressure sewer lines back to the existing systems. The lift stations will be planned, installed and maintained by the City of Meridian but a majority of the distribution system will all be developer driven. Location of water: The properties will receive water service via extension of mains in approved developments. New pressure zones will be necessary with the elevation changes in the properties included in this application and the City of Meridian has already begun planning for new well locations. 2. Vegetation: There are numerous existing trees on the subject properties that should either be preserved or mitigated for at the time of development. 3. Flood plain: The City of Meridian's existing FEMA mapping does not show any of the subject south Meridian area properties lying within the floodway; however, some properties that are adjacent to Mason Creek and Ten Mile Creek are within flood zone A. Per City of Meridian resolution all properties encumbered by a FEMA flood zone designation of an A category shall submit a Flood Plain Development Pennit prior commencement of any work. 4. Canals/Ditches Irrigation: The Ridenbaugh Canal, Rawson Canal, Ten Mile Creek, Mason Creek, Carlson Lateral, Calkins Lateral, Farr Lateral, Stevens Lateral, and the Beckdolt Lateral all course through this area. There are also several smaller irrigation/drainage ditches in this area. 5. Hazards: Staff is not aware of any potential hazards within the project boundary. 6. Proposed Zoning: No annexation or zoning is proposed with this application. 7. Size of Property: 17.8 square miles or 11,392 acres +/- 7. COMMENTS MEETING On March 16, 2007, Planning Staff held an agency comments meeting. The agencies and departments present included: Meridian Fire Department, Meridian Parks Department, and Meridian Public Works Department. The meeting focused on the "Staff Response" future land uses (Exhibit A.ll). However, as no new development is proposed, the meeting was for informational purposes only; Meridian Fire and Parks and Recreation were the only departments providing comment (please see Exhibit Cl, Exhibit C2, Exhibit C.3, and Exhibit C.4). 8. ANALYSIS South Meridian Area CPA-07-002 & CPA-07-009 CITY OF MERIDIAN PLANNING DEPARTMENT STAFF REPORT FOR THE HEARING DATE OF APRIL 5, 2007 PROPOSED FUTURE LAND USE MAP The following factors and studies led staff to recommend revisions to the future land uses proposed in CPA-07-002. A Public Involvement Process: The proposed future land use map (Exhibit 2.A) is the result of a public involvement-oriented planning process as outlined in Section 5. Throughout the process, meeting attendees and interested stakeholders stated a preference for primarily low density residential uses in the study area. Open space was also identified as a priority by area residents. Many meeting attendees indicated an interest in some day-to-day commercial businesses in the study area, and others expressed a desire for transit services in the study area. Attendees also indicated that higher- intensity land uses are only appropriate along major transportation routes. Participants strongly stressed the importance of providing adequate transportation infrastructure throughout the study area. Staff incorporated these elements in the proposed future land use map that is the subj ect of CP A- 07-002. Low density residential uses are proposed in the majority of the study area (70.4%). Two Neighborhood Centers, both designated Mixed-Use Neighborhood, are also proposed; one at the corner of Locust Grove Road and Lake Hazel Road and one at the corner of Amity Road and Black Cat Road. The Neighborhood Centers are intended to meet day-to-day shopping needs of residents in South Meridian. Higher density residential uses, primarily Medium Density Residential, are proposed along Lake Hazel Road, Meridian Road, Ten Mile Road, and Amity Road to increase the viability of these corridors as future transit routes. Although quantitative comments received by staff from the public indicate a desire for an abundance of land designated as Low Density Residential throughout the study area, informal conversations with and qualitative comments from area residents indicate a desire to preserve the rural and agricultural character of South Meridian. Members of the public expressed support for Low Density Residential uses to convey this sentiment, but staff is confident that they do not envision urban levels of low density residential development throughout the study area (please see "Meeting Summaries" - Exhibit A8, Exhibit A9, and Exhibit AIO). In addition, conversations with COMPASS staff indicate that most of the higher density residential uses proposed in the subject application (primarily Medium Density Residential) along major transportation corridors identified in Communities in Motion are not dense enough to support transit services. B. Market Study: According to a market study prepared in conjunction with the South Meridian Area Plan, the study area will attract between 5,000 and 50,000 new residents between now and 2030. However, the market study notes that only a limited number of potential new residents will be able to afford homes built in conventional low density areas ofless than three units per acre (as many as 75% will be priced out ofthese areas). The market study stresses the need to promote greater diversity in housing stock than Meridian has traditionally experienced. Fewer large-lot homes and more multi.family, higher density units are needed. C. ACHD Transportation Study: ACHD is currently finalizing a transportation plan for the South Meridian area. ACHD staff anticipates that the plan will go before the ACHD Commission for consideration in summer, 2007. The purpose ofthe South Meridian Transportation Plan is to identify future roadway, South Meridian Area CPA-07-002 & CPA.07-009 CITY OF MERIDIAN PLANNING DEPARTMENT STAFF REPORT FOR THE HEARING DATE OF APRIL 5, 2007 intersection, and corridor needs, provide a framework for future roadway improvements based on proposed land use designations, and develop access management standards that will allow the network to function in an acceptable manner. The southern boundary of the Transportation Plan is the same as the southern study area boundary for the subj ect CPA. The Transportation Plan considers future traffic and transportation system needs based on three land use scenarios: Communities in Motion - Community Choices, Communities in Motion - Trend, and Meridian - proposed land uses. The results of all three analyses were distributed to ACHD, COMPASS, and City staff in January, 2007. Land uses proposed in the subject application yield the following results when compared to Communities in Motion - Community Choices (which is the accepted forecast in the adopted regional long range transportation plan for the Treasure Valley): . 23,244 more households (approximately 70,829 more residents). . 31 of 66 roadway segments experience between 25% and 100% increase in ADT. . 9 of 66 roadway segments experience greater than 100% increase in ADT. . Ten roadway miles require three lanes to achieve LOS D during peak hour (as opposed to twenty seven in Community Choices). . Thirty seven roadway miles require five lanes to achieve LOS D during peak hour (as opposed to thirty six in Community Choices). . Nineteen roadway miles require seven lanes to achieve LOS D during peak hour (as opposed to three in Community Choices). . Even with the extensive improvements recommended, two intersections (Overland Road/Meridian Road and Overland RoadlVictory Road) function at Level of Service F in either AM or PM peak hour. RECOMMENDED CHANGES Considering the factors outlined in Section 8.A- 8.C, staff prepared the revised future land use map titled "Staff Response" (Exhibit A.ll). The revised future land use map seeks to achieve the following outcomes: . Lower the total number of new households in the study area thereby decreasing demands placed on the transportation system. . Decrease the overall number oflarge acre lots. . Increase densities along major transportation corridors identified in Communities in Motion to levels that will support transit services. . Promote the diversity of future housing types available in the study area. . More closely align with public comments received throughout the planning process. Transportation System: Estimates based on the "Staff Response" land uses indicate that there will be approximately 20,907 new housing units in the study area upon buildout This is a decrease of over 7,000 units from the land uses proposed in Exhibit A.2, which result in approximately 28,000 units. The decrease in future housing units impacted the transportation system as follows: . Eighteen roadway miles require three lanes to achieve LOS E during peak hour (as opposed to twenty eight in Community Choices). South Meridian Area CPA-07-002 & CPA.07-009 CITY OF MERIDIAN PLANNING DEPARTMENT STAFF REPORT FOR THE HEARING DATE OF APRIL S, 2007 . Thirty five roadway miles require five lanes to achieve LOS E during peak hour (as opposed to thirty six in Community Choices). . Thirteen roadway miles require seven lanes to achieve LOS E during peak hour (as opposed to two in Community Choices). . The mile-to-mile need for additional lanes is consistent; roadways require fewer lanes in more rural areas and progressively more as they continue into higher density areas. Needed improvements were at times more haphazard with the land uses proposed in Exhibit A2 (i.e. a road would need five lanes for two miles, then seven lanes for two miles, then five lanes for a mile, followed by seven lanes, etc.). . No intersections operate at LOS F at any time. The proposed development pattern is still a departure from Communities in Motion. However, impacts to the transportation system with the "Staff Response" land uses are less significant than those with the land uses proposed in Exhibit 2.A Large Acre Lots: Based on the land uses in Exhibit 2.A there will be approximately 11,383 residential units on larger lots (within areas designated Low Density Residential) upon buildout ofthe study area. Based on the land uses proposed in the "Staff Response" (Exhibit All) there will be approximately 6,234 residential units on larger lots (within areas designated Very Low Density Residential or Low Density Residential) upon build-out ofthe study area - a decrease of 5,149 units. Future Transit Corridors: Communities in Motion identifies future transit routes on Ten Mile Road, Meridian Road, Amity Road, and Lake Hazel Road. The "Staff Response" future land use map proposes transit nodes along these corridors that will require residential development at transit supportive densities. Housing Stock Diversity: The land uses proposed in Exhibit A2 will yield the following number of housing units per land use designation: - Low Density Residential: - Medium Density Residential: 11,383 units 14,625 units - High Density Residential: 940 units - Neighborhood Centers: 959 units This development pattern, and the resulting housing stock, is similar to that which currently exists in Meridian. The land uses proposed in the "Staff Response" will yield the following number of housing units per land use designation: - Very Low Density Residential: 1,691 units - Low Density Residential: 4,543 units - Medium Density Residential: 6,061 units - Medium-High Density Residential: 7,334 units - Neighborhood Centers: 1,278 units The "Staff Response" encourages the development of more housing products than typical development patterns in Meridian. Responsiveness to Public Comment: The "Staff Response" land use map adheres more closely to the preferences of the public by identifying areas for rural housing and open space, promoting transit supportive densities along major transportation corridors, providing business services to meet day-to-day South Meridian Area CP A.07.002 & CP A.07.009 CITY OF MERIDIAN PLANNING DEPARTMENT STAFF REPORT FOR THE HEARING DATE OF APRIL 5, 2007 needs of area residents, and providing employment opportunity areas in South Meridian. The "Staff Response" also provides appropriate buffers between uses using either transitional land uses (Medium- High Density Residential to Medium Density Residential to Low Density Residential, for example) or natural barriers (such as creeks, canals, and major roadways). Components of the "Staff Response" land use map include: Very Low Density Residential (new designation): This designation would allow residential development on lots three acres or larger. Planning staff recommends this designation in areas specifies in Exhibit All ("Staff Response") for the following reasons: 1. Efficient Service Provision: Planning staff communicated periodically with Public Works staff throughout this planning process. Public works indicated that, while the City has planned to and is capable of providing water and sewer services anywhere in the study area (please see Exhibit A3 and Exhibit A4), some areas are more efficient to serve than others. The main reasons for certain areas standing out as less efficient to serve is parcel size and existing development; there are non-farm and cluster subdivisions, especially in the western portion ofthe study area, that are not likely to redevelop in the near future (see Exhibit A 12). A majority ofthe smaller lots with existing residential uses in the study area are within the same sewer shed, so by allowing current development patterns to continue (greater than three acre lots that do not receive City services), the City can focus on higher priority and more efficient service areas. 2. Transitional Areas Between Communities: Areas designated Very Low Density Residential that are outside of the sewer shed identified in Exhibit A 12 provide a transitional area between Meridian and neighboring communities to the west and south. 3. Public Comment: Very low density areas also allow opportunities for open space preservation, decrease the total number of households in the study area, and adhere to comments received throughout the public involvement process to maintain the rural feel of South Meridian. Note: The City's Future Land Use Map states that "In residential areas, other residential densities will be considered without requiring a Comprehensive Plan Amendment. However, the density can only be changed one "step" (i.e. low to medium, not low to high, etc.)." Therefore, an applicant can request zoning otherwise consistent with a Low Density Residential designation within areas designated Very Low Density Residential, and the Commission and Council can consider said requests based on the benefit of the action to the City without an amendment. Note: Including parcels that may not receive City services in the near future in the AGCI is not consistent with the USP A element of the Comprehensive Plan. Staff is currently exploring potential implementation options for Very Low Density Residential areas, and will revisit the USP A section of the Comprehensive Plan if the subject CPA is adopted and when implementation measures are determined. Note: The northwest corner of Linder Road and Amity Road is within the sewer shed identified in Exhibit A.I2. The Medium Density Residential designation of the corner is consistent with the Future Land Use Map adopted in 2002 and amended in 2006. Staff feels that to deviate from the land use identified in the adopted Future Land Use Map, and to impose a Very Low Density Residential designation, would be unfair to the land owner(s). Low Density Residential: Areas designated as Low Density Residential contribute to the diversity of future housing stock and provide transitions between higher and lower intensity land uses. Medium Density Residential: Areas designated as Medium Density Residential contribute to the diversity of future housing stock and provide transitions between higher and lower intensity land uses. Medium-High Density Residential (new designation): Medium-High Density Residential uses are South Meridian Area CPA-07-002 & CPA-07-009 CITY OF MERIDIAN PLANNING DEPARTMENT STAFF REPORT FOR THE HEARING DATE OF APRIL 5, 2007 proposed along major transportation corridors and in close proximity to proposed Neighborhood Centers and Mixed Use areas. This designation will encourage transit supportive densities, but at a lower intensity than allowed in High Density areas as recognized in the Comprehensive Plan. This balances desires to achieve transit supportive densities on major transportation routes with suggestions to maintain the rural feel of the area (i.e. these densities are more easily buffered than traditional high density uses). Neighborhood Centers: Two Neighborhood Centers are proposed in the study area to meet the day- to-day commercial needs of area residents and to provide a sense of place for the surrounding community. The locations proposed for Neighborhood Centers are at intersections of one principal and one minor arterial roadway (Lake Hazel/Locust Grove and Amity/Black Cat). The principal arterial roadways will provide traffic counts necessary to make the locations attractive from a development perspective. The minor arterial roadways will allow convenient access to businesses in the Neighborhood Centers without requiring multiple accesses directly to the principal arterial streets. CP A~07-009 proposes that "Forty percent of all land within Neighborhood Centers shall be developed for residential uses." This will ensure greater diversity of uses within Neighborhood Centers. The Neighborhood Center discussion in the Comprehensive Plan (pg. 101) also states that "If developing a conventional mixed use proj ect, four specific design elements must be incorporated into the development: a) street connectivity, b) open space, c) pathways, and d) not below eight (8) dwelling units per acre" (emphasis added). The proposed addition will require the development oftransit supportive residential densities within Neighborhood Centers. Mixed Use - Employment (new designation): The area designated as Mixed Use - Employment is included at the suggestion of residents to create employment opportunities in the study area. It will also help to offset the jobs housing imbalance in the region. Emphasizing employment uses with limited retail at the comer of Lake Hazel Road and Meridian Road (both principal arterials) will allow for more restrictive access control than other commercial uses. This will allow the intersections, and therefore the roadways, to continue to serve their necessary function in the regional transportation system. Mixed Use - Community: The southwest comer of Meridian Road and Amity Road is designated Mixed Use - Community in the "Staff Response" land use map. This adds balance with the other three comers of the intersection, but at intensities that will not require the same frequency of roadway access that may be necessary with higher-intensity uses. Neutraceutical Overlay (new designation): The location of the Neutraceutical Overlay was chosen because it is adjacent to a major east/west transportation route (Lake Hazel Road) and in close proximity to a planned major north/south transportation route (Future SH 16 in the vicinity of McDermott Road) The location also allows easy access to the proposed Mixed Use - Employment area at the comer of Meridian Road and Amity Road. Parks: There are nine future park locations identified on the "Staff Response" land use map. The future park location near the corner of Black Cat Road and Overland Road was selected to encourage redevelopment for public use in the event that the existing gravel pit at that location ceases operations. Other park locations were chosen along proposed pathways identified in CP A-07 -003 and in areas that are accessible by a large number of residents (i.e. in or near higher density designations). Note: Future pathway locations are not shown on the "Staff Response" map as they are the subject of another active Comprehensive Plan Amendment. Schools: Planning staff met with a representative of Joint School District No.2 to discuss future school locations in South Meridian. The representative indicated that the District is considering certain sites in the study area, and those sites are included in the "Staff Response" map. Other locations are proposed in each square mile of the study area (which is consistent with the City's South Meridian Area CP A-07-002 & CP A-07-009 CITY OF MERIDIAN PLANNING DEPARTMENT STAFF REPORT FOR THE HEARING DATE OF APRil.. 5, 2007 Future Land Use Map) with the exception ofthose designated primarily Very Low Density Residential. Fire Stations: Four future fire station locations are identified in and in the immediate vicinity ofthe study area. The location on the northeast comer of Meridian Road and Amity Road is consistent with the City's Future Land Use Map, as is the location on Lake Hazel Road east of Locust Grove Road. At the suggestion of the Meridian Fire Department, one new location is proposed on Amity Road at the half mile between Ten Mile Road and Black Cat Road. The station location shown west ofTen Mile Road and south of Lemont Road on the City's Future Land Use Map was moved to the east side ofTen Mile Road and north of Lemont Road for consistency with Southridge Subdivision. All locations are depicted on the "Staff Response" map as recommended by the Fire Department. Potential Transit Location: A future transit location is proposed on the southwest comer ofl-84 and Ten Mile Road to indicate the need for a future park and ride lot. This location will allow residents of Kuna and eastern Canyon County a convenient transfer point from personal vehicles to public transportation along 1-84 in the future. In addition, the following factors were considered and are pertinent to the proposed future land use map in Exhibit A.l1 ("Staff Response"): Southeast CPA (CPA-06-003): Planning staff has met with the applicant ofCPA-06-003, which was adopted on October 24, 2006. Staff does not recommend changing the park and school locations approved with CPA-06-003 ("Staff Response" reflects the same locations). The Neighborhood Center on the comer of Locust Grove Road and Amity Road also remains unchanged. Staff has revised the proposed future land uses and configurations. The developer is aware of the proposed changes. Study Area Boundary: The City of Kuna has annexed several parcels south of Lake Hazel Road and west of Meridian Road within the study area. It therefore makes sense to scale the boundary of the proposed Area of City Impact back to reflect these recent annexations. The City Councils of Meridian and Kuna plan to meet at a date to be determined to discuss future city limit boundaries. Pending the outcome of that discussion, however, it is premature to revise the study area boundary. COMPREHENSIVE PLAN - POLICIES AND GOALS Staff finds the following Goals, Objectives, and Action items contained in the 2002 Comprehensive Plan to be applicable to this application (staff analysis is in italics below policy): . Chapter VII, Goal I, Objective D, (page 110) - Plan for appropriate uses within rural areas. Expanding the AGCl and assigningjuture land uses to the south Meridian area for future expansion of the city will allow the City to planjor future uses that are suitable to the existing and future rural uses in this area. . Chapter VII, Goal I, Objective D, Action 7 (page 110) - Permit schools, churches, and other public and quasi public uses in rural areas, that are compatible with adjacent uses. The proposed Future Land Use Map attached in Exhibit A.2 of this staff report depicts several schools, fire stations, neighborhood and community parks, and park & ride locations in the south Meridian area. These public/quasi-public designations are placed strategically according to the surrounding uses planned for this area in order to provide essential services needed for juture development. . Chapter VII, Goal IV, Obj ective C, Action 10 (page 113) - Support a variety of residential categories (1ow~, medium-, and high-density single-family, multi-family, townhouses, duplexes, South Meridian Area CP A-07-002 & CP A-07-009 CITY OF MERIDIAN PLANNING DEPARTMENT STAFF REPORT FOR THE HEARING DATE OF APRlL 5, 2007 apartments, condominiums, etc.) for the purpose of providing the City with a range of affordable housing opportunities. The proposed CPA's recommend two additional residential land use designations, Very Low and Medium High Density Residential. The addition of these designations will provide for a wider variety of residential categories in this area. The Very Low Density Residential designation will preserve the rural feel of areas so designated while providing long term preservation of agricultural land and open space. The Medium High Density Residential designation will allow for transit supportive densities at intensities that are more appropriatefor areas such as the South Meridian area. STATE REQUIRED COMPREHENSIVE PLAN ANALYSIS Idaho's counties and cities are required by law, Idaho Code 67-6508, to prepare, implement, review, and update a comprehensive plan which outlines goals and policies for land use. Fourteen elements which must be addressed in the plan are listed in the Code. It is the detailed ordinances that then spell out how these policies are to be achieved. The order in which the following policies are presented implies no order or priority. a. Community Design The purpose of this element is to ensure a pattern of planned growth resulting in orderly and attractive developments within the City of Meridian. The South Meridian Area CPA specifically addresses future land uses within the study area. The proposed "Very Low Density Residential" designation will assist in providing a transition between the existing rural residential and agricultural uses and urban level residential densities. The proposed "Medium High Density Residential" designation will allow for more transit supportive densities along transportation corridors. The proposed "Neutraceutical Overlay" will allow for the operation of businesses that will complement the existing agricultural and other growing businesses in the South Meridian area, which will create more jobs in western Ada County. And finally, the proposed Mixed Use- Employment designation will emphasize employment uses over retail and will create more jobs within this area ofthe City. b. Population The City of Meridian must ensure that population growth is accommodated in an orderly pattern. Residential and commercial developments must be easily served by City infrastructure and public services. The densities proposed in the plan have been reviewed by the Public Works Department and they are confident that all necessary public utilities can serve this area. The proposed plan also references demographics and population within the study area and the city. c. Housing The City of Meridian is charged with ensuring adequate and attractive living environment which meets the needs of City residents of different ages, family sizes, lifestyles, and income levels. The proposed plan includes the existing residential land use designations (Low, Medium and High) and proposes to add two new residential designations (Very Low and Medium High) that will also allow for more diverse housing types. Staff is supportive of further defining the residential housing types that will be allowed in this area. The comprehensive plan specifically addresses the need for providing various types of housing within the city. d. Economic Development Meridian's economic base has been gradually shifting over the last 20 years from a fanning-based economy to a retail, service, and manufacturing-based economy. During this time, local policy with regard to the types of lands needed to support the economic and employment needs of the South Meridian Area CPA-07-002 & CPA-07-009 CITY OF MERIDIAN PLANNING DEPARTMENT STAFF REPORT FOR THE HEARING DATE OF APRIL 5, 2007 community has also changed. The 2002 Comprehensive Plan forecasts the need to continually adjust the provision of commercial lands in order to gradually broaden economic opportunity throughout the City. The proposed South Meridian Area Plan specifically addresses the need for more job opportunities within the city. To achieve this, the plan includes two new land use designations that are designed to promote job growth and business within the city. These proposed designations are the "Neutraceutical Overlay" and "Mixed Use - Employment" designations. Staff believes that these new designations will help to promote various types of employment opportunities within the city. e. Public Services, Facilities, and Utilities The purpose of this element is to ensure that all public services and facilities are accounted for with new development. The Public Works Department is confident that all necessary services can be provided to this area based upon the proposed densities and projected population. f. School Facilities and Student Transportation The purpose of this element is to direct new residential development to areas with adequate school facilities and student transportation. The proposed plan specifically designates 11 new locations for school facilities in each square mile of the study area with the exception of those areas designated primarily Very Low Density Residential. These school locations are adjacent to major transportation corridors and should be accessible by various forms of transportation. g. Transportation The purpose of this element is to promote an efficient and safe transportation system within the City. A future transit location is proposed on the southwest comer ofl-84 and Ten Mile Road for a future park and ride lot. This location will allow residents ofKuna and eastern Canyon County a convenient transfer point from personal vehicles to public transportation in the future. Further, the higher density residential designations proposed along major transportation corridors will assist in providing transit supportive densities. h. Natural Resources The purpose of this element is to promote conservation of areas of natural significance, where appropriate. Staff does not believe that future development of this area will significantly pollute or degrade the natural environment. i. Special Areas The subject amendment directly addresses the need for the preservation and planning of significant natural resources such as the Ridenbaugh Canal, Rawson Canal, Ten Mile Creek, Mason Creek, Carlson Lateral, Farr Lateral, Stevens Lateral, and the Beckdolt Lateral, which all course through the South Meridian area. The plan designates the land adjacent to these natural features with green space that is to be used for pathways and other amenities (for further detail see the discussion of recreation below). J. Hazardous Areas The purpose of this element is to ensure regulation of development in hazardous areas, such as floodplains, unstable slopes, etc. No hazardous areas have been identifies within the study area. k. Recreation Recreation resources within Meridian include seven City parks totaling approximately 65 acres. The City is in the process of developing new park facilities. The City also maintains several pathways. The proposed plan will add to the recreation opportunities already available in the city. The plan sets aside lands to be used as parks, pathways, open space and other recreational uses. South Meridian Area CPA-07-002 & CPA-07-009 CITY OF MERIDIAN PLANNING DEPARTMENT STAFF REPORT FOR THE HEARJNG DATE OF APRlL 5, 2007 These areas are specifically identified on the plan as Open Space or Park, Community Parks, Neighborhood Parks, and Proposed Trails. 1. Land Use The policies of this element are presented in the Comprehensive Plan Land Use Map. The Map is a graphic representation of the policies and goals of Meridian's Comprehensive Plan. The Map has been prepared to identify suitable areas for future residential, commercial, and industrial development. The Map is designed to be a projection of growth patterns for the City. Therefore, the Map is to be used as a guide for decisions regarding request for land use changes. As discussed above, the applicant is proposing to amend the Map by expanding the AOCI and assigning land use designations for future expansion of City limits. These designations are shown on the future land use map shown in Exhibit A.2. Along with the map change, a text amendment is also proposed which will include 4 new land use designations as stated above. m. Implementation The City provides the necessary staff and facilities to administer and enforce the policies and goals of the Comprehensive Plan. The City of Meridian Planning Department will administer the Comprehensive Plan and its policies, under the direction and supervision of the Meridian City Council. The Planning & Zoning Commission is also authorized by the Council to review, approve and make recommendations on proposals affecting the public's interest in land use. n. Property Rights The purpose of this element is to ensure that the land use policies, restrictions, conditions, and fees do not unconstitutionally violate private property rights, and establish a consistent review process that enable the City to ensure that any proposed actions will not result in an unconstitutional taking of private property without due process of law. Staff believes that the Comprehensive Plan Land Use Map change, as initiated by the Meridian Planning Department, would not unconstitutionally deprive the owners of economically viable uses of the subject properties. 9. UNIFIED DEVELOPMENT CODE No amendments to the Unified Development Code are being proposed with the subject CPA applications. 10. SUMMARY AND RECOMMENDATION Staff recommends approval of CPA-07-009 per the Analysis in Section 8 and the Findings listed in Exhibit D of this staff report. Staff also recommends approval of CPA-07-002 per the same analysis and findings with the changes indicated in the "Staff Response" Future Land Use Map. However, Staff recommends that the subject CPA's be continued until April 19, 2007, to allow the public and interested entities time to review and provide comment on the "Staff Response." Continuation to April 19,2007, will also allow the Commission adequate time to review the proposed CPA's in detail prior to making a recommendation. 11. EXHIBITS A. Fire Department (a) 1.1 Any building greater 30' in height shall require roadways to be a width of 26', placed a minimum of 15' from the building and no farther than 30' from the front of the building per D105 of the Intemational Fire Code. The surface of the roadway shall be capable of supporting 75,000 lbs. 1.2 The most remote part ofunsprinklered buildings shall be within 150' of the fIre department access roads as measured around the perimeter of the building. 1.3 All occupancies shall meet the applicable requirements of the International Building and Fire Codes as adopted by the City of Meridian. 1.4 Fire flows shall be provided per Section 508 of the International Fire Code with fIre flow and hydrant spacing per Appendix B & C. 1.5 Based on the proposed street widths some parking restrictions may be imposed to provide the minimum widths required by the International Fire Code. 1.6 This area lies outside of the fIve-minute response zone goaL Achievement of this goal is subject to budgetary constraints and is intended to enhance the probability of a favorable outcome on a request for Advanced Life Support. Required Findings from the Unified Development Code 1. Comprehensive Plan Amendment Findings Upon recommendation from the Commission, the Council shall make a full investigation and shall, at the public hearing, review the application. In order to grant an amendment to the Comprehensive Plan, the Council shall make the following findings: a. The proposed amendment is consistent with the other elements of the Comprehensive Plan. Staff finds that the proposed change to the Future Land Use Map does not directly conflict with other elements of the Comprehensive Plan. b. The proposed amendment provides an improved guide to future growth and development of the city. Staff finds that the proposal to modify the Future Land Use Map will provide a guide for future growth and development in this area of the City in which the majority ofland currently has no future land use designations assigned. c. The proposed amendment is internally consistent with the Goals, Objectives and Policies of the Comprehensive Plan and the Comprehensive Plan Land Use Map. Stafffmds that the proposed amendment is internally consistent with the Goals, Objectives, and Policies of the Comprehensive Plan. Staff recognizes the existence of rural residential and agricultural properties in this area and believes that the four new proposed land use designations, in addition to the existing land use designations, will allow this area to develop in a manor that will complement the existing uses and provide needed services in this area of the City. Please reference Section 8, Analysis, Idaho State Code, Local Land Use Planning Act, for more detail. d. The proposed amendment is consistent with the Unified Development Code. Staff finds that the proposed amendment is consistent with the Unified Development Code. No development approvals will be granted as part of this CPA application; all subsequent development applications shall comply with the unc. e.
