In reponse to Commissioner Smith's concerns, we have contacted
Mr. Daniel P. Thomas from Sun Valley Car Wash / Hana-Sherman who will
be supplying the carwash equipment. Mr. -Thomas has indicated that
based on an estimated 28,000 cars per day (A.C.H.D.'s Aug. 1996
traffic count of 24,822), on Fairview Avenue, and using an industry
factor of .74 percent, we can expect 210 cars per day to utilize the
carwash facility.
Mr. Thomas also indicates that we could accommodate approximately
1500 cars per day before we would be backed up into the easement
roadway. (Please see letter dated 6-30-97)~
Our client, Mr. Steve Bainbridge has informed us that time is of the
essence and that in order to expedite matters he has reached an
agreement with Mr. Kouba to relocate and to add additional-parking to
the South of the. parcel. This will not only eliminate cars backing
into the roadway .easement but will also allow space to stage up to
eight additional vehicles..
Enclosed please find a revised site plan reflecting the above changes
which we feel should satisfy Commissioner Smith's concerns regarding
the site plan. Mr. Joe Numbers (project architect) will address the
building materials to the. City Council.

Please find enclosed the original of the DEVELOPMENT AGREEMENT prepared
as per instructions from the Council meeting of September 17, 2002, for the owners/developers
signatures.
Since the set of Findings of Fact and Conclusions of Law for the above matter were
approved and revised as of 6-10-06 for Richard Johnson and Lamont Kouba Annexation and Zoning
with. a Conditional Use Permit for the property at 835 E. Fairview Avenue, and which are made a
part of the Palmer Conditional Use Permit/Development Agreement, that set of Findings will now
need to be attached to the Development Agreement as Exhibit "B".

Mayor Corrie and Council Members:
One of the conditions for the Bobby's Transmission CUP was that the owners sign and
record a Development Agreement as required by the annexation that occurred several years ago.
The drafting of the Development Agreement was complicated by the fact that a portion of the
arulexed property was sold and already developed as the Ultra Touch Car Wash. One of the
concerns was that Ultra Touch had constructed a parking lot on the north end of the parcel that
will be used for Bobby's Transmission. Ultra Touch needs to have at least eleven parking spaces
on this property in order to comply with the City's parking ordinance. We received some
inforniation that the developer of the Bobby's Transmission site did not want to allow Ultra
Touch to use any of the parking spaces that Ultra Touch built. Since the parking was shown on
the original site plan for Ultra Touch, staff felt that it was appropriate to include in the
Development Agreement a condition regarding the parking. The original Ultra Touch CUP
application was part of a larger parcel, but there was a lot split approved by the Council between
the time of submission of the application and the final approval. That lot split had the effect of
placing the parking lot on the parcel now included in the Bobby's Transmission CUP.
This memo is written in regards to a recent meeting held with the Planning and Zoning
Dept., and the Clerk's office, on the above matter. Pursuant to the requirements of the Findings
of Fact and Conclusions of Law set forth in attached Exhibit B to the Development Agreement,
Owner, Lamont Kouba, and the Developer, Larry and Becky Palmer, would need to provide
eleven (11) parking spaces to the adjoining Ultra Touch Car Wash parcel located immediately
north of the property. The eleven (11) parking spaces would be those spaces immediately
adjacent to the Ultra Touch Car Wash parcel. Additionally, a cross parking, access easement
would be needed to effect the conditions. The agreement would need to be executed and
recorded prior to issuance of any building pernzit for the property. Also, the Planning and
Zoning Department must review and approve the agreement prior to the recording. The
agreement would be reasonable because:
1. The Ultra Touch Conditional Use Perniit was approved after a lot split
was approved.
2. The Ultra Touch Conditional Use Permit Site Plan showed parking on the
parcel that was not sold to Ultra Touch.
3. If the off parcel parking is discontinued, Ultra Touch will then be out of
compliance with Meridian's parking ordinance.
4. Lamont Kouba owned the property on which Ultra Touch applied for their
Conditional Use Permit.
5. Ultra Touch provided and paid for the parking lot.
6. Across-parking access easement, which shall be approved by the Planning
and Zoning Department, shall be provided for the northern eleven (11)
parking spaces.
Staff has identified an alternative to requiring Kouba to provide eleven spaces. The
alternative would be for Ultra Touch to move its detailing area, re-stripe its parking to make for
thirteen spaces, and obtain an agreement to have access to 2 spaces on Kouba's property.
Kouba's buyers, the Palmers, have obtained an agreement from Kouba that Kouba will indemnify
Palmers from any damages or costs associated with the dispute. Kouba maintains that the
agreement to allow Ultra Touch to use the parking was a revocable license agreement. The
problem with that analysis is that Kouba consented to the Ultra Touch site plan which showed
the parking.
The development agreement has been revised to allow either of the two options as a way
of dealing with the parking issue.
If you should receive any calls on this matter, you will be aware of the issues and may
then proceed to address the situation accordingly.

Facts and Findings:
835 Fairview Avenue
Car wash w/ fuel facilities
A. The Ada County Highway District (ACRD) staff has received the above referenced application
requesting conditional use approval to construct a 6,400-square foot car wash facility. The
3.98-acre site is located on the south side of Fairview Avenue approximately 1/2 mile east of
Locust Grove Road. This development is estimated to generate 900 total additional vehicle
trips per day based on the Institute of Transportation Engineers Trip Generation manual.
B. The applicant is proposing to access Fairview Avenue via an easement located adjacent to the
east property line. There are no new driveways (other than the easement) proposed on
Fairview Avenue and no others will be approved with this application. However, the
applicant should be required to pave the easement 24 to 30-feet wide with 15-foot radii
pavement tapers abutting Fairview Avenue and paved south of the right-of--way of Fairview
Avenue a minimum of 30-feet.
C. This application addresses the northern portion of the site only. When the District receives a
development proposal for the southern portion of the site, the District will review the site for
compliance of all applicable District policy, at that time.
D. The application and site plan stamped as received by the City of Meridian and submitted to the
District on April 18, 1997, have been reviewed by the ACHD Development Services staff and
conforms to applicable District standards/policy, or can be made to conform with the
change(s) to the plan described in the requirements stated below.
This is a staff level approval and will not be heard by ACHD's Commission unless the site
plan is changed in such a manner as to not conform with District standards/policy or an appeal
of the Development Services staff decision is submitted as described within the Standard
Requirements outlined below.

the District Commission at an evening meeting within 20 calender days of the District's receipt
of the appeal letter. The appellant will be notified of the date and time of the Commission
meeting.
2. After ACRD Commission action, any request for reconsideration of the Commission's action
shall be made in writing to the Development Services Supervisor within two days of the action
and shall include a minimum fee of $110.00. The request for reconsideration shall specifically
id nti each retirement to be reconsidered and include written documentation of data that
was not available to the Commission at the time of it's original decision. The request for
reconsideration will be heard by the District Commission at the next regular meeting of the
Commission. If the Commission agrees to reconsider the action, the applicant will be notified
of the date and time of the Commission meeting at which the reconsideration will be heard.
Payment of applicable road impact fees are required prior to building construction in
accordance with Ordinance #188, also known as Ada County Highway District Road Impact
Fee Ordinance.
4. All design and construction shall be in accordance with the Ada County Highway District
Policy Manual, ISPWC Standards and approved supplements, Construction Services
procedures and all applicable ACHD Ordinances unless specifically waived herein.
The applicant shall submit revised plans for staff approval, prior to issuance of building permit
(or other required permits), which incorporates any required design changes.
6. Construction, use and property development shall be in conformance with all applicable
requirements of the Ada County Highway District prior to District approval for occupancy.
7. Any change by the applicant in the planned use of the property which is the subject of this
application, shall require the applicant to comply with all rules, regulations, ordinances, plans,
or other regulatory and legal restrictions in force at the time the applicant or its successors in
interest advises the Highway District of its intent to change the planned use of the subject
property unless awaiver/variance of said requirements or other legal relief is granted pursuant
to the law in effect at the time the change in use is sought.
No change in the terms and conditions of this approval shall be valid unless they are in writing
and signed by the applicant or the applicant's authorized representative and an authorized
representative of the Ada County Highway District. The burden shall be upon the applicant to
obtain written confirmation of any change from the Ada County Highway District.

Dear Commissioners:
The Nampa & Meridian Irrigation District's Five Mile Drain courses through the southwest
corner of the project. Tlae right-of-way of the Five Mile Drain is 100 feet; SO feet from the
center each way. See Idaho Code 42-1208--RIGHTS-OF-WAY NOT SUBJECT TO ADVERSE
POSSESSION. The developer must contact John P. Anderson or Bill Henson at either 466-0663
or 345-2431 for approval before any encroachment or change of right-of-way occurs.
The Nampa & Meridian Irrigation District requires a Land Use Change/Site Development
application be filed for review prior to final platting. All laterals and waste ways must be
protected. All municipal surface drainage must be retained on site. If any surface drainage
leaves the site, the Nampa & Meridian Irrigation District must review drainage plans. Contact
Donna Moore at 343-1884 or 466-7861 for further information.
The developer must comply with Idaho Code 31-3805. It is recommended that irrigation water
be made available to all developments within the Nampa & Meridian Irrigation District.

For your information, this issue was discussed back in March of 1998. At that time it was noted that the
hydrant should be moved Unfortunately, both Ada County and the City of Meridian did not think it
would be necessary. So, in order to fulfill your current request, this letter is to confirm the fire hydrant
will be relocated by July 16,1998. Pursuant to your request the following information is provided:
• Cost of relocation is not to exceed $2,750.00

MCU-15-97 835 Fairview Avenue Car wash w/ fuel facilities
Facts and Findings:
A. The Ada County Highway District (ACRD) staff has received the above referenced application
requesting conditional use approval to construct a 6,400-square foot car wash facility. The
3.98-acre site is located on the south side of Fairview .Avenue approximately 1/2 mile east of
Locust Grove Road. This development is estimated o generate 900 total additional vehicle
trips per day based on the Institute of Transporkation Engineers Trip Generation manual.
B. The applicant is proposing to access Fairview Avenue via an easement located adjacent to the
east property line. There are no new driveways (other than the common easement) proposed
on Fairview Avenue and no others shall be .approved .with this application. However, the
applicant should be required to pave the easement 24 to 30-feet wide with 15-foot radii
pavement taper abutting Fairview Avenue, and paved south of the right-of--way of Fairview
Avenue a minimum of 30-feet.
C. This application addresses the northern portion of the site only. When the District receives a
development proposal for the southern portion of the site, the District will review the site for
compliance of all applicable District policy, at that time.
D. The application and site plan stamped as received by the City of Meridian and submitted to the
District on April 18, 1997, have been reviewed by the ACHD Development Services staff and
conforms to applicable District standards/policy, or can be made to conform with the
change(s) to the plan described in the requirements stated below.
This is a -staff level approval and will not be heard by ACHD's Commission unless the site
plan is changed in such a manner as to not conform with District standards/policy or an appeal
of the Development Services staff decision is submitted as described within the Standard
Requirements outlined below.

the District Commission at an evening meeting within 20 calender days of the District's receipt
of the appeal letter. The appellant will be notified of the date and time of the Commission
meeting.
2. After ACHD Commission action, any request for reconsideration of the Commission's action
shall be made in writing to the Development Services Supervisor within two days of the action
and shall include a minimum fee of $110.00. The reauect for reconsideration shall specifically
identifyeach requirement to be reconsidered and include written documentation of data that
~=gas not available to the Commission at the time of it's original decision. The request for
reconsideration will be heard by the District Commission at the next regular meeting of the
Commission. If the Commission agrees to reconsider the action, the applicant will be notified
of the date and time of the Commission meeting at which the reconsideration will be heard.
3. Payment of applicable road impact fees are required prior to building construction in
accordance with Ordinance #188, also known as Ada County Highway District Road Impact
Fee Ordinance.
4. All design and construction shall be in accordance with the Ada County Highway District
Policy Manual, ISPWC Standards and approved supplements, Construction Services
procedures and all applicable ACRD Ordinances unless pecifically waived herein.

5. The applicant shall submit revised plans for staff approval, prior to issuance of building permit
(or other required permits), which incorporates any required design changes.
6. Construction, use and property development shall be in conformance with all applicable
requirements of the Ada County Highway District prior to District approval for occupancy.
7. Any change by the applicant in :the: planned use of the property which is the subject of this
application, shall require the applicantta comply with all rules, regulations, ordinances, plans,
or other regulatory and legal restrictions in:force at the time the applicant or its successors in
interest advises the Highway District of its' intent to change the planned use of the subject
property unless awaiver/variance of said requirements or other legal relief is granted pursuant
to the law in effect at the time the change in use is sought.
8. No change in the terms and;conditions of this approval shall be valid unless they are in writing
and signed by the applicant or the applicant's authorized representative and an authorized
representative of the Ada County Highway District. The burden shall be upon the applicant to
obtain-.written confirmation of any change from the Ada County Highway District.
