In order that the Final Plat may be considered by the District for acceptance, the Developer shall cause the following applicable standard conditions to be satisfied prior to District certification and endorsement: Drainage plans shall be submitted and subject to review and approval by the District. 2. If public street improvements are required: Prior to any construction within the existing or proposed public right-of-way, the following shall be submitted and subject to review and approval by the District. a. Three complete sets of detailed street construction drawings prepared by an Idaho registered professional Engineer. b. Execute and Inspection Agreement between the Developer and the District together with initial payment deposit for inspection and/or testing services. c. Complete all street improvements to the satisfaction of the District, or execute a Surety Agreement between the Developer and the District to guarantee the completion of the construction of all required street improvements. 3. Furnish a copy of the Final Plat showing street names as approved by the Local Government Agency having such authority together with the payment of fee charged for the manufacturing and installation of all street signs. • 2 4. If Public Right-of-Way Trust Fund deposit is required, make the deposit to the District in the form of cash or cashier's check for the amount specified by the District. 5. Furnish easements, agreements and all other datum or documents as required by the District. 6. Furnish Final Plat drawings together with the plat and plan review fees for District acceptance and endorsement. The final plat must contain the signed endorsement of the Owner and the Land Surveyor's certification. 7. All of the material must be submitted to District staff two-weeks prior to Commission review of the final plat. 8. Approval of the plat is valid for one year. On May 10, 2000, the ACRD Commission reviewed and approved Autumn Faire, a 263-lot residential subdivision on 78.4-acres. That site is estimated to generate 2,630 additional vehicle trips per day. C. Utility street cuts in pavement less than five years old are not allowed unless approved in writing by the District. Contact Construction Services at 387-6280 (with file numbers) for details. D. The applicant should be required to construct all public roads within the subdivision as 36-foot street sections with curb, gutter, and 5-foot wide concrete sidewalks within 50-feet of right-of- way. E. The applicant currently has access to one existing street, O'Conner Avenue, at the south property line. The applicant also has access to a stub street in the Autumn Faire Subdivision, but that subdivision has not yet been constructed. F. The applicant is proposing to extend O'Conner Avenue into the site at the south property line between Lot 20, Block 15 and Lot 1, Block 17 from the Turnberry Crossing Subdivision. The applicant should remove the fence that was constructed across the right-of--way of O'Conner Avenue as a part of the Turnberry Crossing Subdivision. Staff supports this extension. G. The applicant is proposing to extend Dayside Avenue into the site at the north property line between Lot 11, Block 15 and Lot 27, Block 14 from the Autumn Faire Subdivision. Staff supports this extension. H. The applicant is proposing to stub Morningside Way to the west property line at Lot 11, Block 17. Staff supports the location of the stub street. District policy requires a paved temporary turnaround for a stub street with greater than 150-feet of frontage, or frontage on two lots. The proposed stub street requires a turnaround. The applicant should provide a paved temporary turnaround at the west end of the stub with a temporary easement provided to the District. The applicant should be required to install a sign at the terminus of the roadway stating that, "THIS ROAD WILL BE EXTENDED IN THE FUTURE". Coordinate the sign plan for the stub street, and the design of the turnaround with District staff. Any proposed landscape islands/medians within the public right-of--way dedicated by this plat should be owned and maintained by a homeowners association. Notes of this should be required on the final plat. All turnarounds should be constructed to provide a minimum turning radius of 45-feet. K. Lot 27, Block 14 is proposed to be a 7-acre neighborhood park. Lot 28, Block 14 will be platted as single family residential in a future phase of Autumn Faire. L. This involves both the extension of the utility sewer and water and potential ground water issues involved in providing service for the 35Q+ dwelling units. This proposed development is inconsistent with existing land use in this area south of Victory. Road... There are no developments. of this scale south of Victory in this area and Victory is a good "Stop Line". As a property owner and tax payer, I am concerned that this development will cause an increase in property values and an increase in taxes. This will create undue hardship on existing property owners. This is not a desired development.. We realize the Commission has other items to discuss, therefore we offer the following responses to some of your comments. The item numbers correspond to your staff report dated October 16, 2001. 1. We will calculate the net density and present it at the hearing. 2. Said street names will be added and presented at the City Council meeting. 3. See attached letter from NMII). The annexation agreement required a total of 30' to be provided to the Ciry along the Sky Pilot Drain. 20' will be provided in Autumn Faire and 10' will be provided in Autumn Faire Crossing. The 10' common strip is shown, but not dimensioned. An encroachment agreement will be obtained from NMID at final plat stages. Please note, NMID requires final plat and plans with the agreement, therefore, it cannot be provided prior to the Council hearing the preliminary plat. Currently, we aze working on an agreement for Autumn Faire 2 and NMYD requested a half encroachment of 30', centered on the drain. 4. See attached letter from NMID, As with item 3, please realize we cannot provide an encroachment agreement until the final plat stage. 5, We agree with the removal of the questionable stub street. We added the stub based upon our interpretation of the maximum block length allowed by the City. If our interpretation were incorrect, we would gladly remove the stub street. 6. Said plan will be provided at the final plat stages. The plan will meet the current landscape ordinance. For comparison, a similar common/drainage lot was designed for Autumn Faire No. 1. The plans indicate that all storm water run-off from Phase II will return to Phase I. Providing that Phase I drainage system has not been altered, this will be acceptable to the District. The pressure urban irrigation system for Phase II will connect directly into Phase I and this is also acceptable. However, the District will not accept dead-end lines, all lines must be looped. During the review we discovered two lines that are dead-end lines, both lie within Block 9, Lots 1 and 9. These need to be re-drawn and show as looped lines. If we failed to miss one please correct this also and send us plans indicating the change. The Nampa & Meridian Irrigation District does have a contract for operation and maintenance for Autumn Faire Subdivision No.l. The District will require another contract to take care of Phase II. Phase I has successfully passed the pressure test and we will need to do the same inspection and approval process for Phase II. We also need to see plans for the proposed pump with pump curves. Please send us this information as soon as it is available. The last issue I would like to address is the District's Sky Pilot Drain. The easement of the Sky Pilot Drain in 100 feet, 50 feet from the center each way. The only thing that indicates anything regarding this drain is located in the southwest corner of this phase. Your plans appears to follow a north south direction running left to right and it changes from the previous pages. This makes it very difficult to follow the plans. We realize the Commission has other items to discuss, therefore we offer the following responses to some of your comments. The item numbers correspond to your star`F report dated October 16, 2001. 1. We will calculate the net density and present it at the hearing. 2. Said street names will be added and presented at the City Council meeting. 3. See attached letter from NMID. The annexation agreement required a total of 30' to be provided to the City along the Sky Pilot Drain. 20' will be provided in Autumn Faire and 10' will be provided in Autumn Faire Crossing. The 10' common strip is shown, but not dimensioned. An encroachment agreement will be obtained from NMIb at final plat stages. Please note, NMID requires final plat and plans with the agreement, therefore, it cannot be provided prior to the Council hearing the preliminary plat. Currently, we are working on an agreement for Autumn Faire 2 and N1vIID requested a half encroachment of 30', centered on the drain. 4. See attached letter from NMID. As with item 3, please realize we cannot provide an encroachment agreement until the final plat stage. 5. We agree with the removal of the questionable stub street, We added the stub based upon our interpretation of the maximum block length allowed by the City. If our interpretation were incorrect, we would gladly remove the stub street. 6. Said plan will be provided at the final plat stages. The plan will meet the current landscape ordinance. For comparison, a similar common/drainage lot was designed for Autumn Faire No. 1. The landscape plan was approved be the City and we anticipate Autumn Faire Crossing's will be very similar. 7. Said notes will be added to the final plat. If necessary, we can add the notes prior to the Council hearing the preliminary plat. 8. We agree in principle with the recommendation. However, we respectfully request that any conditions related to the lift station and sewer construction be decided by the Engineering Department durin; final design. We agree in advance to any conditions they may impose. 9. We have re-submitted to ACRD, A copy of the revised staff report is attached. 1\To modifications are required. Regarding the Black Cat Tntnk fee, please note that the development agreement prepared after the annexation required the fee to be paid at building permit stage. We anticipate platting that portion of Autumn Faire in approximately- 8 months. 14. Said details will be provided during final design. Please note, the development agreement provides for items responsible by Gemstar. Generally speaking those items include a sewer stub and a domestic water stub. We did agree verbally with the Pazks Department to stub an imgation service to the parcel Said stub will be approximately 4-inches in diameter. The irrigation will he provided via the existing NMID pump station located in Autumn Faire. Autumn >~ afire currently includes aback-up connection to City water. We agree the development should pay for water assessments for the residential units and the common lot. Please note, the park site is not a common lot but will be owned by the. City, therefore Gemstar will not .provide for back-up water assessments for the park site. 15. See item 14 above. 16. No comment. 17. No comment. 18. During the annexation process, we met with P&Z staff and the Parks Department. Staff could not agree ir~temally what type offence was required. A more particular description of the above property is on file in the City Clerk's office at Meridian City Hall, 33 East Idaho Avenue, and is available for inspection during regular business hours, Monday through Friday, from 8:00 a.m. to 5:00 p.m. A copy of the application is available upon request. Any and all interested persons shall be heard at said public hearing, and the public is welcome and invited to submit testimony. Oral testimony may be limited to three (3) minutes per person. Written materials may be submitted seven (7) days prior to the above hearing date so that all interested parties may examine them prior to the hearing. All materials presented at public meetings shall become property of the City of Meridian.
