Our Aspen Hills Apartment community is progressing rapidly. We anticipate the first buildings
being ready to occupy in February or March of 1996. At that time, we obviously will not have all work,
such as landscaping, etc., done in this apartment community. We will however have all life safety issues
such as the fire hydrants, road surface completed such that we can request and hope to receive temporary
certificates of occupancy from the City of Meridian on a building by building basis pending completion of
those items necessary to receive a final certificate of occupancy for the entire project.
I suggest it would be most efficient for all concerned to have a brief meeting at Meridian City Hall
the first two weeks of December 1995 to ensure that we are aware of any issues the City may have
regarding issuing the temporary certificates of occupancy. I will contact the Mayor's office to get available
dates on his schedule the first part of December and coordinate a meeting.

109.3 Certificate Issued. After the building official inspects the buildino, or structure and finds
no violations of the provisions of this code or other laws which are enforced by the code enforce-
ment agencv, the building official shall issue a certificate of occupancy which shall contain the foi-
lowing:
1. The building permit number.
2. The address of the building.
3. The name and address of the owner.
4. A description of that portion of the building for which the certificate is issued.
5. A statement that the described portion of the building has been inspected for compliance with
the requirements of this code for the group and division of occupancy and the use for which the
proposed occupancy is classified,

109.6 Revocation. The building official may, in writing, suspend or revoke a certificate of occu-
pancy issued under the provisions of this code whenever the certificate is issued in error, or on the
basis of incorrect information supplied, or when it is determined that the building or structure or
portion thereof is in violation of any ordinance or regulation or any of the provisions of this code.

DRAWINGS OF RECORD:
Either the Contractor or Developer is responsible to keep a record of changes to the
construction approved drawings. These changes are noted on the plans by the Project
Engineer and 'Record Drawings" are submitted (3 sets) within 30 days after construction
is complete.
Subdivisions will not be accepted as final until "Record Drawings" are submitted to the

2. WATER:

✓2. Finder wire must be installed along the north and east side of all pipe. (See detail
in Standard Drawings) The City is to be notified, prior to the installation of the
road base gravel, that the finder wire is ready for a continuity test.

the meter tile is set, so that its' top elevation fits the back of sidewalk elevation.

samples from the system for bacteriological testing. Disinfection is limited to 5
days maximum, then sampling and testing shall follow immediately. Test results

LAT Service Iine pigtails shall be extended straight out 8 feet with one then curving

In paved areas, blowoffs shall have a maximum of (1) 4" and (1) 2" grade ring.

Following our meeting in your office this morning regarding our request for issuance of the temporary
certificate of occupancy for the apartment building located at 290 East James Court, I have revisited the site with
my on-site Superintendent John Matthews and Chief Operating Officer Wes Bettis. I make the following
personal observations based on that meeting at about 12 o'clock today:
Approximately 10 landscape people were on site busily planting a number of trees and shrubs.
2. An equal number of people were on site for the irrigation company installing mainlines and
placing nozzles on irrigation lines.
3. The fence is 100% complete.
4. Site lighting work is starting today.
5. The irrigation well is complete. I estimate landscaping and irrigation to be approximately
30% complete.
6. The swimming pool is approximately 90% complete.
7. The sub -base for the volleyball court and basketball court are in, and therefore, about 50%
complete.
I asked Mr. Matthews to have any construction debris in the area of the building 290 removed and have
the parking lot swept to remove any nails that you were concerned about.
I have also reviewed my file and provide the following information all of which should be in your file:
1. Copy of the irrevocable standby letter of credit dated April 5, 1996, issued in favor of the City of
Meridian in the amount of One Hundred Thirty Thousand Eight Hundred Eighteen Dollars
($130,818). This amount was agreed to by your office prior to its issuance.

You will note that the letter of credit expires October 5, 1996; therefore, you have a significant
amount of time left to draw on the letter of credit should you need to.
2. Copy of the Ordinance No. 644, rezoning and annexing this property into the City of Meridian.
3. Copy of the Findings and Facts and Conclusions of Law before the Planning and Zoning
Commission regarding this property.
4. Copy of the Pre -Construction Minutes prepared by the City of Meridian for the pre -construction
conference on September 6, 1995.
I have carefully reviewed the Planning and Zoning, City Council, and Pre -Construction Minutes and find
that we have completely complied with all conditions, including the specific comments you made in the pre -
construction conference.
I am asking for a temporary certificate of occupancy of this building; not a final certificate of occupancy.
Section 109.4 of the Uniform Building Code provides the temporary certificates of occupancy can be
issued if the building official deems appropriate. The City of Meridian inspectors for the Fire Department,
Plumbing, Mechanical, Electrical, and Building Department have either signed (and in the case of the Building
Department which signs last) are willing to sign off on this building indicating they perceive no problem with
occupancy.
We are asking for occupancy on the fourth of eight buildings on this project. We have completed over
50% of the work subject to bond and requested no reduction in the bond.
We have a number of people anxious to move into this building; many of whom are employed in the City
of Meridian.
We believe we have complied with all conditions of approval for this annexation, all provisions of the
Uniform Building Code, and other applicable codes, and posted a more than sufficient bond to ensure the
balance of the landscaping amenities will be done which are being diligently pursued as we speak.
Please immediately review this information, contact me with questions you may have, and sign a
temporary occupancy of certification for 290 James Court, Wednesday morning, June 26, 1996.

We have just finished an on site visit at Aspen Hills Apartments. Both our resident managers for Paragon
Commercial Group and our construction superintendent advise us wM have a continuing and repeated problem
with getting the large construction dumpster and the* ee-y$rd resident trash containers dumped. The resident
property manager, Connie Weisberger, advises she has spoken with you directly in this regard.
The residential dumpsters are evidently to be dumped Tuesday and Friday of each week. The Tuesday
dump almost never happens and the Friday dump occurs very late at night.
The large construction dumpster requires repeated telephone calls and approximately one week to get
dumped.
Please advise what we need to do or who we need to contact to make this process smoother. The over-
flowing dumpsters are very 4asightly.

John ,Matthews, my on-site superintendent at Aspen Hills Apartments called this morning (August 6)
indicating you were unwilling to sign the temporary occupancy certification, for Building 278. The reason given
was the painter was reinstalling some of the exterior doors and that the landscaping was not completed at least
two,,thirds of the way aroi;nd the building.
On rune 27, I sent you tate enclosed letter indicating what I thought was the agreement we reached on the
balance of this project. Neither at that time nor anytime subsequent to that were we made aware that you would
no longer sign occupancy certifications without two-thirds of the landscaping completed.
The temporary occupancy certification procedure is exactly the format we have attempted to follow from
the beginning of this job,
You still have a $131,000 letter of credit for all of the landscaping when, in fact, approximately 70% or
800/6 of it has been completed. A temporary fence has been installed around the playgrounld to keep children
from using the playground equipment next to the last building, #282.
The swimming pool has been completely fenced with locking gates.
The irrigation and landscaping contractors are working diligently every day to get the building
landscaping completed. It should be done in 7-10 days.
All other inspections by the City of Meridian have been satisfactorily completed and the inspection cards
signed.

SUBJECT: Aspen Hills Apartment Complex - Thomas Development, Inc.
The main issues that need resolution from a P&Z perspective are:
Tiling of ditch - A small ditch exists along the northerly boundary of this development
that needs to be tiled. The ditch will need to be burned to clean it out each spring, and
a wooden fence will be installed adjacent to the ditch. When this was discussed during
the pre -construction conference, the developer asserted that it did not lie at all within
their property boundary. However, since then the developer has attempted to get the
property owner to the north, Dais Barrett, to accept a quit -claim deed for the property
containing the ditch. 3 r P r '

An equitable solution may be for the Barretts and Thomas Development to share in the
cast of tiling the ditch. However, if the Barretts do not wish to do this at this time,
Thomas Development should tile this ditch in its entirety along their northern
boundary. Another possible solution would be for Thomas Development to provide
pressurized irrigation to the Sciscoes (property owner to the west) and abandon the
ditch (I believe the Sciscoes are the only property receiving water from the ditch), if
this is acceptable to all parties A letter of credit, certified check, or cash needs to be
submitted to the City for 110% of an actual quoted price, or actual construction needs
to take place prior to any Certificate of Occupancy.
2. Fencing - Perimeter fencing along the north, west, and east boundaries needs to be in
place prior to occupancy. I have not been to the site in quite some time and do not
know if any of this has been accomplished. Bonding is not appropriate for this item, as
it provides some buffering and security for adjacent residential properties.
3. Landscaping - Extensive landscaping was promised during the approval process of this
rezone (see Dorado Development file). The Soiscoes were also promised 15-20'+ trees
along the westerly boundary to help screen the back of their property from the 2-1/2
(now 3) storey buildings. The Sciscoes were quite upset when they discovered the
construction was maneuvered to add "berms" up the sides of the building in an attempt
to classify the apartments as less than 3 storeys. Apparently this was done to avoid
having to add a sprinkler system to the buildings. A detailed quote and 110% of the
price is needed rnior to any Certificate of Occup �•
4. Amenities - It was made quite clear during the approval process that all amenities were
to be constructed as part of the fust phase of this project. This included a swimming
pool, clubhouse, tot lot, W. (see file, or have Jim Rabbitt pull pertinent
information/plan). I am not aware of any of this construction being even started. If a
Certificate of Occupancy is granted, 110% of the quoted cost of construction should be
deposited with the City.
Irrigation Ponds and Child Safety - The developer is installing two ponds for the
purpose of providing pressurized irrigation within this development. I am concerned
about the safety of small children in the complex. I am not aware of this being
approved by the City Council (it could have been, but the concept has changed
dramatically since Council approval and I did not have time to thoroughly research
this). Children will gravitate toward these ponds, and we all know it only takes
seconds for a child to get in trouble. I am unaware of any safety provisions being
made.
6. All parking lot improvements would need to be bonded at 110% of construction cost. `
Iow p has problems with therparking and driving lanes o emg compete
prior to occupancy. He is probably justified in requiring the paving to be in place"
prior to occupancy, both from a safety and aesthetic standpoint.
Once occupancy is permitted, enforcement becomes a perpetual problem. It would be nearly
impossible, bonds or no bonds, to evict all the tenants (short of shutting off sewer and water) and make
the developer make the improvements. Cash or a letter of credit should be provided in lieu of bonds.
The items above may warrant that the entire Council approve of any premature occupancy, but I guess
that is up to you.

The above entitled annexation and zoning application having
come on for consideration on April 13, 1993, at the hour of 7:30
o'clock p.m. on said date, at the Meridian City Hall, 33 East
Idaho Street, Meridian, Idaho, and the Planning and Zoning
Commission having heard and taken oral and written testimony and
the Applicant appearing in person and having duly considered the
matter, the Planning and Zoning Commission makes the following:
FINDINGS OF FACT
1. That notice of public hearing on the annexation and
zoning was published for two (2) consecutive weeks prior to the
said public hearing scheduled for April 13., 1993, the first
publication of which was fifteen (15) days prior to said hearing;
that the matter was duly considered at the April 13, 1993,
hearing; that the public was given full opportunity to express
comments and submit evidence; and that copies of all notices were
available to newspaper, radio and television stations;

2. That the property included in the application for
annexation and zoning is described in the application, and by this
reference is incorporated herein; that the property is
approximately 7.40 acres in size; it is located East of North
Meridian Road.
3. That the property is presently zoned by Ada County RT
(Rural Transition); that the Applicant requested that the property
be zoned R-40 Residential with a development density of 25
residential units per acre.
4. The general area surrounding the property is used
agriculturally and residentially.
5. That the property is adjacent and abutting to the
present City limits.
6. The Applicant is not the owner of record of the property
but the owner of record has consented to the annexation and
consented to the Application.
7. That the property included in the annexation and zoning
application is within the Area of Impact of the City of Meridian.
8. That the entire parcel of ground requested to be annexed
is presently included within the Meridian Urban Service Planning
Area as the Urban Service Planning Area is defined in the Meridian
Comprehensive Plan.
9. As found above the Application requested that the parcel
be annexed and zoned R-40 Residential but the Applicant testified
that development would not exceed 25 dwelling units per acre;

10. There was a property owner in the immediate area that
testified on the Application as to, his desire of requiring a
collector street, but he had no objection to the Application.
11. That Larry Sale of the Ada County Highway District
(ACRD) testified stating ACHD was requiring a traffic study and a
collector street and wanted those as requirements of the
annexation.
12. That the property is in the NORTH CURVE Neighborhood as
set forth in Policy Diagram in the Meridian Comprehensive Plan;
that under Housing Development on page 25 and 26 of the
Comprehensive Plan, property inside the Urban Service Planning
Area may be developed at greater densities than one dwelling unit
per acre and it is the policy that a density of greater than 1
dwelling unit per 5 acres may not be exceeded outside of the Urban
Service Planning Area.
13. That in the Rural Area section of the Comprehensive Plan
it does state that land in agricultural activity should so remain
in agricultural activity until it is no longer economical to
exclude orderly growth and development to maintain agricultural
pursuits.
14. That Meridian has, and is, experiencing a population
increase; that there are pressures on land previously used for
agricultural uses to be developed into residential uses.
15. That the property can be physically serviced with City

water and sewer.
16. Ada County Highway District, the Central District. Health
Department, Nampa Meridian Irrigation District, Settlers
Irrigation District, City Engineer, Meridian Police Department,
Meridian School District, and City Fire Department submitted
comments and such are incorporated herein as if set forth in full.
17. That the R-40, Residential District is described in the
Zoning Ordinance, 11-2-408 B. 6 as follows:
(R-40) HIGH DENSITY RESIDENTIAL DISTRICT:
The purpose of the (R-40) District is to
permit the establishment of high density
residential uses at a density not exceeding
forty (40) dwelling units per acre.
Connection to the Municipal Water and Sewer
Systems of the City of Meridian is required.
18. That the City has no zone which allows development at a
density of 25 units per acre; the ordinances of the City also
require that land be zoned upon annexation.
19. That proper notice was given as required by law and all
procedures before the Planning and Zoning Commission were given
and followed.
CONCLUSIONS
1. That all the procedural requirements of the Local
Planning Act and of the Ordinances of the City of Meridian have
been met; including the mailing of notice to owners of property
within 300 feet of the external boundaries of the Applicant's
property.

2. That the City of Meridian has authority to annex land
pursuant to 50-222, Idaho Code, and Section 11-2-417 of the
Revised and Compiled Ordinances of the City of Meridian; that
exercise of the City's annexation authority is a Legislative
function.
3. That the Planning and zoning Commission has judged this
annexation and zoning application under the provisions contained
in Section 50-222, Title 67, Chapter 65, Idaho Code, the Meridian
City Ordinances, the Meridian Comprehensive Plan, as amended, and
the record submitted to it and things of which it can take
judicial notice.
4. That all notice and hearing requirements set forth in
Title 67, Chapter 65, Idaho Code, and the Ordinances of the City
of Meridian have been met.
5. That the Commission may take judicial notice of
government ordinances, and policies, and of actual conditions
existing within the City and State.
6. That the land within the proposed annexation is
contiguous to the present City limits of the City of Meridian, and
the annexation would not be a shoestring annexation.
7. That the annexation application has been initiated by
the Applicant and the annexation is not upon the initiation of the
City of Meridian.
8. That since the annexation and zoning of land is a
legislative function, the City has authority to place conditions
upon the annexation of land.

9. That the development of annexed land must meet and
comply with the Ordinances of the City of Meridian; that the
Applicant shall be required to connect to Meridian water and
sewer; that the property will be subject to Site Planning Review
and the Subdivision and Development Ordinance.
10. That since the Applicant's property is in the NORTH
CURVE NEIGHBORHOOD of the Comprehensive Plan, the annexation would
be in conformance with the Comprehensive Plan and the requested
Zoning would be since the land is within the Urban Service
Planning Area.
11. Therefore, based on the Application, these Findings of
Fact and Conclusions, and the Ordinances of the City of Meridian,
it is ultimately concluded that Applicant's property could be
annexed and zoned, as requested.
12. That the property shall be zoned R-40 but shall be
subject to de -annexation if a density of greater than 25 units per
acre is exceeded; this limitation is a condition of annexation and
development.
13. That all ditches, canals, and waterways shall be tiled
as a condition of annexation and if not so tiled the property
shall be subject to de -annexation.
14. That the requirements of the irrigation districts and
Ada County Highway District shall be met as well the requirements
of the City Engineer.

Freckleton: This is a pre -construction meeting for Aspen Hills Apartments, we are
recording this today just so we can transcribe minutes and get them out to everybody for
better accuracy here of note taking, I'm a lousy note taker. We have the approved
construction plans with the City stamp on it here and ready for distribution. Plans being
used on the job need to have the city stamp on them. That way we can make sure it's a
current set. Did everybody get signed up on the list? We will go through the sewer and
water and get schedules set for that. Then we have some issues we need to talk about
before we proceed with the rest of the schedule. MASCO is currently on site working on
drainage, you figured you would be done with that in the next couple of days.
Smith: It probably should be real close to being done out there today.
Freckleton: When do you plan starting on sewer?
Smith: Possibly tomorrow.
Freckleton: How long do you anticipate that taking?
Smith: Ten days, ten working days.
Munger: So you will have all the storm drain done today?
Smith: As far as the storm beds I think there will still be the outfall pipes to put in.
Freckleton: Okay that takes us out to about the 20th of September for sewer. As usual Bill
when you get materials on site give us a call for a materials inspection. Pre -cast base and
manhole sections are coming from Best Western. Just maintain your trench water if you
have any don't let it down the pipe. Twelve inches of chip bedding over the pipe, four
inches under. You did receive the letter for weekend and holiday work. We don't allow
Fernco or Mission type couplings, any couplings shall be done with the PVC slip
couplings. Maximum invert elevation tolerance is 10 foot. I guess we just do our standard
service markers.
Smith: That is still four foot above?

Freckleton: It is still four foot above ground and painted green with finder wire. Maximum
number of grade rings allowed is 12 inches. As far as your service line depths on your
sewer, the City standard is five feet. In a commercial development, will that work for you
or do you want them shallower?
Munger: I think shallower (inaudible) 4 foot, five feet outside the building. (Inaudible)
Freckleton: We will do our standard pressure test after all utilities are installed prior to
paving. This will be a city owned main lines going through the project. Any sewer pipe
damaged during the installation of power, gas, telephone, etc. we want MASCO to make
repairs on that and not the individual contractors. Typical, after it is paved and you have
made sure its clean, then call for our inspection. Okay, do you plan to start after the 20th
on water?
Smith: I am not sure, we will probably put 2 crews in there and if so we probably start that
water like Monday and do those two live taps probably Tuesday morning of next week.
Hezeltine: So water the 11th through the 15th? (Inaudible) the same time as sewer?
Smith: Yes, that is possible.
Freckleton: Finish up on water about when?
Smith: Probably about the 15th.
Freckleton: I've got water then the 11th to the 15th. Coordinate with water on those live
taps and the same type of deal when the materials are on site give them a call for
materials inspection. Finder wire needs to be installed and a continuity test needs to be
performed on that. Hubble Engineering is going to provide all the staking for curbs etc.
The yoke tolerance to the top of the lid is 18 inches to 21 inches.
Hudson: Bruce these are
1/2" services mostly and those are a 30 inch minimum it is
different on the bigger meter sets.
Smith: That is another question Chip, what do you guys want us to do, bring the 2" pipe
over to 1 1/2" meter set.
Hudson: Bruce and I talked about that earlier and he said it is going to have to be 1 1/2"
pipe going to the 1 1/2" meter after the meter you can go 2" if you want.

blind flange on it. So that is not that big of a deal. Now as far as, well do you have
anything else on Water Chip?
Hudson: There is an irrigation service, I know this has pressurized irrigation, is this going
to be fed off of a well or a ditch system?
Everman: Ditch
Hudson: Okay
Freckleton: There actually shouldn't be any services for irrigation that one should be taken
off the plans.
Munger: The pressure irrigation that you see on the plans is the pump at the bottom of this
amenity. That lifts the water back up to the upper pond so that we always have a stream
in that is the only irrigation we have.
Smith: You are just talking about this is still on here, landscape meter, which is deleted it
is still shown on here.
Hudson: That is going to be deleted then?
Munger: Yes
Freckleton: That is the service that comes in off James Court.
Hudson: Right
Hezeltine: What time frequencies are you looking for the power to come in and water gets
out?
Everman: The 18th
Hezeltine: You are looking at 2 weeks for power probably.
Smith: We will have irrigation to do too prior to power coming in, won't we?

Hezeltine: So you want power in from what dates to what dates?

Freckleton: Let's talk about something else here real quick if we could. On your building
construction, I will probably just turn this over to Daunt Whitman our building official.
Whitman: I am here because Skip Voss our Fire Marshall couldn't be here. There is going
to be some big concern about getting combustible material there without having the
hydrants active and access to the buildings. So you will need to coordinate the timing of
that so that there doesn't become a problem. As far as doing the foundations and such that
we are feeling like it is not as hazardous a time as they start construction with the
combustibles.
Everman: That is understandable and the way I am going to approach that is there is a fire
hydrant right across the road that is within 250 foot of our first buildings plus we can go
ahead and put a pit run road in for a temporary basis which would give us base to drive
on. That should cover us on those three buildings. Then we will just have to work from
there. By the time we get the first building started framing and framed up we will probably
have all the underground and it will continuing on the rest of the road. That is a concern
of ours.
Whitman: You are going to use the roadway for drivers concrete trucks and such so that
fire trucks or other emergency vehicles wouldn't have any problem.
Everman: Absolutely and fire hydrants across the street like I say we are okay for now. I
don't quite now where we will store lumber at I guess we could store it out on the front if
the actual lumber piles are a problem we can work that out with Skip.
Freckleton: I didn't know if that would affect anybody's schedule so we thought we better
bring it up. Power do you want to go in next Don?
Hezeltine: Power usually, the way they have been doing it lately they want to get in before
we do. So you want power from the 18th through the 29th?
Everman: Power going out front or in the back?
Smith: We will be in there probably until the 25th.
Everman: You only have two.power crossings, power is not a concern of yours, you are
behind the building. I am not really concerned when you get in there because you run
most of it across the street, and be ready to move without you even going through the site.

Everman: You are right over here maybe you can run down this planter and come across
the road right in there and cut through there around the back.
Hezeltine: Okay, so gas is running in the middle, I haven't seen any plans. With what 4
or 5 meter manifolds. Have we got a mechanical plan to Lynn Davis so he knows what's
going on?
Everman: Right, who knows what is going on. There are 18 plexes, there are 3, 6, they
are all 6 meter manifolds. There are 2 on the 12 plexes, three on the 18 plexes.
Hezeltine: Okay, and Lynn Davis had the mechanical for our running line.
Everman: I don't know, he has a civil for this
Hezeltine: Okay (inaudible) so gas can get in say a time the 18th through the 29th for the
main. The low end it would probably take us like 4 or 5 days. So the 18th through the
22nd?
Everman: Okay (inaudible)
Munger: Why don't you put them back a week because MASCO still has the interior work
to do at that same time.
Everman: Like one crossing here and one crossing here this will all ready be in.
Hezeltine: Because if the 18th doesn't work out then we can pull back a week. Do you
want to shoot for the 18th?
Everman: Yes, let's shoot for the 18th.
Freckleton: You said 4 or 5 days John?
Hezeltine: Yes, for the inside. If all the buildings are going to be constructed we will have
the main in and the service work at a later date. Get them the main in and whatever
services will be required at the same time.
Everman: I should have foundations at least on six of the eight buildings by then,
hopefully all eight.
Hezeltine: And then Lynn Davis to follow up on the sign ups for the individual.

Freckleton: Okay besides gas from the 18th to the 22nd, what about power
Hezeltine: Power is going to be in front and they are not going to be in the back then we
can go in at the same time.
Freckleton: Okay, Chip, you had something else you wanted to bring up.
Hudson: On these fire hydrants it is been in these plans there is going to be a curb and
gutter there evidently. So we would like the fire hydrant to be 3 to 5 feet from the edge of
the curb there.
Smith: From the back of curb?
Hudson: Yes
Smith: You want them 3 to 5
Hudson: Three to five feet inside the planter.
Freckleton: How wide are those planters? Like that one over there for instance on the east
end off of James Court. The planter doesn't look a whole lot wider (inaudible).
Munger: That is one of our big ones, but this one here that planter is only 6 feet at the
front. This on the very back, middle.
Hudson: So if you centered it about middle.
Munger: (Inaudible) Then you should have roughly 3 feet around.
Everman: Do these valves have to be out in the road for these hydrants?
Freckleton: Yes
Hudson: I don't know who you are going to get to pour your collars around the valves, but
get them to clean the cement off of them when they pour them it makes them a lot easier
to get up.
Freckleton: Where did Shari go? -A.J. did you want to get your 2 cents in?
Carlson: I just wanted to check to see what the plan looks like, mine was like October of

1994. 1 will get you a trench design as soon as I can, has this changed at all?
Freckleton: Possibly, it depends on which set of plans you have.
Carlson: (Inaudible) April of 1994 and then
Freckleton: There was one set of plans that had the building on the outside and the
perimeter road on the inside (inaudible) so things could have changed.
Carlson: (Inaudible)Who wants the design? What will be your first service date?
Everman: I will. Probably the first building is going on line December 1 st.
Carlson: I am sure you have read about us (inaudible).

Freckleton: Is there anything else?
Hudson: Bruce, the specs they have here on the back of the 1 1/2" services have
changed, we don't use that swing joint which I think MASCO is aware of. They used to
have the swing joint with the 900 down and out they will be like the ones you did at the
hospital they are a straight shot. That swing joint is left out now.
Smith: So just do like we did at St. Luke's?
Freckleton: You have a blow off detail shown on these plans.
Munger: I think originally there was.
Freckleton: Alright is that it?
Hudson: I think so.
Freckleton: Shari Stiles, our Planning and Zoning Administrator had some issues that she
wanted to discuss as well.
Stiles: You haven't talked about the ditch at all have you? There is an existing ditch along
the northern boundary in this property. Are there plans on piping of the ditch. Our
ordinance requires that any ditches that are property boundaries or only partially located

on property be tiled. We need to get plans that show the piping of that ditch (inaudible).
Munger: I have one question before you get too far, the ditch that is on our north boundary
is the collection ditch from the north run off has nowhere to go. The only reason that ditch
is there is to collect his field run off.
Stiles: There is irrigation water that runs down there isn't there?
Munger: But when he doesn't take his water right straight to that then it comes back out
here and drains back into the drain further.
Stiles: I think the Scicoes take their water from that ditch.
Munger: They might take water out of it too but they are, they didn't show up as one of the
people on that ditch so I think they just get what he doesn't take. We looked at piping that
at first but it is also his collection ditch. If we pipe it then he has to build another one. At
times it does have live irrigation but the rest of the time when he waters his field it is a
collection ditch.
Stiles: I would like a letter from the ditch rider.
Munger: There is no ditch rider (inaudible).
Stiles: They said (inaudible) there is a ditch rider on that ditch, I don't know if it is the one
clear over on the other side.
Munger. That is a user's lateral that probably has a rider and a users group. This ditch that
is here only feeds these two pieces it is the one that we are moving a diversion structure
for.
Freckleton: How this concern came up wasn't it the Barrett's (inaudible)
Stiles: Apparently (inaudible) right on the edge of that ditch which will (inaudible) as it
should anyway. I understand there is some discussion about moving the ditch or giving
the Barrett's some additional land.
Everman: No the discussion was we were going to fence on this side of the existing ditch
which the ditch that's there on our property as it comes around their shed. If I have to move
it their side of the property we will have to move their shed and cut down a bunch of trees,
move their driveway over. So we just elected to put the fence on this side of the ditch and

Munger: Itis a couple feet their side. The property line is basically where the old barbed
wire fence was which was on the bank of the ditch. It is in there pretty close.
Freckleton: I think the way the ordinance is drafted it speaks to adjacent as well.
Stiles: Adjacent or even partially located on the property. So we need some approval from
Settler's (inaudible) owned and operated by Nampa Meridian Irrigation District. Have they
approved plans for any diversions?
Munger: Settlers from what I understand talking to them they don't have control of this and
(inaudible) from that point on it is a users ditch. We were in contact with the users on the
ditch to get that information.
Stiles: Then we will need their approvals on that for any construction of that.
Everman: We are in the process of getting that.
Stiles: Bruce, maybe we need to actually go out there and look at that ditch.
Freckleton: Well I think we have to work it out with the Barrett's.
Everman: I think it is a real minor problem. It has become a concern of mine because I
want to get this fenced off. I want to get going on it right away, I don't know what to do
over here because I don't know why she thinks if we put a fence on our side of the ditch
if we are screwing her up that way.
Freckleton: I think her concern is that if it is fenced off basically that the problem then
becomes hers and she doesn't want the problem.
Everman: She doesn't want her ditch?
Freckleton: She doesn't want the responsibility of tiling it. If it is your responsibility per our
ordinance (inaudible).
Everman: If she wants the responsibility of moving her shed (inaudible).
Freckleton: These are the things that have to be worked out.
Everman: I think why don't we get together with her and you out there and would that
work.
