Construct 5-foot, wide concrete sidewalk along Fairview Avenue abutting parcel. Coordinate with District staff for sidewalk alignment. 6. Complete construction of the 5-foot wide meandering sidewalk on North Hickory Way abutting parcel. 7. Install a stop sign on every unsignalized approach of a project access to an intersection involving a collector or arterial as the cross-street. The stop sign shall be in- stalled when the project access is first accessible to the motoring public. STANDARD REQUIREMENTS: 1. Street and drainage improvements required in the public right- of-way shall be designed and constructed in conformance with District standards and policies. 2. Submit site drainage plans and calculations for review and appropriate action by ACHD. The proposed drainage system shall conform to the requirements of the City of Meridian and shall retain all storm water on-site. 3. Specifications, land surveys, reports, plats, drawings, plans, design information and calculations presented to ACHD shall be sealed, signed and dated by a Registered Professional Engineer or Professional Land Surveyor, in compliance with Idaho Code, Section 54-1215. 4. Provide design data for proposed access to public streets for review and appropriate action by ACHD. 5. Locate obstructions (utility facilities, irrigation and drain- age appurtenances, etc.) outside of the proposed street im- provements. Authorization for relocations shall be obtained from the appropriate entity. 6. A right-of-way permit must be obtained from ACRD for any street or utility construction within the public right-of-. way. Utility cuts should be combined where practical to limit pavement damage. Any existing irrigation/drainage ditches crossing the property to be included in this project, shall be tiled per City Ordinance 11-9-505.M. Plans will need to be approved by the appropriate irrigation/drainage district, or lateral users association, with written confirmation of said approval submitted to the Public Works Department. 2. Determine the seasonal high groundwater elevation, and profile the subsurface soil conditions. 3. Submit copy of proposed restrictive covenants and/or deed restrictions. 4. Submit a letter from the Ada County Street Name Committee, approving the subdivision name. 5. Assessment fees for sewer and water service will be determined during the building plan review process. e. Acceleration/deceleration lanes shall be constructed, in accordance with ACHD standards, as a part of this project to keep consistent with the constructed improvements on the south side of this intersection. We also feel it is appropriate to request curb and gutter be built along the Fairview Avenue frontage of this project. Crookston: I take all of the evidence that has been presented, all the ordinances, the Comprehensive Plan, which are basically the laws that the City has to follow, I then apply them to the facts that have been submitted. I call individually the Planning and Zoning Commissioners and ask for their input, what they want to see in the findings. And then I prepare written findings of fact and conclusions of law. They are then presented to the Commissioners and they have the right to modify them or change them or make whatever recommendations they want to make. Then they adopt those either as they have been written or as they have changed them. Then they are presented to the City Council and they review those. There will be another public hearing before the City Council, if the City Council, if there is different testimony they think is significant enough to change the findings they will that new findings be prepared. And they the same thing, and I do as I just suggested that the Commission does. ITEM #15: PUBLIC HEARING: REQUEST FOR PRELIMINARY/FINAL PLAT FOR CAPITAL PARK DEVELOPMENT, 2 LOTS BY FRED LOTRIDGE: Johnson: I will now open the public hearing, if the applicant or his representatives here would he please come forward and address the Commission at this time. Jim Merkle, 9550 Bethel Court, Boise, was sworn by the City Attorney. Merkle: Mr. Chairman, members of the Commission I am here on behalf of Fred Lotridge the applicant. Earlier this evening, item #10 was the findings of fact and conclusions with a favorable recommendation onto the City Council for the approval of the Conditional use, this is basically the same project. What I am here for tonight is just the public hearing for the preliminary plat to create 2 lots out of one over the top of that conditional use planned commercial development that you recommended approval on earlier. Capital Christian Center is right here, this is the vacant area right here, single family subdivision up to the west. Tonight's issue is basically the platting of the whole project, it is a 2 lot plat right now. One of the lines will be right in through here so that Mr. Lotridge can start on his portion of the project. This would be the other lot which would be developed in concert with the Capital Christian Center. The issues addressing the comments by the Planning and Zoning Administrator Shari Stiles and the City Engineer Gary Smith, I have prepared a written response and gotten it back to them. Basically they are all the same comments that were addressed. Johnson: We have a copy of that letter. Merkle: With that I would like to answer any questions if you have them. Earlier this evening, item #10 was the findings of fact and conclusions with a favorable recommendation onto the City Council for the approval of the Conditional use, this is basically the same project. What I am here for tonight is just the public hearing for the preliminary plat to create 2 lots out of one over the top of that conditional use planned commercial development that you recommended approval on earlier. This is the piece of Meridian Planning & Zoning Commission February 14, 1995 Page 55 ground on Fairview Avenue and Hickory Way. Capital Christian Center is right here, this is the vacant area right here, single family subdivision up to the west. Tonight's issue is basically the platting of the whole project, it is a 2 lot plat right now. One of the lines will be right in through here so that Mr. Lotridge can start on his portion of the project. This would be the other lot which would be developed in concert with the Capital Christian Center. The issues addressing the comments by the Planning and Zoning Administrator Shari Stiles and the City Engineer Gary Smith, I have prepared a written response and gotten it back to them. Basically they are all the same comments that were addressed. Johnson: We have a copy of that letter. Merkle: With that I would like to answer any questions if you have them. Johnson: Any questions for Mr. Merkle? Apparently none, this is a public hearing, is there anyone from the public that would like to address this issue? We have the same issues with the Highway District on that as we do on the conditional use so they will both be flushed out at the same time. The comments from the City basically are comments related to notes on the final plat and what not. I think they are all acceptable to us, most of them are the same as they were on the conditional use. Kingsford: Any questions of Mr. Merkle on the preliminary/final? Any comments of staff? Morrow: I have a question of Bruce, we are currently struggling with on the comments on the general comments from you guys, is any existing irrigation or drainage ditches crossing the property to be included in this property shall be tiled, so on and so forth. My question is as it relates specifically to this group of property does, we are struggling with the Avest from Locust Grove to Eagle .Road with respect to those water and drainage lines flooding the Bryan property. Does any of the ditches that exist on this property impact those negotiations that are currently going on? Freckleton: Councilman Morrow, the the that fronts this property on Fairview turns north along the Ewing parcel, the water eventually gets into the drain if you remember it is the __ drain that cuts diagonally across the back of the Dove Meadows piece. So yes I think it does need to be looked at just to make sure it is going to fit into the grand scheme of things. Morrow: Okay, and I further want to make the point here if it does fit into the scheme of things based on the things that we are going through with that, that these folks do • Meridian City Council March 21, 1995 Page 46 • participate in the solution of the problem that we are currently researching as they are a contributing factor to that problem. Freckleton: I believe that is appropriate and I think that we should probably invite Mr. Merkle to the meeting of the group. Kingsford: I think Jim you are looking a little dazed here, but that is not unusual, what we have here is a condition that has been worsened going to the west with each parcel been developed that has resulted in the corner of Locust Grove and Mr. Don Bryan's property and having about a foot of water on his orchard and his ,front lawn. We are trying to remedy that of which this parcel may be a factor. Bruce will be calling a meeting in the. next week that would be beneficial for you to be at and work on this solution. Merkle: I have no problem with attending that meeting, I would just like, from what I recall out there, there is one irrigation ditch along Fairview along the front of our property. Any drain that is created by us paving will have to retained on site. And basically we would get our irrigation water for the common areas for the landscape areas out of that ditch and just pipe the ditch through. So, I am kind of hesitant to say we want to hold up our approvals based upon some solution down stream that on the surface may turn out Kingsford: I don't think that this will be a big encumbrance but we would like to have everybody along there so that we remedy it. Morrow: I think the point, Jim, is going to be is that if this is approved it is going to be approved subject to you participating in the solution of the problems that have been created down stream by development of which this is part. And it is not a major issue. Kingsford: Any other questions or comments of the Council? Is there a motion on the preliminary/final? Morrow: Mr. Mayor, I would move that we approve the preliminary~nal plat subject to staff conditions and subject to participation of the owner or his representative in the solution of the irrigation problems for the area. Brewer: In order to expedite I believe you have the comments passed along, the findings of fact from Planning and Zoning. The only thing that is really of any importance to me at this point is that we could maybe get out of doing curb and gutter improvements. We request that because 5 to 6 years down the road we plan on destroying the building that is there and putting something else there and to have to re-do curb cuts and approaches and everything at that time would be a waste for me. We are planning living by all of the other requests that have been made. Kingsford: Any questions of Bill? Morrow: With respect to the curb, as I read through this, the indications were that they, as I interpreted, they were asking to replace all of the curb not just the damaged portion of the curb. Brewer: All the curb and gutter. Morrow: And it is a straight back curb is that correct? And it has no curb cuts other than the one that exists on the southeast corner of the property? Brewer: That is correct. Morrow: And if you re-use this property at some point in time, this is a throw away building at the point of re-usage any new curb would be put in at this point in time would be destroyed with new curb cuts to utilize the property. Brewer: That is right, I don't mind the expense of approximately $2400 for 5 new sidewalks but to have to destroy curb and gutter 5 or 6 years would to me be a total waste. Opposed? MOTION CARRIED: All Yea Smith: Mr. Mayor, could we back up to or could I have you back up to Golfview Estates Non-Development agreement. The developer is in a I guess you could call it a chicken and egg situation. They want. to record the subdivisions both 4 and 5, but they don't want to be required to bond for the improvements that would be required in order to obtain our signature. That is the City Clerk and the City Engineer signatures. Which would allow them to carry the plat onto the County Engineer. So that is the reason they have submitted this non-development agreement and I think that the plat, Shari just informed me that the plat has to be recorded by June 20th because they are I think the 2nd, (inaudible) because it was over, I don't know if you recall but it ran over one year and they came to the Council and got a variance for the two year extension which gave them another year on the final plat approval and required that they record the plat by June 20th of this year. I believe that, I don't know the conditions of that variance I can imagine that it was kind of a drop dead deal, if it is not done by then you start over. I am just theorizing that is what the Council said because it was the second extension. This non-development agreement is basically for the entire subdivision no. 4 and 5. I had forwarded copies of a previous non- development agreement that we had used to the applicant's representative who is sitting here this evening, he is still here. I have not checked this against what I gave him but the language in it should be very similar to what we have used before with the exception of the legal description of this subdivision. Corrie: Gary this says Golfview No. 4 I don't see anything about No. 5 you say this is for both 4 and 5? Smith: There should be two of them, there should be a no. 4 and 5 separate. Corrie: You are right thank you. • Meridian City Council May 7, 1996 Page 92 Smith: The only difference between the two I believe is the description of the property. Since the subdivision is not a plat there are not lots of records so the land is described by meets and bounds. The boundary of the property. I think it is also referred to as lots and blocks in what would be a recorded subdivision. I hope all of that makes some sense and I, there is a degree of urgency because of the length of time that is still going to be required by the developers that the developer is going to have to have to get the County Engineer's signature. I don't know what time period that is now. Shari said today it takes 2 weeks to get the County Engineer's signature. So, I don't know what your desires might be if you want to revisit this. If you want to approve this non-development agreement subject to Wayne looking at it rather than tabling it for two weeks to your next Council meeting, if that is something you want to do or not. But, that would put it at May 21st the meeting it would go to. I guess I defer to the applicant as to whether that is a doable thing from his standpoint to get the plat recorded, if it was all approved at that time. Cowie: Do you have any problem with that, we can always pull-the motion and the second from that tabling and then you can redo the motions. Morrow: So what is the answer, can it be done the 21st or is it better to be done now. (Inaudible) Cowie: Motion was made by I think Mr. Bentley made the motion and Mr. Rountree seconded.
