NOTICE OF HEARING
NOTICE IS HEREBY GIVEN pursuant to the Ordinances of the City of Meridian
and the Laws of the State of Idaho, that the City Council of the City of Meridian will hold
a public hearing at the Meridian City Hall, 33 East Idaho Avenue, Meridian, Idaho, at the
hour of 6:30 p.m. on March 6, 2001, for the purpose of reviewing and considering the
application of B & A Development for a variance to exceed the maximum building height
of 35 feet and reduce the 30-foot setback requirement to 20 feet along the 63 feet of the
one-story section of the building for the proposed Ameritel Inn generally located at
Eagle Road and Interstate 84.
A more particular description of the above property is on file in the City Clerk's
office at Meridian City Hall, 33 East Idaho Avenue, and is available for inspection during
regular business hours, Monday through Friday, from 8:00 a.m. to 5:00 p.m.
A copy of the application is available upon request. Any and all interested
persons shall be heard at said public hearing, and the public is welcome and invited to
submit testimony. Oral testimony may be limited to three (3) minutes per person.
Written materials may be submitted seven (7) days prior to the above hearing date so
that all interested parties may examine them prior to the hearing. All materials
presented at public meetings shall become property of the City of Meridian. Anyone
desiring accommodation for disabilities related to documents and/or hearings, please
contact the City Clerk's Office at 888-4433 at least 72 hours prior to the public meeting.

This letter is in response to your revised report regarding the height, issue for the proposed
Ameritel Inn at Eagle Road and I-84. The issue I wish to address is the azchitectural element at
the center of the building. Ameritel Inn's takes great pride in developing a well designed
building with architectural elements that signifies the quality product they provide to their
customers. Further, it provides us the opportunity for a visual presence without the creation of a
lazge freestanding sign that would be highly visible to neighboring properly owners. We all
know the sensitivity of the large pole signs in this neighborhood. Placing the integrated sign into
the building shields it from the vast majority of the neighborhood yet provides the presence we
need to compete yet done in a pleasant manner. Removal of elements of this nature creates a faz
less attractive building.
We believe this component of the building is permitted under Section 11-9.2-E, Supplemental,
Yazd and Height Regulations.
"E. Exceptions To Height Regulations: The height limitations contained in the
zoning schedule of bulk and coverage controls do not apply to spires, belfries,
cupolas, pole antennas, water tanks, public utility power poles, ventilators,
chimneys or other appurtenances usually required to be placed above the level
and not intended for human occupancy except where height of such structures will
constitute a hazard to the safe landing and take-off of aircraft at an established
airport. (Ord. 430, 4.2-1984) "
The intent behind this section of the code is to permit azchitectural elements on buildings that are
not designed for human occupancy. This is exactly what the center portion of the building is
intended to accomplish. It is analogous to a "spire, belfry, cupolas, or other appurtenances:" It is
an architectural element that is integral to the over all design of the structure.
With this in mind, we would like the City Council to review the interpretation of this section of
the code. If they concur with our position, then a variance for the height is not needed. If they do
not concur then we must weigh the impact of reducing the height of the building and loss of
needed identification. The impact may be fatal to the project.

^ 10. Run-off is not to create a mosquito breeding problem.
^ 11. This Department would recommend deferral until high seasonal ground water can be determined if other

As we discussed earlier on the phone, we were scheduled w be heard by the City Council
on March 6~' for a variance and CUP for the above referenced project. Shelby in your
office called me this morning to inform me that because she was under the impression
that the CUP only required one public heating, the CUP was not noticed. Because the
CUP does require two public hearings, we will not be able to be heazd until the March
20'h meeting. i would request that the public bearing for the setback vaziance be
rescheduled to be heard on the same date as the CUP. If you have any questions, please
feel free to give me a call.

Variance Request Modification
Dear Council Members,
We have reviewed the relevant sections of the Meridian Zoning Ordinance and reviewed them with staff to
ascertain the appropriate defmitions and requirements for building height. The following quote is the
Zoning Ordinance definition of Building Height: "The vertical distance measured from the average
elevation of the proposed finished grade at the front of the building to the highest point of the roof for flat
roofs, to the deck line of mansard roofs, and the top of building walls for gable, hip and gambrel roofs. "
The height of a building does not include parapet walls or forms of architectural treatments. This is further
clarified in Section 11-9.2-E, Supplemental Yard and Height Regulations: "The height limitations
contained in the zoning schedule of bulk coverage controls do not apply to spires, belfries, cupolas,~nole
antennas, water tanks, public utility power poles, ventilators, chimneys or other appurtenances usually
required to be placed above the level and not intended for human occupancy except where height of such
structure will constitute a hazard to the safe landing and take-off of aircraft at an established airport. "The
top of the roof is thirty- three feet with the main parapet extending five feet higher to a height of thirty-
eight feet. Based on the fact that the parapet walls are exempt from the height requirements of the
ordinance, the main structure is below the maximum height requirement and would not require a variance.
As indicated in the application to the City, the main entrance to the building has a spire or beliiy treatment
that rises to a height of forty- seven feet, nine inches to the top of the wall and fifty- seven feet, nine inches
to the top of the gable. This entire area is an architectural treatment and contains no human occupancy. It is
the trademark of the hotel chain and provides the an area for a sign negating the need for a large
freestanding sign. We have discussed these issues with staff and they concur with us that there is no need
for this project as designed to obtain a height variance. We are, therefore modifying our variance
application by withdrawing our request for a height variance.
Because ACHD is classifying South Allen Street as a collector street, we will still need a setback variance
for the sixty- three feet (+/-) the single story pool enclosure extends ten feet into the thirty foot setback for a
collector street.

As we discussed earlier on the phone, we were scheduled to be heazd by the City Council
on March 6`~' for a variance and CUP for the above referenced project. Shelby in your
office called me this morning to inform me that because she was under the impression
that the CUP only requvred one public heazing, the CUP was not noticed. Because the
CUP does require two public hearings, we will ztot be able to be heazd until the March
20~' meeting. I,~would rec~uesl: that the _public hearing for the setback variance be
rescheduled to be heazd on the same date as the CUP. If you have any questions, please
