The 4.26-acre site is located at the southwest corner of Eagle Road and Franklin Road. This development is estimated to generate 900 additional vehicle trips per day based on the Institute of Transportation Engineers Trip Generation Manual. On March 19, 1997, the Commission discussed and directed staff to meet with the applicant to discuss designing their site to accommodate a future urban interchange at the intersection of Franklin Road and Eagle Road (Franklin Road -140-feet of total right-of--way, 70-feet from centerline; Eagle Road - 226- feet of total right-of--way, 113-feet from centerline). The applicant has re-designed their site, using the reduced right-of--way stated in the draft report (108-feet of total right-of--way, 54-feet from centerline on Franklin Road, and no additional on Eagle Road). Staff has determined that impact fees can be used to preserve right-of-way on State roadways. Staff has also talked with Meridian's planning staff and found that they are supportive of preserving the right-of- way for the interchange at this time rather than paying more later, and they would like to be consistent with the urban interchange requirements they have made at other parcels at this corner (MA-2-96 at the northwest comer and Porky Park Subdivision at the northeast comer). Staff recommends that the right- of-way for the interchange be purchased at this time on Franklin Road and Eagle Road, including an agreement with ITD that ACHD will be reimbursed for right-of--way when the interchange is constn:cted. In order to reduce trips to and from this development, it is recommended that the tenants occupying the proposed building(s) be required to participate in any Transportation Management Association (TMA) or Transportation Management Organization (TMO) that is formed with a boundary that includes this site or is adjacent to this development. A Transportation Management Association (TMA) or Transportation Management Organization (TMO) is formed with a coordinator that works as a liaison between businesses and private and public transportation providers to increase the use of alternative transportation and other trip reduction measures (shuttle buses, bus pass programs, vanpools, carpools, bicycle and walking enhancements). An annual survey will be required of the TMA/TMO to monitor participation in alternative transportation programs and forwarded to the ACRD Ridesharing Office. K. As required by District policy, restrictions on the width, number and locations of driveways, may be placed on future development of this parcel. L. The existing transportation system will be adequate to accommodate the additional traffic generated by this proposed development with the requirements outlined within this report. The following requirements are provided as conditions for approval: Special Request of the Applicant: 1. Require the tenants of the proposed building(s) to participate in a Transportation Management Association (TMA) or Transportation Management Organization (TMO). Special Recommendation to ITD and the City of Meridian: 1. Driveways on Eagle Road should be prohibited within 440-feet of Franklin Road. A driveway on Eagle Road located a muumum of 440-feet from Franklin Road may be restricted to right turns in the future if an interchange is constructed at the Franklin/Eagle Road intersection. The applicant only has 400-feet of frontage on Eagle Road. The applicant could be allowed aright-out driveway located at the south property line. The driveway design must include a maximum 16-foot lane width, a minimum 50-foot radius and an appropriate left turn prohibition signing. 2. The applicant should be required to construct a 5-foot wide sidewalk on Eagle Road abutting the parcel (approximately 400-feet) prior to issuance of any required permits or District approval of a final plat, whichever occurs first. Those items shall be rescheduled for discussion with the Commission on the next available meeting agenda. Requests submitted to the District after 9:00 a.m. on the day scheduled for Commission action do not provide sufficient time for District staff to remove the item from the consent agenda and report to the Commission regarding the requested modification, variance or waiver. Those items will be acted on by the Commission unless removed from the agenda by the Commission. 2. After ACHD Commission action, any request for reconsideration of the Commission's action shall be made in writing to the Development Services Supervisor within two days of the action and shall include a minimum fee of $110.00. The request for reconsideration shall rifer y ' •++' each re uirement to be reconsidered and include written documentation ,n`f data that wac not available to the Commission at th_e time of its original decision. The request for reconsideration will be heard by the District Commission at the next regular meeting of the Commission. If the Commission agrees to reconsider the action, the applicant will be notified of the date and time of the Commission meeting at which the reconsideration will be heard. 3. Payment of applicable road impact fees are required prior to building construction in accordance with Ordinance #188, also known as Ada County Highway District Road Impact Fee Ordinance. 4. All design and construction shall be in accordance with the Ada County Highway District Policy Manual, ISPWC Standards and approved supplements, Construction Services procedures and all applicable ACRD Ordinances unless specifically waived herein. 5. The applicant shall submit revised plans for staff approval, prior to issuance of building permit (or other required permits), which incorporates any required design changes. 6. Construction, use and property development shall be in conformance with all applicable requirements of the Ada County Highway District prior to District approval for occupancy. 7. No change in the terms and conditions of this approval shall be valid unless they are in writing and signed by the applicant or the applicant's authorized representative and an authorized representative of the Ada County Highway District. The burden shall be upon the MCU597MA.COM Page 6 applicant to obtain written confirmation of any change from the Ada County Highway District. 8. .Any change by the applicant in the planned use of the property which is the subject of this application, shall require the applicant to comply with all rules, regulations, ordinances, plans, or other regulatory and legal restrictions in force at the time the applicant or its successors in interest advises the Highway District of its intent to change the planned use of the subject property unless awaiver/variance of said requirements or other legal relief is granted pursuant to the law in effect at the time the change in use is sought. Conclusion of Law: 1. ACRD requirements are intended to assure that the proposed use/development will not place an undue burden on the existing vehicular and pedestrian transportation system within the vicinity impacted by the proposed development. Dedicate 70-feet of right-of--way from the centerline of Franklin Road, tapering 370-feet west of the centerline of Eagle Road, abutting the parcel. Coordinate the right-of--way taper with Traffic Services Department. Dedication shall be by means of recordation of a final subdivision plat or execution of a warranty deed, prior to issuance of a building permit (or other required permits), whichever occurs first. The owner will be compensated for this additional right-of--way from available impact fee revenues in this benefit zone. If the owner wishes to be paid for the additional right-of--way, the owner must submit a letter of application to the impact fee administrator prior to breaking ground, in accordance with Section 15 of ACRD Ordinance #188. 2. Dedicate 113-feet of right-of--way from the centerline of State Highway 55 (Eagle Road) abutting the parcel by means of recordation of a final subdivision plat or execution of a warranty deed prior to issuance of a building permit (or other required permits), whichever occurs first. The median shall be constructed a minimum of 4-feet wide to total a 100-square foot area and located outside the right-of--way of Franklin Road. 5. Construct a 5-foot wide concrete sidewalk on Franklin Road abutting the parcel (approximately 550-feet), located one foot within the new right-of--way or construct the sidewalk on-site and grant the District an easement for the sidewalk. Coordinate the location of the sidewalk with District staff. 6. Other than the access point(s) specifically approved with this application, direct lot or parcel access to Franklin Road is prohibited. Driveways on Eagle Road should be prohibited within 440-feet of Franklin Road. The applicant only has 400-feet of frontage on Eagle Road. Current District policy allows aright-out driveway located 220-feet south of Franklin Road. The applicant should be allowed aright-out driveway on Eagle Road, located at the south property line. The driveway design should include a maximum 16-foot lane width, a minimum 50-foot radius and an appropriate left turn prohibition signing. E. The Ada County Highway District (ACHD) and the Idaho Transportation Department (TTD) are working together to plan for the long term needs of the Eagle Road Corridor. The major elements of this long term plan are access control (e.g. limited street or driveway access to Eagle Road) and traffic interchanges at the arterial street intersections. A traffic interchange is anticipated at the Eagle Road/Franklin Road intersection. This plan has not yet been developed but future access controls can be expected to include: • .Prohibition of left-turns on Eagle Road within 1,000-feet of Franklin Road. • Expanding the Eagle Road right-of--way to between 150 and 220-feet. • Prohibition of left-turns on Franklin Road within 700-feet of Eagle Road. This includes the Franklin Road/proposed access driveway intersection for this site. • Expanding the Franklin Road right-of--way to between 96 and _164-feet. F. The applicant is proposing to construct a driveway on Franklin Road- with 15-foot radii pavement tapers, located approximately 440-feet west of the Franklin Road/Eagle Road intersection. This distance is ACHD's current policy for a full access driveway, however in the future a driveway at 440-feet may be restricted to right turns due to the construction of an interchange. The driveway's entrance off Franklin Road should be designed with 20-feet of pavement on either side of a center median. The median should be constructed a minimum of 4-feet wide to total a minimum of 100-square feet area and located outside the right-of- way of Franklin Road. G. RE: SW Comer of Franklin 8t-Eagle Deaz Shari: As we discussed earliex today, A'a LLC requests a variance of the ~30' front setback and the 25' side street setback. We additionally request that the issue of setbacks be addressed and resolved during the May 6th hearing on the subject property. In the Planring and Zoning Commission heazing we noted that the right-of--way issues had not been fully resolved by the Ada County Highway I?istrict. On May 1st we received AC1-ID's final conditions of approval that aze different from any option that was discussed in the several coordination meetings that were held to address this issue. Their final requirements are increasing theright-of--way on Franklin Road from 46 feet to 70 feet and, on Eagle Road, increasir~ from 70 feet to 113 feet. Most previous discussions centered on keeping the Eagle Road boundary at its current 70 feet and increasing Franklin Road to between 54 feet and 100 feet. Because of the increase on the Eagle Road side of the property, we have had to move all buildings to the West. Howr~ver, the "reduced" (relative to the original I00')rigM-of--way requirement allowed moving the project layout to the North. We are requesting relief from the existing setbacks to 20' on the front and street sides. We feel this is a reasonable request for several reasons. First, the "grade-separated" urban interchange will not be considered until the year 2015. Realistically, this means we will be maintaining the ground between our buildings and the existing edge of pavement for at least the next 18 years. On the Franklin Road side this is over 75 feet of landscape and, on Eagle Road, it is over 70 feet. As we desire an attractive appearance to our site, we will maintain an extensive "green space" corridor £or almost a generation that is over double the city's desired 35' width. Secondly, even when the interchange is installed, a 20 feet wide landscape buffer will be present. Additionally, the city staff has addressed this request, with at least tacit approval, in the Memorandum of Maxch 6, 1997. In the 1vlemorandum's "Site Specific Comments" item (6) it states "With the high quality building proposed, the building itself would be an asset that would be better presented without a parking lot in front of it". This same comment is included in the Findings of Fact and Conclusions of Law.
