We have reviewed this submittal and offer the following comments, as conditions of the applicant.
These conditions shall be considered in full, unless expressly modified or deleted by motion of the
Meridian City Council:
APPLICATION SUMMARY A BACKGROUND
The applicant is requesting a Conditional Use permit to add a 15,448 sq. ft. classroom building to an
existing school. The seven existing modular classrooms will be removed from the school site. No
new students or staff will be added to the school.
The Meridian Academy was approved as a Conditional Use in 1992. In 1992, Meridian's City
Council determined that the Meridian Academy met the definition of a private school and was
eligible for a Conditional use permit in the Light Industrial zone. The subject property currently
has an 11,000 sq. ft. multi-purpose building and seven modular classrooms. The subject property
was originally used as a high school and later as an intermediate/middle school.
LOCAnoN A SURROUNDING USES
The subject property is located at 2311 E. Lanark Street E. Carlton, at the north east intersection of
Hickory Way and Lanark Street.
The following uses surround the subject property:
North — The Union Pacific Railroad borders the subject property to the north. Property north of the
railroad is zoned IL.
South — Greenhill Estates Subdivision; zoned RI (Ada County.)
East —Single family residences; zoned Rl and RUT (Ada County.)
West — Locust Grove Industrial park; zoned I -L and C -G.

STANDARDS FOR CONDITIONAL USES
The Commission and Council shall review the particular facts and circumstances of each
proposed conditional use in terms of the following and may approve a conditional use permit
if they shall find evidence presented at the hearing(s) is adequate to establish (11-17-3):
A. That the site is large enough to accommodate the proposed use and all yards, open
spaces, parking, landscaping and other features as may be required by this ordinance;
The submitted site plan does not meet the required parking standards for a high school. 120
parking spaces will be required to bring the school into compliance with the MCC. The
applicant must either submit a revised site plan showing the required 120 parking spaces or
apply for a Variance from the parking standards when the application goes to City Council.
B. That the proposed use and development plan will be harmonious with the Meridian
Comprehensive Plan and in accordance with the requirements of this Ordinance;
The Comprehensive Plan shows the subject property as "Public / Quasi Public". Current
zoning is I -L; private schools require a CUP in I -L zone according to the Zoning Schedule of
Use Control. Staff finds the proposed use and plan to be in Compliance with the Meridian
Zoning Ordinance and the Comprehensive Plan, as long as the conditions of the staff report
are met.
C. That the design, construction, operation, and maintenance will be compatible with
other uses in the general neighborhood and with the existing or intended character of
the general vicinity and that such use will not adversely change the essential character
of the same area;
Staff finds that the proposed development will not adversely change the essential character of
the general vicinity and will be harmonious with the intended character of the same area. The
proposed conditional use is for the replacement of modular classrooms with a permanent
classroom building.
D. That the proposed use, if it complies with all conditions of the approval imposed, will
not adversely affect other property in the vicinity;
The Council and Commission should rely upon public testimony to determine if the
development will adversely affect the other properties in the vicinity.
E. That the proposed use will be served adequately by essential public facilities and
services such as highways, street, police, and fire protection, drainage structures, refuse
disposal, water, sewer or that the person responsible for the establishment of proposed

Staff finds that the proposed development will be adequately served by the essential public
facilities and services listed above.
F. That the proposed use will not create excessive additional requirements at public cost
for public facilities and services and will not be detrimental to the economic welfare of
the community;
Staff finds that the proposed use would not be detrimental to the economic welfare of the
community, nor would it create the need for any new facilities or services to be paid for by the
public.
G. That the proposed use will not involve activities or processes, materials, equipment, and
conditions of operation that will be detrimental to any persons, property, or general
welfare by reason of excessive production of traffic, noise, smoke, fumes, glare or odors;
The proposed use will not increase traffic. No new students or staff will be added to the
Meridian Academy; the new classroom building will replace the existing modular classrooms
on the subject property. Staff does not anticipate that the proposed use will be detrimental to
the general welfare of the community by means of increased traffic, noise, smoke fumes, glare
or odors generated by the use.
H. That the proposed use will have vehicular approaches to the property which shall be so
designed as not to create an interference with traffic on surrounding public streets;
Staff finds that the proposed use will not create significant interference with traffic on the
surrounding public streets. The applicant has not proposed any new curb cuts onto existing
streets.
L That the proposed use will not result in the destruction, loss or damage of a natural,
scenic or historic feature considered to be of major importance.
Staff finds that no natural or scenic feature will be lost, damaged or destroyed by issuance of
this conditional use.
SPECIAL CONSIDERATIONS
The following items are special issues with the project that warrant discussion with the Commission
and/or Council. They are not conditions of approval, unless so moved by the Commission or Council.
1. parking: The applicant has proposed a site plan that provides 112 parking spaces. 120

address issues related to anticipated enrollment and parking needs for staff and students. If
the Commission finds that the proposed parking configuration is acceptable, a Variance
application will have to accompany this CUP application for the hearing with City Council.
Since the Commission does not officially act on Variance requests, the Commission would
recommend approval of the project, conditioned on Council's approval of the Variance
request. If the Commission finds that the proposed parking configuration is not acceptable,
either the site plan will need to be modified, or the project would have to be recommended for
denial. Staff's initial judgment is to recommend approval of a Variance to allow the proposed
parking configuration, but reserves final judgment until after the anticipated parking needs,
based on the school's past experience, are presented.
SITE SPECIFIC REQUIREMENTS
1. Parkins: The proposed use requires 120 parking spaces, but only 120 spaces are provided on
the subject property„ leaving a deficit of 8 parking stalls. Either a Variance application must
be filed with the P&Z Dept. to accompany this application to Council, or the site plan must be
modified to show the required number of parking spaces. Upon satisfactory resolution ofthe
parking demand versus supply issue, staff would support a Variance to the parking
requirements.
2. Landscanine: The east side of the subject property needs to be brought into compliance with
current landscaping standards. Trees should be placed every 35 feet along the western
perimeter ofthe subject property. A 5' landscaped buffer must be maintained on the northem
and southern perimeters of the subject property. No buffer is required along the western edge
of the subject property. These revisions to the landscaping plan must be submitted ten days
before the application goes to City Council.
3. Existing Trees: The existing trees shall be protected during construction as noted on the
proposed plan.
4. Handicap parking: All handicapped spaces must be posted as well as marked.
5. Setbacks: The proposed structure is subject to all required setbacks of the I -L zone. The
submitted site plan appears to meet all of the required setbacks.
6. Water/sewer: This facility is currently served by the City of Meridian's sanitary sewer and
water systems. Existing sanitary sewer and water assessments will be compared with the
anticipated impact, to determine whether additional assessments are warranted.r If additional

permit for tenant improvements.
7. As part of a conditional use permit, the City of Meridian may impose additional
restrictionstconditions.
STANDARD REOUIItEMENTS
1. Existing trees shall be protected and retained in accordance with Meridian City Code 12-13-
13.
2. Off-street parking shall be provided in accordance with the City of Meridian Zoning and
Development Ordinance and/or as detailed in site-specific requirements. All parking and
areas of circulation shall be improved with a hard surface in accordance with Meridian City
Code 11-13-4.1), and shall be installed and striped in accordance with the approved site plan
and Ordinance 11-13-4.F.
3. All construction and site improvements shall conform to the requirements of the Americans
with Disabilities Act.
4. A drainage plan designed by a State of Idaho licensed architect or engineer is required and
shall be submitted to the City Engineer (Ord. 557, 10-1-91) for all off-street parking areas. All
drainage water is to be maintained on-site. Storm water treatment and disposal must be
designed in accordance with Department of Environmental Quality 1997 publication Catalog
of Storm Water Best Management Practices for Idaho Cities and Counties and City of
Meridian standards and policies. Off-site disposal into surface water is prohibited unless the
jurisdiction which has authority over the receiving stream provides written authorization prior
to development plan approval. The applicant is responsible for filing all necessary
applications with the Idaho Department of Water Resources regarding Shallow Injection
Wells.
5. All exterior lighting, whether attached to the building or located within the parking lot, shall
be down -shielded or otherwise altered so that the light does not spill over onto adjacent
properties or right-of-way. All parking lot lighting shall be in accordance with Ordinance I I -
13-4.C.
6. All signage shall be in accordance with the standards set forth in Section 11-14 of the City
Zoning and Development Ordinance or as specifically approved. All signage is subject to
design review and shall require separate permits.
7. Provide five -foot -wide pedestrian walkways in accordance with City Ordinance.
8. Screen trash areas on at least three (3) sides. Coordinate screened trash enclosure locations

approval from their office when applying for a Certificate of Zoning Compliance (CZC).
9. Per Ordinance 11-17-4.B., a conditional use permit, when granted, shall be valid for a
maximum period of eighteen (18) months unless otherwise approved by the City Council.
During this time, the permit holder must acquire building permits and commence the
construction of permanent footings or structures. Time extensions are allowed per the
ordinance.
RECOMMENDATION
Staff recommends approval of the project with the conditions stated in this staff report and upon
satisfactory resolution of the issues mentioned, including parking, signs, gymnasium design, tree
mitigation, trash enclosure, building height, and handicap parking.

The following will be the requirements and/or concerns to provide minimum levels of fire
protection for the proposed project:
1. That a fire -flow consistent with Appendix III -A of the Uniform Fire Code be
provided to service the entire project. Fire hydrants shall be placed an average of
400' apart. 1997 UFC Appendix III -A
2. Operational fire hydrants are required before combustible construction begins.
UFC 901.4.2 & 901.3
3. Acceptance of the water supply for fire protection will be by the Meridian
Water Department.
4. Final approval of the fire hydrant locations shall be by the Meridian Fire Department
submitted thru the Public Works Department.
5. All radii for internal & external roads shall be 28' inside and 48' outside radius.
6. A 20' wide fire lane shall be provided around the proposed School or be provided
with an approved turn -around
7. The proposed project will have an unknown transient population and will have an
unknown impact Meridian Fire Department requests for service. According to a
report completed by Fire & Emergency Services Consulting Group in February of
2000 our requests for service are projected to reach 2800 in the year 2005 and 3800
by the year 2010, this is up from 2069 responses in the year 2000.

The Ada County Highway District (ACHD) staff has received and reviewed the application and site
plan for the item referenced above and is submitting this no review letter in response to the lead
agency's request for comment.
Based on the submitted information, it has been determined that the proposed development will
generate less than 10 additional vehicle trips per day (VTD). ACHD policy states that no site related
improvements will be required for developments generating less than 10 additional VTD. If the site
plan or use changes in such a manner that more than 10 additional vehicle trips per day are
generated, then ACHD will review the site plan and may issue requirements based on the ACHD
Policy Manual.
ACHD is currently in the process of acquiring additional right-of-way for Franklin Road abutting this
site.
ACHD policy requires that before any improvements of any kind are constructed or installed within
the public right-of-way, a permit or license agreement permitting the improvements must be
obtained.
All future design plans and construction shall be in accordance with the Ada County Highway
District Policy Manual, ISPWC Standards and approved supplements, Construction Services
procedures and all applicable ACHD Ordinances unless specifically waived in writing by the District.
Meet District drainage requirements per section 8000 of the ACHD Development Policy Manual.
Contact District staff at 387-6170 for details.
Please contact the office for determination of possible road impact fees, prior to obtaining a building
permit. These fees are collected in accordance with Ordinance #197, the Ada County Highway
District Road Impact Fee Ordinance.

Re: Explanation of Changes to Site and Landscaping plan at the Meridian Academy
Wendy:
Per our conversation regarding the review of the Meridian Classroom Building, there
must he additional parking provided. Briefly, the requirements state that there shall be
(10) parking stalls per classroom as it pertains to this particular use. We have a total of
(11) teaching Classrooms, in both the existing multi -use building and the new classroom
building. This results in (110) required parking stalls.
We have added parking stalls, and reconfigured existing parking stalls to incorporate
compact spaces. We have met the above requirements resulting in (I 11) parking stalls
total.
