Anna, Attached is the letter received yesterday from Matt Schultz requesting a public hearing in this
matter. Will thought it best that an application be filed, and an "MI" file number assigned to better
track this item. We need site plan of some sort to run a property owner list for public hearing
notices..... Do you agree? Will your department be contacting Mr. Schultz and advising him? Please
let me know if I need to do anything other than await an application.
tf I have an application in my office tomorrow , we can notice the matter for August 5th. Next week,
we would have to put it on August 12th. Thank you.

Dear Clerk:
We understand a public hearing will be required to discuss the sewer trunkline alignment
for Tuscany Development. This matter was brought before the council in the Department
Reports section of the July 8'h, 2003 hearing where outside input was not allowed and the
requirement for a public hearing was discussed. While we believe this is an issue that
could be resolved administratively in accordance with the preliminary plat condition for
sewer routing, time is of the essence and we request the next available hearing before the
City Council.

We understand this issue will come before you on July 8, 2003. This letter is to provide
you with our justification for the revision to the Master Plan alignment for the 27" sewer
downstream of our Tuscany Properties. We are currently finishing our improvements to
the Messina Village #1 (52 Lots) and Messina Hills #1 (59 Lots) properties and have
started Tuscany Lakes #1 construction (54 Lots). All of these lots will require
completion of a major 27" sewer trunk and we are prepared to finish this work upon
approval of the revised plans by the City Engineer.
The requested revision is a minor realignment to the overall Master Plan that maintains
the intent to provide major sewer "backbone" infrastructure from the northwest to the
southeast as the City grows to the south. Future developments in the area will connect to
the trunkline accessible in Victory Road and Locust Grove Road with smaller sewer
mains.
Prior to our development, the Victory/Locust Grove intersection was about 4000 feet
from the nearest major sewer. We have constructed the 27" sewer trunk within 1200 feet
of that intersection. From the current terminus, we propose to extend the 27" sewer
across a 33-acre parcel we purchased for possible development and have a pending
application. The alignment was designed that if our development application were
denied, any future development would not be impeded. We have delivered a sewer
easement to the City Engineer for our preferred alignment and wish to commence
construction immediately.
We look forward to seeing you on July 8~' to discuss this matter further if required.

Re: Tuscany Sewer Re-routing (July 8 City Council Meeting, Department Reports)
Tuscany Development, owners of the Tuscany Lakes, Messina Village and Messina Hills
projects, has requested what we believe to be a significant change to the sewer routing,
approved with the preliminary plat) that will serve these subdivisions. This request was
initially made in March this spring. After much internal discussion and analysis, I sent a letter
to Matt Schultz, Dean Briggs and Ben Thomas on April 2, 2003 listing our reasons for not
approving this altemate routing. A copy of that letter is attached.
There appear to be two reasons why the developer wishes to use the altemate sewer route:
Constnaction on the sewer trunk in Victory Road effectively stopped in April. Ada
County Highway District has evidently severely restricted any work in Victory
Road while Overland Road is being reconstructed.
2. We were told in a meeting in March that their altemate sewer route could save
them approximately $70,000 by avoiding two crossings of the Ten Mile Drain.
I have signed the Messina Village Subdivision No. 1 plat (6/13/03) and I presume it is under
review at the Ada County Surveyor. We expect the plat to be recorded by about August 1
after which the Tuscany Development will undoubtedly seek building permits. We would be
very hesitant to issue building permits without an operational sewer available.
Our reasons for not accepting the revised sewer routing have not changed since in my 4/2/03
letter. However, in regard to my Item #3 in that letter, the developer has since that time
submitted a preliminary plat application for the property through which they wish to re-route
the sewer. We do not believe the proposed re-routing is in the best interests of the area.
However, since the developer and we appear to be at an impasse, we are seeking City
Council input.

Additionally, I have received a handful of letters and one petition from surrounding properties
in the Locust GroveNictory Road area voicing their opposition to the proposed sewer re-
routing. Copies of those are attached.
As you know, sewer and water issues are almost always worked out without requiring
Council input. However, since we believe neighboring property owners would have objected
to this proposal had it been presented during the preliminary plat public hearings, we feel City
Council should decide whether or not a new opportunity for public input is appropriate.

Gary Smith, Bruce Freckleton and I reviewed and discussed your March 19, 2003 proposal to
revise the off-site sewer trunk alignment from the previously approved plans. We will not
approve this proposal for the following reasons:
The preliminary plat application was reviewed and approved on the basis of the currently
approved sewer trunk alignment. Staff recalls phone calls and office visits with other
property owners and developers about the sewer alignment in which we indicated it would
be built as you showed in the application. While we do not recall any testimony at the
public hearings regarding sewer alignments, we believe there would have been if you had
proposed this alignment at that time. We know that staff would have argued against this
proposal during the public hearing process if it had been included in the application.
2. The revised alignment is not in accordance with the approved sewer master plan. While
the master plan shows general alignments and minor variations are expected, we feel this
is a significant change in which seven parcels would no longer front this sewer trunk.
Owners and development representatives continue to visit with us about the location and
timing of your project in regard to the water and sewer. Because we have approved
water and sewer plans, we continue to show them where those facilities will lie and they
are likely proceeding with development plans based on those representations. To allow
this change at staff level without opportunity for public comment would surely invite a
firestorm of criticism.
3. The revised alignment is shown traversing through future streets on a parcel of land for
which an application has not been submitted. We are reluctant to approve an off-site
alignment through the "future streets" of a subdivision that has received no staff, other
agency, P & Z Commission, City Council or public input.

You will have the opportunity to request from City Council that a latecomer agreement be
prepared that provides reimbursement to you from those properties along Victory and Locust
Grove Roads.
Concerning changes to our sewer system master plan, we must consider not only the impacts to
the applicant proposing the change but to each and every property in the area. The current
master plan has been available to the public for approximately five years and, just as you rely on
us to not change it to detrimentally impact your projects, other properties also expect us to not
significantly modify it and impact their plans. The sewer alignment internal to the Tuscany Lakes
project is significantly different from the master plan and I spent many hours reviewing and
modeling it to ensure that it not only adequately served your project but did not adversely affect
neighboring parcels.

line approved as part of Tuscany Lakes Subdivision No. 1.
The proposed design was discussed previously when the property located at the
southwest corner of Locust Grove and Victory was under different ownership and the

general area is planned for residential growkh in the adopted
Meridian Comprehensive Plan and also in the adopted Meridian
Sever Facilities Plan.
It has come to our attention that you have received a proposal to
deviate frt+m the adopted Meridian Sewer Facilities Pfan in this area
of the comrnuniiy. Evidently, someone is proposing to alter the
alignment of the Ten Mile trunk by avoiding sewer construction in the
planned ~ctor~ Road and Locust Grove Road alignment. If
approved, this atternalive proposal caould eliminate gravity sewer
se~nrioe to several properties in the area.
The Ciiy of Meridian and JUB Engin®ers have done a good job of
master planning the Ten Mile trunk sewer project to make sure that
properties wkhin il's drainage boundary are served witht gravity
sewers. The City has adopted this sewer plan and properly owners
have made significant community development decisions based on
this adopted sewer` plan. If this plan is going to be altered, then a
series of public hearings should be scheduled to solicit input from
affected properly owners. For good planning and community
development to proceed, the adopted Meridian Sewer Facility Plan

It has been brought to our attention that there has been some changes proposed to the +rpproved
plan for the location of the sewer at Locust Grove Road and Victory.
Your office approved the original plan forthe sewer connection to go through the Intersection at
Victory and Locust Grove Roads. Since the oRginal plan betterserved the communidr of Meridian,
and not just one developer, It seems that that might be the better plan to approve. It sl~~o seems

Maybe we should be Involved In the decision to change the original approved plant
It almost seems that the developer obtained approval from the City of Meridian underfsilse pretense,

Brad,
Per our conversation today it is my understanding that Tuscany Lakes developers have made
arrangememts to run sewer/water lines parallel to Ten Mile Creek. I have concerns about this matter
particuarly with it being so close to the creek and making it unavailable to the neighborhood to hook up
to it at some point and time. I believe that the origional plan was to run these lines east Victory and
south Locust Grove.
I would like to request a public hearing to re-open this case regarding water and sewer lines for Tuscany
Lakes subdivisions.
Please keep me informed regarding this situation.

We are residents of the S. Locust Grove and E. Victory Roads intersection area.
We request that- the sewer and utilities improvements for this area proceed as planned
through the intersection. We understand that the sewer line route is requested to be
changed, without hearing or notice, and might be diverted to go along the ten mile
drain/creek bank. This was NOT discussed publicly earlier and has adverse impacts to
all neighborhood residents and the area.
Tiffany subdivision hearings and plans indicated the sewer would o~ through the
intersection easterlyunder/along E. Victory Rd to the intersection and then southerly
along/under S. Locust Grove Rd to the subdivision.
WE CONTINUE TO SUPPORT THAT APPROVED ROUTE/PLAN. without
amendment, as finalized through public hearing and due processes for the subdivision .
AT THIS TIME WE OPPOSE ANYDEVIATION OR AMENDMENT TO THAT
ORIGINAL SEWER AND INFRASTRUCTURE PLAN.
Any alternative route proposed which delays or replaces the Victory-SLG Roads
Intersection route that was approved, is strongly protested and is vigorously opposed.

Quasar Development LLC, is in the process of purchasing and developing a parcel of
land in the vicinity of Locust Grove Road and Victory Road in Meridian. This general
area is planned for sewer service in the adopted Meridian Sewer Master Plan.
It has come to our attention that you have received a request to deviate from the
adopted Meridian Sewer Master Plan in this area of the community. Evidently, the
developers of Tuscany Subdivision are proposing to change the alignment of the Ten-
Mile Trunk sewerline by avoiding sewer construction in the planned u<ctory Road and
Locust Grove Road alignment. If you approve Tuscany's sewerline change, several
properties in this area will not have sewer service as originally planned and approved by
the City!
We researched the City's adopted Sewer Master Plan before we bought this property.
If you change the sewer plan for this area, our properly and several other properties will
be damaged and suffer an economic loss. We beg you to stay focused on the
approved Meridian Sewer Master Plan and deny the Tuscany sewer change request!
The City of Meridian and your engineers have done a very good job of master planning
the Ten Mile trunk sewer project to make sure that all properties within it's drainage
boundary are served with gravity sewers. The City has .adopted a sewer master plan
and property owners have made significant investment decisions based on this adopted
sewer plan. For good planning and community development to proceed, the adopted
Meridian Sewer Master Plan should not be changed in this area. Thank you for sticking
with the adopted plan and upholding your policies.
