We have received a protest to the bid from Golfs Construction. Their protest Is against the low bidder
Haemker General Contractor because they listed a HvAC contractor, Iselman Plumbing, that is not a
licensed State of Idaho Public Works HVAC contractor. Haemker General Contractor dtd not list the State
of Idaho Public Works Contractor number on any of their subcontractors or themselves. Haemker
General Contractor used the old bid proposal form and did not use the correct bid proposal form that was
issued In addendum #2, whkh included a navised Imitation to Bid requiring that they include the State of
Idaho PubNc Works Contractors License number. Also included In addendum #2 was a revised Bld
Proposal that had an appropriate space for the Idaho Public Works Contractors License Number and the
Idaho Contractors License Number. Haemker General Contractor acknowledged receipt of both
addendum #1 and #2 on the Bid Proposal Form. According to Title 67 Chapter 23 of the Idaho Statutes
by not listing these numbers Haemker General Contractor's bid proposal Is unresponsive and void. Golfs
Construction, being the next lowest bidder would appear to be the contractor awarded the bid, but
according to the same section of the Idaho Statutes that Golfs included as an attachment to their protest,
Titl® 67 Chapter 23, it would require Golfs Construction to include the Idaho Conlractors License Number
for each of his subcontracbrs, which he did not include on his Bid Proposal, mektng his bid unresponsive
and void. The onty contractor to complete his Bid Proposal correctly and inGude all of the required
contractor license numbers was Elsworth Klncald Construction Inc. his Cole ~ Associates
recommendatlon that the contrast be awarded to ElswoRh Kincaid Construction Inc.

Golfs Construction, Inc. would like to pxotest the public bid on the Bear Creek Restroom project
if the apparent low bidder, I-Isemker General Contractor, is selected as the successful bidder.
The reason for Ibis Qratest is I~aemker listed on their bid form I~nselman Plumbing as both their
HVAC and plumbing subcontractor.
Inselman Plumbing is nat currently licensed by the State of Idaho Department of Building Safety
to do ariy type of HVAC work. They are licensed for only plumbing, trenching s-od boner work.
I have enclosed, for your reference, a copy of Idaho Statue 67-2310. 'T'his document discusses
the namiung of subcontractors on bid farms. Please review and discuss this issue with the City of
Meridian. I lank forward to your xesponse.

MISCELLANEOUS PROVISIONS
67-2310. SUBCONTRACTORS TO BE LISTED ON BID OF GENERAI, CONTRACTOR,
Hereafter, befoze the state of Idaho, the separate counties, cities, towns,
villages or school districts with~.n the state of Idaho shall. let eontracts
for the construction, aiteratiort or repair of any and all buildings,
improvements or public works, and such construction, alteration or repair
requires plumbing, heating and air--conditioning work, or electrical work,
the general contractor shall be required to include in his bid the name, or
names and address, or addresses, ox the subcontractors who shall, in the
event the Contractor secures the Contract, subcontract the plumbing,
heating and air-conditioning work, and electrical work under the general
contracts provided, however, that this act shall not apply to the
construction, alteration or zepair of public buildings under the
jurisdiction of the board of regents of the University of Idakso; further
that this act shall have no application to Che pi;eparation and submission
of plans and specifications pursuant to section 50-1.05 {50-316), Idaho
Code. Failure to name subcontractors as required by this section shall
rendex any bid submitted by a general contractor unresponsive and void.
Subcontractors named in accordance with the provis:.ans of this section must
possess an appropriate license or cextificet® of competency issued by the
state of Idaho covering the contractor work classa.fication in which the
subcontractoz' is named.
The Idaho Code is the pmperry of the state of Idaho, and is copyrighted by Idaho law, I.C. g 9-350.
According to Idaho law, arty person who reproduces or distributes the Iduhu Cvde for commercial
purposes in violation of the provisions of this statute shall be deemed to be an infringer of the state of
Idaho's copyright.

Separate sealed Bids for the City of Meridian, Bear Creek Park Restrooms will be received by the City of

read aloud.

detail to secure comparabl® bids. All parts or work not specifically mentioned which are necessary in order
to provide a complete installation shall be included in the bid and shall conform to all Local, State and
