We are in receipt of the Findings of Fact, Conclusions of Law and Decisions & Order with regard to
AZ-07-012. It is our understanding that adoption of these findings by the Meridian City Council will
be on the consent agenda for January 22, 2008.
We would like to have read into the record for this consent a clanfication of one item related to
Development Agreement #3 (DA#3) contained in the findings:
Page 27, second bullet point currently reads: "Right-of-W~ shall be dedicated for the extension of
Records (and E River Valley Street, if CenterCal's ownership expands to the North Parcel of
DA#2) Construction of records Road (and E River Valley Street, if applicable) shall take place with
the initial phase of the project."
Pages 39-40 of the City Council Minutes reflect a more precise understanding of the intention of the
both the City and CenterCal that may more clearly be stated by adding the following statement to the
text noted above:
"CenterCal is not obligated to construct other portions of Records Road and E. River Valley
Street unless CenterCal develops the adiacent property. "
