Watertower, Suite 200 Meridian, ID 83642 DATE: January 16, 2008 RE: Strada 13ellissima Subdivision Mayor & City Council: RECEIVED AN 1 6 2008 City Of 1Vleridian City Clerk Office 1 am respectfully requesting a reconsideration of your decision of December 18, 2007 regarding the request for rezone from L-0 to C-N in case RZ-07-O1 1. At the meeting, some of the homeowners came forward and stated opposition to our rezone based on parking and traffic conditions that were caused by the adjacent church. We have held a meeting with the church and approximately 30 of the neighbors and had a frank and open discussion with both about the situation. The main concern is the amount and speed of the traftic leaving the church. The developer has offered parking in the commercial area of the subdivision for church overtlow parking and the church has made additional parking available on their property. The church has agreed to continue to encourage their parishioners to slow down and use Maestra to Meridian Road as ingress/egress rather than routing through the neighborhood. There were concerns about the "tot lot" expressed and the developer is currently getting bids on a fence to keep children from wandering into the street. It is the developer's position that the traffic situation (that we are making steps towards helping alleviate) is actually not a real factor in the application. It is a result of other issues that are not germane to the zoning of the lots in Strada Commercial. The concept that the existing traffic will be impacted by the rezone is false in that the ingress and egress of the commercial development is straight in and out on Victory and Meridian and the only reason any customers would have to enter the residential subdivision would be if they were residents of the SUbdIVISIOn. At our meeting, there were as many in numbers supporting the rezone as there were that were against it. The problem was that the neighbors that supported it were afraid to come forward because the individuals that were against the rezone were so vocal The only reason given by those that were against the rezone was merely to protest the traftic and would not support it until the developer "fixed the traftic problems". Since the developer did not create the traftic, it seems unreasonable to require the developer to "fix" it and to penalize the developer by withholding approval of his rezone request for his project that has nothing to do with the problem created by the adjacent church. I would like to further explain that the existing zoning of the commercial in Strada Bellissima Commercial Park is L-0 and we arc asking an increase to 12552 W EXECUTIVE DRIVE, SUITE B • BOISE, IDAHO 83713 • (208) 887-7760 • FAX (208) 887-778] a C-N zoning. The only difference would be the allowed use of a Retail Store, which would be a day use only. Further, the traff is enters Strada Commercial from Meridian and Victory and does not ever go through the residential, regardless of the zoning. F. For uses that may fall into more than one category, the director shall determine the most appropriate category based on the more restrictive standards.
