Dear Sonya;
To clarify the issue of the annexation request for Birthstone Creek Subdivision, the existing parcel
containing the single family dwelling that is located on the north side of the property and labeled as
`hot a part" has been included within the annexation and zoning request but is not part of the
preliminary plat. The submitted legal descriptions for the annexation/zoningintlude this parcel, and
subsequently, the legal for the preliminary plat does not. I hope this clears things up. If you would

RE: Birchstoue Creek Subdivision Anneaatioo/Loning and Preliminary Plat - Letter of Intent
Dear Mayor and Council;
As representative for Cemennial Developmern, LLC, please accept this application for Birchstone
Creek Subdivision, located on the northwest comer of Blackcat Road and Ustick Road in Meridian,
Idaho, Section 33, Township 4 North, Range 1 West ofthe Boise-Meridian. Birchstone Creek
Subdivision includes 34.52 acres and has been designed with 981ots (88 residemial, 9 common, 1
school site) and includes a request for annexation with a zoning designation of R-8 (Medium Density
Residential). A density of 2.55 dwelling units per acre is proposed. The current owners of record for
the property are Del Bain and Marcia A Bain. Cernennial Development, LLC has this property under
contract, and the property owner has provided a letter of consent (signed affidavit) regarding the
submittal ofthis application.
This letter is included with the application for the annexation and zoning, and the preliminary plat,
together with filing fees and various exhibits.
The enclosed preliminary plat has been designed, and the applications have been submitted in
accordance with the requirements of the Meridian Zoning Ordinance. The lone exception to this is a
requested variance for the block lengths within the subdivision. The development has also been
designed to be in wmpliance with the imem of the Meridian City Comprehensive Plan.
Specific Comprehensive Plan policies that support the requested zone change include:
• Population Growth Goal 1, Objective A, Action 6 (New residential development with provided
Urban Services);
• Services Goal II, Objective A, Transportation, Action 6 (Street connections between
subdivisions);
• Land Use Goal III, Ensure public services, Objective A, Action 1 (Development projects
planned public services); Goal IV, Objective C, Action 1(compatibility), 3 (usable open space),
5 (sidewalks, curbs, gutters, etc.), Objective D, Transportation Corridors, Action 2 (Restrict
curb cuts/access on collectors); Goal V, Objective C, Quality, Action 1 (Require common
area);

An R 8 zoning designation is being requested with this annexation and the subdivision plat will contain
lots ranging in size from a minimum 6, 500 squaze feet to approximately 13,700 squaze feet. All streets
will be public and will be constructed, along with curb, gutter and sidewalks, to Ada County I3'ighway
District and Meridian City standards. Sewer and water service is readily available and will be provided
by the City of Meridian. Drainage will be handled by surface and subsurface methods and will be
designed to the standards of all appropriate regulatory agenaes. A pressure imgation system will be
provided for all lots within the development. The Meridian Fire Department has been consulted
regarding the layout of the subdivision with any concerns addressed within the design.
A 9.56 acre future school site is located on the western third of the property. The developer has been
working with the administrators of the Meridian School District and their azchitects in the functional
layout of this site. Negotiations are moving forwazd with the developer and the school district on the
timing of the acquisition of the site by the district.
The development has been designed to include landscaping at the entrances to the developmem and
along the interior collector streets, in addition to the boundaries of Blackcat and Ustick Roads. An
open space lot is included at the western end of the residential portion of the development. It is the
intent of the developer to wnstnrct and maintain (through the HOA) this open space azea urtil such a
time as the school site was to develop. At that time, the open space lot will be transfeaed to the school
district and incorporated into the future school design. All rPma;ning common landscape azea lots
would be owned and maintained by the Homeowners Association that will be established for the
subdivision.
In all, Birthstone Creek Subdivision will be a quality and compatible addition to this area of Meridian.
The development is adjacent to existing residential development to the south and southeast, and
provides wnsideration for future development along its remairring boundaries. The requested zoning to
R-8 will benefit the public irnerest by providing desirable housing needs to this area of the City while
allowing for the continued improvement and expansion of city services and an increase in the City's tax
base. This application submittal includes all items listed within the preliminary plat and annexation
checklists. We look forward to working with you and your staff and request approval of this project.
