NOTICE OF HEARING
NOTICE IS HEREBY GIVEN pursuant to the Ordinances of the City of Meridian and
the Laws of the State of Idaho, that the Planning and Zoning Commission of the City of
Meridian will hold a public hearing at the Meridian City Hall, 33 East Idaho Street,
Meridian, Idaho, at the hour of 7:30 p.m., on .September 10, 1996, for the purpose of
reviewing and considering the Application of Consolidated Equipment Supply Co., for a
Conditional Use Permit for land located in Lot 1, Block 1 of The Playground Subdivision,
Boise Meridian, Ada County, Idaho, and which property is generally located East of Locust
Grove on Overland Road, where driving range is currently located. The application
requests a conditional use permit for a John Deere Dealership.
Amore particular legal description of the above property is on file in the City Clerk's
office at Meridian City Hall, 33 East Idaho Street, and is available for inspection during
regular business hours.
A copy of the Application is available upon request. Any and all interested persons
shall be heard at said public hearing and the public is welcome and invited to submit
testimony.

I have reviewed our sewer design, which was approved
by the City of Meridian for the Piaygrvund.
Presently, a 4" service runs from the ball shack to
a manhole near the east end of the driving range.
From there, a 6" main flows west for 40o feet to
another manhole, and from there an B" main intercepts
the public syatea~ boated iq Locust Grove. The maims
and two manhole® located on th® playgound sgt8 izots
1-3 of the Playgrounr3 Subdivision) are on private
ground and not considered a part of the City of
Meridian's public sewer system.
The aias of the existing mains ie entirely adequate
in capacity to serve the Cesco 4evclopment, which
will be located on said Lot 1.

Dear Mayor Corrie and Members of the Meridian City Council:
I am writing on behalf of contractors Equipment Supply
Company, Inc. ("CESCO") regarding their conditional use permit
application for a John Deere Dealership. The Meridian Planning &
Zcniny Con-~nissiun has recum~iended that the conditional use permit
be approved subject to certain draft Findings of Fact and
Conclusions of Law. The Commission has also recommended that the
issue of sewer service to the propecLy be resulvea. CESCO has
two concerns with the proposed Findings of Fact and Conclusions
of Law.
Sewer service
At page 4, paragraph 7.0, the craft r'indings of r'act and
Conclusions of Law indicate that sanitary sewer service for this
project doesn't exist and that sewer service must be directed to
the future Five Mile Creek sewer trunk line extension. CESCU
respectfully disagrees with. the conclusion that sewer service is
not available to the property. CESCO retained J. J. Howard
Consulting Engineer to examine this issue. Mr. Howard has
concluded that the size and capacity of the existing sewer
service to Lot 1 of the Playground Subdivision is adequate to
serve the CESCO development. A copy of Mr. Howard's analysis is
attached.

CESCO understands that the principal objection to allowing
CESCO to connect tv the existitty ~CWez' service is tllaL the City
plans to extend sewer service to the property as part of the Five
Mile Trunk Extension. CESCO has consistently indicated that it
wants to address this concern and is willing to assist with the
Five Mile Trunk Extension and to outline the details of that
arrangement in an Amended Development Agreement. CESCO requests,
ti~wever, that paragraph 5.e. on page 14 of the draft Findings and
Conclusions be modified as follows:

Amended pe~elopment Agreement
CESCO has been informed by the Planning & Zoning
Administrator and City Attorney that an Amended Development
Agreement will be required for the property. The draft Findings
of Facts and ;Conclusions of Law do not appear to require CESCO to
enter into ajn Amended Development Agreement. Paragraph 7.b. on
page 15 of the draft Findings and Conclusions requires CESCO to
comply with] the Development Agreement executed by the
Playground, Iinc. That Development Agreement requires development
of a drivinq~range and conta?ns other language that is no longer
applicable.
CESCO his submitted a draft Amended Development Agreement tai
the MPric~ia» city Attorney. Thy? Amended Development Agreement
contains a proposal for resolving the sewer issue regarding the
property'.

CESCO has had an opportunity to review the Memorandum dated
September 12, 1996, from Mr, Freckleton and Ms. Stiles to the
Planning & Zoning Commission, Mayor and City Council. CESCO's
response to the items listed in the Memorandum is as follows:
GENERAL COMMENTS
CESCO has no problem with Items ? , 4 , 5 , 6 , 7 , 8 , and 9 of
the general comments and will comply with those conditions as
stated.
Item 1: CESCO requests that Item 1 be deleted as a
condition of approval. CESCC has been inforired by AChD that
Overland Road will be widened within the next two to three years.
The widening of Overland RoaC Twill require reconstruction of the
Nampa & Meridian Irrigation District's Cook Lateral a-long the
southern boundary of the CESCO property. Tiling the lateral at
this time will be a substantial waste of time and ruoney because
the tiling will simply have to be removed in the near future in
order to accommodate the widening of overland Road.
Item 3: CESCO requests that Item 3 be deleted as a
condition of approval. Determining the seasonal high groundwater

elevation and profiling the subsurface soil conditions i.s an
expensive, time-consuming endeavor. CESCO was unaware of this
proposed requirement until yesterday. It is not clear why the
information is needed, or how it relates to any condition of
approval for the use proposed by CESCO.
SITE SPECIFIC COMMENTS
CESCO has no problems with-Items 1, 3, 4, 6, 7, 8, 9, and 10
of the site specific comments and will comply with those
conditions as stated.
Item 2: CESCO disagrees that sanitary Sewer sarcTi.ce for.

property, and to connect to the City of Meridian sewer service.
The prior owr~e-rs complied with these requirements and sewer
service has been provided to what is now Lots 1, 2 and 3 of the
Playground Subdivision. The existing sewer service is not
temporary. On August 12, 1995, representatives of CESCO discussed
connecting to the existing sewer service with the City of
Meridian.
When CESCO purchased the property from the P1ayc~round, Inc.,
it was granted a permanent sewer easement over Lats 2 ar~d 3 of
the Playground Subdivision. A copy o~ that easement agreement is
attached to this letter. Sewer servicA fer Lot 3_ does er_isL, and
CESCO has legal access to that sewer service.
CESCO is, ho~~ever, w.illi.ng tc~ connect. to the future I'ive-

Item 5: CESCO is willing to amend the existing Development
Agreement consistent with CESCO's proposed use if tree City
determines such an amendment is necessary. CESCO suggests that
the Development Agreement for the property is eutdatsd and not
applicable in many respects, and it would be easier to simply
terminate than Development Agreement once a valid conditional use
permit is issued. That is CESCO's preference.
Item 1Z: CESCO's normal hours of apera.tion wi].]_ be from
8:00 a.m. to 5:,00 p.m. However, there are occasions where CESCO

will need to operate the facility beginning at 6:00 a.m. and
extending until 7:30 p.m. CESCO requests that this condition be
modified as follows:
The hours of operation shall normally be from 8:00 a.m.
to 5:00 p.m. However, the applicant shall have the
right to operate the facility from 6:00 a.m. to 7:30
p.m., as needed.
Item 12: CESCO does not agree that a minor change in
ownership or operation should. be subject to City Council review.
CESCO suggests the following language be substituted for Item 12:
Any modification or amendment of the approved use must
be preces.sed in accordan~_e ;with Section 2-~0~ of the
Meridian Zoning & Development Ordinance.
CESCO appreciates your consideration of these comments and
looks forward to discussing the application with the City on
Monday, September 16, 1996.

STORMWATER MANAGEMENT RECOMMENDATIONS
We recommend that the first one half inch of stormwater be pretreated through a
grassy swale prior to discharge to the subsurface to prevent impact to groundwater
and surface water quality. The engineers and architects involved with the design
of this project should obtain current best management practices for stormwater
disposal and design a stormwater management system oaulds be used fog
groundwater and surface water degradation. Manuals that

RE: Summary of access to Overland Road east of Locust Grove Road
September 9, 1996
On September 6, 1996, representatives of John Deere/MCU-24-96, Bill Howell/MCU-19-95, and the parcel
previously processed as Sundance Subdivision discussed a joint solution to multiple driveways on Overland
Road maintaining the District's required 230-foot separation between driveways based on a 45 mph speed
limit. Bill Howell/MCU-19-95 was the only participant with approved driveways. Sundance Subdivision is
no longer proceeding and the deadline for final plat submittal is within the next month or two. John
Deere/MCU-24-96 was in the process of review and was proposing a driveway that did not have adequate
separation from a driveway approved in MCU-19-95.
Mr. Howell is in the process of modifying his site plan to develop the east side of his site first. The District
is appreciative of Mr. Howell's cooperation and flexibility, without which a 3-party solution may not have
been possible. Mr. Howell agreed to relinquish the approved driveways in MCU-19-95 with the approval of
the following driveways from east to west:
Howell parcel - 1.) a 40-foot wide driveway 560-feet east of the site's west boundary
2.) a future driveway located 230-feet from both driveway #1 and driveway #3 (a
range of approximately 100-feet)
John Deere parcel - 3.) a 40-foot wide driveway, located 9-feet west of the site's east boundary with a
cross access easement to the Howell parcel
Sundance parcel - 4.) a future driveway located 230-feet from both driveway #3 and an existing
driveway to Lot 2 of the Playground Subdivision (a range of approximately 110-
feet)
The Sundance parcel has the choice of additional driveways or streets (total of 3
maximum) that may either align with driveways #1, #2, or #3, or offset 230-feet
to the east of driveway #1 (assuming no additional conflicting driveways).

SUBJECT: Request for Conditional Use Permit for a John Deere Dealership by Contractors
Equipment Supply Company (CESCO)
We have reviewed this submittal and offer the following comments, for your information and
consideration as conditions of the Applicant during the hearing process:
GENERA COMMENTS
Any existing ilTigation/drainage ditches crossing the property to be included in this project,
shall be tiled per City Ordinance 11-9-605.M. Plans will need to be approved by the
appropriate irrigation/drainage district, or lateral users association, with written confirmation
of said approval submitted to the Public Works Department.
2. Any existing domestic wells and/or septic systems within this project will have to be removed
from their domestic service per City Ordinance Section 5-7-517. Wells may be used for non-
domestic purposes such as landscape irrigation.
Determine the seasonal high groundwater elevation, and submit a profile of the subsurface
soil conditions as prepared by a soil scientist with the development plans.
4. Provide 5-foot-wide sidewalks in accordance with City Ordinance Section 11-9-606.B.
ACRD will require deposit into their trust fund for future sidewalk construction on Overland
Road.
Water service to this development is contingent upon positive results from a hydraulic analysis
by our computer model.
6. Bonding will be secured for any uncompleted improvements prior to temporary Certificate
of Occupancy being secured.

Re: CESCO Partial Amended Development Agreement
Dear Mayor and Members of the City Council:
I am writing on behalf of CESCO. We have successfully
resolved with City officials all of the issues regarding CESCO's
Partial Amended Development Agreement, with the exception of the
distance of the Five Mile Trunk Sewer Extension. As you may
recall, CESCO agreed to construct the Five Mile Trunk Sewer
Extension, individually or in cooperation with others, in the
event that Extension is not constructed by CESCO or another party
within five years from the date of issuance of a building permit.
We are hopeful that the Extension will be constructed before that
time by existing landowners, using funds already dedicated for
that purpose.
However, in the event CESCO must construct the Extension, we
agree that the distance and size of that line should be defined.
We have reached agreement with the City Engineer on those issues,
with one exception. The question we would like the City Council
to address is whether CESCO must construct the Extension to the
western boundary of its property. CESCO's position is that
extending the sewer line to its eastern boundary is sufficient.
Lot 2 of the Playground Subdivision already has adequate,
permanent sewer service that has been permitted and approved by
the City of Meridian. In fact, in the Development Agreement

between the City of Meridian and the Playground, Inc., the
Playground agreed to extend sewer lines to and along the exterior
boundary of the entire Playground Subdivision. The City agreed
that the Playground would extend and construct sewer line
extensions to serve the Playground Subdivision and connect to
City of Meridian sewer lines. Those sewer lines have already
been constructed on Lots 2 and 3. There is no reason to extend
another sewer line to property that already has adequate,
approved service.
CESCO has been provided with preliminary estimates by Masco,
Inc. for the Five Mile Trunk Sewer Extension. Masco estimates
that construction of the Extension will probably exceed $300,000.
Masco estimates that extending the sewer line from the eastern to
the western boundary of the CESCO property will cost an
additional $30,000. CESCO is investing approximately $80,000 to
install extensive landscaping. If CESCO must extend the sewer
line to its western boundary in five years, there may be a
significant amount of damage to CESCO's landscaping, sprinkler
system, signage, asphalt and other utilities.
We would suggest that CESCO has already made a sufficient
commitment to the City of Meridian by agreeing to extend the
sewer line to its eastern boundary. It is not reasonable to
require CESCO to construct an additional 465 feet of sewer line
through extensive landscaping for the benefit of a private party
that already has adequate sewer.
We look forward to presenting this issue to the City Council
tonight and completing the Partial Settlement Development
Agreement.

On June 17th, 1997 the Meridian City Council decided to release the Stop Work
Order on the construction of the CESCO Building. This release refers only to the
construction of concrete pouring and red iron erection to be allowed, not
involving frre safety or flammable materials. This will allow this type of
construction to proceed until the building permit is acquired. If you have any
further questions, please contact Councilman Ron Tolsma. A copy of the
minutes for this portion of the meeting will be given to you as soon as they are

The Nampa & Meridian Irrigation District has reviewed the plans for the above mentioned project. We
did approve of the proposed crossing into Cesco. The plans also indicate that al/storm water run-off
will be retained on site. if built according to the plans this project meets all of the requirements of the
Nampa & Meridian Irrigation District.
The easement on the Cook Lateral is 30 feet; 15 feet from the center each way. This easement is
non-encroachab/e without written authorization from the District. if there are any further planned
encroachments within this area, i. e., landscaping, signs, etc., the District does require a license
agreement. The plans do not indicate anything of this nature and /will assume unless l hear otherwise,
that no encroachments will be made.

Re: CESCO Amended Development Agreement and Building Permit
Application
Dear Wayne:
This letter confirms our agreement to meet by phone next
Tuesday, March 25, 1997 at 10:00 a.m. to make final changes to
the Amended Development Agreement. I have to admit I was
surprised by your statement that CESCO's building permit
application will not be processed until the Amended Development
Agreement is signed by the City Council.
For the past several months, CESCO has been trying ardently
to complete the Amended Development Agreement. We have responded
to all of the City's comments in an extremely timely fashion, we
have advised the City of our intent to apply for a building
permit, and we have done everything possible to move this process
along. We even submitted a proposed Amended Development
Agreement before CESCO's development application was approved by
the City Council.
The City is aware that CESCO's lease with the City of Boise
expires in September of this year. Unless CESCO commences
construction in the immediate future, it will be forced to
abandon its facility in Boise without having a place to relocate..
In that event, CESCO will suffer tremendous financial damages.
We are imploring, begging, and beseeching the City to
process the building permit application while we complete the
Amended Development Agreement. CESCO could have argued from the
outset that it was not required to obtain a conditional use

permit or Amended Development Agreement because its proposed use
is allowed in a C-G zone. Instead, it applied for the
conditional use permit, submitted a proposed Amended Development
Agreement, and has incurred substantial costs all in an effort to
satisfy the City's conditions. CESCO has agreed to construct the
Five Mile Trunk Extension in the event it is not constructed by
CESCO and other parties within five years.
My point is that CESCO has cooperated with the City of
Meridian every step of the way. Refusing to process the building
permit application because a few minor issues have to be ironed
out and signatures obtained on the Amended Development Agreement
is punishment, and not type of consideration a party should
receive for cooperating with the City.
I would greatly appreciate you speaking with the City
officials and requesting that they process the building permit
application while we complete the Amended Development Agreement.
If a foundation permit can be issued early next week, perhaps
some of the economic losses can be avoided. I would also
appreciate the City Clerk placing the Amended Development
Agreement on the City Council's agenda for April 1. Thank you,
and please contact me or Rita at CESCO (336-1850) if there is
anything CESCO can do to expedite this process.

I request assistance of your office is relieving an ongoing problem on Waltman Lane.
I have attempted to contact the Zoning violation office several times without success.
I have also contacted the property owner on three occasions regarding the problem
however he has appearerrtly chosen non-action.

There are two major issues, Westock (horses) and junk.
When the city improperly rezoned and annexed the section of land comprising the east
half of Waltman Lane and Johnson lane in 1984 there was no livestock on the properties
now owned by CESCO. No "grandfathered" use can be raised as the 5 property owners as
of 1984 never did have livestock, nor has any variance or CUP been applied for or
graded during the years from 1984 to present.
Historically, city and police records will prove that there have been a number of livestock
problems in the ensuring years which led to Meridian city and Ada County impounding a
sizeable number of horses.
Also, local law enforcemern officials initiated actions against five Waltman Lane
residerns for having in excess of six motor vehicles, including unregistered and uninsured
junk vehicles. That action included the resident then owning the particular property again
at issue.
The property owner, and his resident renter at 155 Waltman Lane have created a number
of issues and problems relating to the presence of non permitted farm livestock, junk
vehicles, operating ATVs without registration on Waltman Lane and pile of trash now
existing at CESCO owned property.
Respectfully request that the City of Meridian now take action concerning presence of
livestock and trash on CESCO property by requiring those violations to be removed
immediately.
For information, resident Mr Ron Craig at 155 Waltman, and his resident female
companion, have committed a number of threatening and harassing acts against me and
my wife, to such an extent that I am applying for a restraining order against them as I
have found it unsafe to operate my wheelchair in my own neighborhood.
In 1984 the City of Meridian rezoned that parcel of land from rural residential to
commercial, some time before the city actually annexed the property. Additionally, the
rezone and annexation request and process submitted by now defunct High Country
properties contained a sunset clause to abandon the rezone and annexation if High
Country did not go forwazd with their development plans. I sued Nigh Country in 1986
and tied their funding up which caused the abandonment of their corporate entity and
project plans.
That legal action was abandoned by my attorney in approximately1997 as the principals
to the defense had disappeared and abandoned the funds held by an escrow agency.
Subsequent to my legal action other property owners also sued and foreclosed on High
Country.
I have repeatedly requested that the City of Meridian comply with Sunset clause however
the officials have steadfastly refused to do so, therefore livestock and trash free zoning
remains in effect.
Now, 23 years later, this azea still has no city services including water and sewage
although the City continues to reap some $800 per year per acre in taxes for zero service.
Amusingly, the city threatened to shut off my sewer over payment of 50 cents for trash
service. I have a private contract with the refuse removal compa~ however I pay through
the city at their insistence in the spirit of cooperation.
I look forward to the City of Meridian contribution in resolving the ongoing problem
created by CESCO.
