I apologize for the delay in responding. You asked that I respond to the claims raised concerning the last three (3) incidents in your letter. Those incidents relate to Hunts Bluff Subdivision No. 2, regarding height restrictions, house sizes in Salmon Rapids Subdivision No. 2, and the house sizes in Los Alamitos Park No. 1. In regards to the Hunts Bluff height restrictions on houses, this matter came up as a result of the City receiving a complaint from an owner of adjacent property. I believe he lives in Meridian Greens. He stated that Mr. Goldsmith had indicated that there would not be two story homes near his property. Mr. Goldsmith did state at a hearing regarding a variance that he would not construct two story homes on the lots fronting Meridian Greens if he was required not to. There was also a memorandum Pe to ningetooHunts who was an employee of the City at that time, Bluff No. 2 which stated, in essence, as follows: "Because developer committed to building height and roofing material restrictions...approval by the City Council should be contingent upon complete file review...to verify compliance with all development issues." I addressed this issue with the City Council and indilaced on them that there were no height restrictions specifically p this property and that there was no authority to place height restrictions now. It was my understanding that a builder was r '' ~ , delayed in the construction of a two story home, but was allowed to finish his project. It was also my understanding that this matter was going to be discussed with Mr. Goldsmith to see if it could be agreed that, on lots adjacent to Meridian Greens, no further homes would be built that were two story in height. I do not know the final status of any discussions. In regards to the home sizes in Salmon Rapids No. 2, the Findings of Fact and Conclusions of Law for the annexation state that there will be 1,500 square foot homes within 500 feet of Meridian Greens. The preliminary plat application states that the homes would be 1,400 square feet, but the final plat application states that the homes would be at least 1,500 square feet and on the final plat, it lists 1,800 square feet as being the mandatory requirement. In regards to the home sizes in Los Alamitos Park, the Findings of Fact and Conclusions of Law state that the R-4 house size requirement applies, which is 1,400 square feet. However, the Los Alamitos Covenants, Conditions and Restrictions require 1,500 square feet as a minimum for house sizes. Also, the final plat application received by the City on April 14, 1994, states that the minimum square footage of the structures would be 1,500 square feet. Therefore, from the above, it can be seen that one builder was slowed down while the City of Meridian considered the issues regarding two story houses in Hunts Bluff, but to my knowledge the matter has been resolved. With regard to the house sizes in both Salmon Rapids and Los Alamitos, the City is not requiring a larger house size than Mr. Goldsmith asked for and submitted on his final plats. I don't believe therefore, that the City of Meridian is causing any more hardship on Farwest Developers, Inc., which as I understand it, is basically Marty Goldsmith, then they requested to have placed upon them. The, plans indicate that all run-off will be retained on-site which will meet the District's requirements. The plans also indicate that a reten- tion pond will be located close to or within the Ninemile Drain's easement which is 60 feet (30 feet from the center both ways). If your plans are to put the retention pond within the easement, Nampa & Meridian Irrigation District will need more detailed information and we will need to perform an inspection at the time the pond is constructed so that we can be sure that it will not interfere with the District's operation and maintenance. Agreements are required for any encroachment within a District facility. The developer must contact Daniel Steenson, the District's attorney, at 342-4591 and request that he prepare a License Agreement for encroachment. Once the agreement is signed and returned, it will go before the District's Board of Directors for their consideration at the next available board meeting. You indicated to me that you were considering phasing the construction of Los Alamitos No. 2 and I told you that at a minimum I thought that you needed to comply with the items outlined in your August 26, 1996 correspondence as Items a,b,c, and d, I told you that those issues needed to be discussed with the Meridian Ci Clerk and the Meridian Plannin and Zoning Administrator, as t ey were not within my jurisdiction. I also told you that you would nee to discuss the phasing with A.C.H.D. I further stated that you need to submit revised plans that reflect the. phase lines before I could do a comprehensive review of Los Alamitos No. 2 and I would be awaiting your decision on this matter. 2. It appears to me that Nampa and Meridian Irrigation District has signed the Amended License Agreement, even though the dates are incorrect in more than one location, and it has been recorded. The easement for the sewer line has bees recorded and should not impact our final acceptance of Los Alamitos No. 2. The City of Meridian, however will not be responsible for the sewer line until the final acceptance of the subdivision improvements. 3. I did not tell you that the review would be completed by any certain date. I did confirm that Salmon Rapids was the next pmject that I would review. I am working on it at this time. Initial review of yow developmerrt plans was delayed because of the problems you were having in presenting a final plat to the City Council for their action. As I recall our discussion on August 26, 1995, you were to inform me of your decision on the phasing of Los Alamitos No. 2 and submit revised plans to reflect the phase lines. The revised plans have not been submitted and my review cannot be completed ulrtil they are resubmitted to me. .. ~ • 4. I informed you that I was not aware of a~+ variances being granted by the City Council to piping airy ditch requiring 48" diameter pipe or less and emphasized that-you would need to communicate directly with Shari Stiles on this matter. - Also, please be informed that the replacement of the culvert on the north end of the Nine Mile Drain, where it leaves the north boundary of Los Alamitos Park Subd., and the deeding of the well lot to the City of Meridian is required prior to the final acceptance of Los Alamitos No. 1. The subdivision improvement plans, including but not limited to, sanitary sewer, domestic water, irrigation water, storm water, streets, fences, berms, need to be revised to show how ~ of these improvements will end at the proposed phase line. 2. ANon-Development Agreement needs to be entered into between Farwest Developers and the City of Meridian. A sample is attached for your attorney to use as a basis in drafting this agreement. This non-development agreement will need to be reviewed by city staff including Wayne Crookston and will then need to be approved by the Meridian City Council for the Mayor's signature. 3. The Ada County Highway District will also require anon-development agreement for the street construction portion of the improvement plans. I am not sure of their approval process so you will need to talk to them. 4. After we have approved the revised development improvement plans, showing the temporary termination details for the various subdivision improvement elements, you can request apre-construction meeting for the installation of the improvements. 5. The bonding requirements you have provided to Will Berg may be reduced in accord with the reduction in the scope of the subdivision improvements. Persons making the requests must provide the following information: 1) owner/contractor, 2) project location, 3) date and time when the inspection is needed, 4) type of inspection, 5) permit number. The inspection request line is available 24 hours a day, 365 days a year, inspections will be performed Monday - Friday, between 8:00 AM and 5:00 PM, excluding holidays. Other Permits are Requited for the installation of any electrical wiring, plumbing piping and mechanical installations related to gas fired equipment. Permit R.evocation/Espiration. The Building Official reserves the right to revoke any permit issued in error or on the basis of incorrect information. Permits expire in 180 days if work is never commenced, or is discontinued for a period exceeding 180 days or 6 months. I have reviewed this submittal and offer the following comments, for your information and consideration as conditions of the Applicant during the hearing process: We have been receiving quite a few complaints of low water pressure from residents in various parts of the City. Also, our water system has not been able to supply required flows to fire sprinkler systems in some recent commercial developments. These developments have had to install a pressure booster pump in their line in order to meet required fire sprinkler flows. In light of these problems we don't feel comfortable adding more demand to our already taxed water system, and we respectfully request that this application be tabled until such time as we have the problems better defined and a clear plan of action in place. GENERAL COMMENTS 1. Any existing irrigation/drainage ditches crossing the property to be included in this project, shall be tiled per City Ordinance 11-9-605. M. Plans will need to be approved by the appropriate irrigation/drainage district, or lateral users association, with written confirmation of said approval submitted to the Public Works Department. 2. Any existing domestic wells and/or septic systems within this project will have to be removed from their domestic service per City Ordinance Section 5-7-517. Wells may be used for non-domestic purposes such as landscape irrigation. 3. Morrow: Mr. Mayor, at this time I would like to ask Gary Smith to address a couple of comments that appear to be on all three of the plats that we are dealing with tonight. Obviously we tabled the D.W. one but comment No. 2 with respect to the water system. If he could make us a short presentation because I think that has some bearing on what it is we are going to do with these plats. Kingsford: Mr. Smith, I know you have spent a day and a half on that subject and will be well versed. Smith: Thank you, we have been receiving a few complaints from residents within the City and various parts of the City but primarily in the northeast part that they have been experiencing low water pressure. to the past there have been other reports in the past year • Meridian City Council June 20, 1995 Page 11 or so of lower water pressure. This year it seems to be much more significant. At the time that I submitted these comments to you we weren't sure exactly what was happening. On all of the subdivisions that come before you for approval or a decision we run a water flow check through our computer model to verify that we have fire flow of 1,000 gallons per minute with a residual pressure of at least 20 psi or a minimum of 20 psi which is a fire flow minimum standard. At this point in time we have not had a failure in that computer model. Since the time that t wrote these comments to you we have done some investigating with our water superintendent with our water consulting engineer that help develop the computer model. It doesn't appear as though we have a supply problem although we just began to do some changing in our telemetry control system. So we don't know for sure. We have had a certain sequence of wells come on and turn off depending upon the water level in the tank. We have juggled the sequence of the wells coming on and turning off such that we have a well, a lead well coming on that is located in the northeast part of town. Hopefully with this well running more it will pressurize that system in that area and upgrade the pressure. At this time, because we only did that this morning I don't really know what the results of that will be. Morrow: Can you guess how long it will be before we have meaningful. information for that problem, a week or 2 weeks? Smith: I would think that it would be pretty evident within a few days as to whether that is going to work or not. We have put some pressure recorders out in the system in that area. Particularly at the homes of some people that have been in contact with us previously about the water pressure problem. The other thing that is a little bit bothersome is that our big well runs a lot, Well No. 15 on Linder at the Vineyards Subdivision runs a lot. For example, yesterday the information out of the computer showed that it ran 24 hours out of 24 hours. The other well that was running in conjunction with that well ran for approximately 4 hours on and off during that 24 hour period. For example, yesterday only 2 wells were on of the seven wells that we have supplying the City. So, we have 2 wells of the seven that are down. One well in the northwest part of town, Cherry Lane and Ten Mile Road will be in operation in ten days, back in operation in ten days. Which will help the pressure situation out there which will in tum help the pressure situation in the northeast part of town becaase since the gradient is from east to west and we have additional flow then provided in the west that flow gradient will not be as great from east to west which will help the pressure on the east part of town. 1 just became concerned because I didn't know what the answer was. I knew we were getting a lot of calls and I didn't feel prudent in marching ahead with more development until we knew or at least from my standpoint in saying that we have the ability to serve until I knew what was happening. I don`t know as of this point in time I feel fairly comfortable that it is not a supply problem just based on looking at the run stop records of the wells. Yesterday we had 2 wells running all day is all. We have some cool weather right now, this weekend is • Meridian City Council June 20, 1995 Page 12 projected to be 90 to 95 degrees, hot weather again. It is just a fact that people pour the water to the lawns good or bad. Thankfully based on your efforts the pressurized irrigation is becoming a reality which is very helpful and will continue to be helpful. Nevertheless, I just felt uncomfortable at the time I wrote these comments I didn't want to proceed without knowing what was really happening. Morrow. Let me ask you this, are you still a little uncomfortable, would you feel better if we postponed these until our July 5th meeting which is a matter of 10 or 12 days from now or do you feel comfortable enough where you are at in terms of this troubleshooting to press on tonight with them? Kingsford: I think the question that I was going to ask Gary may have some information for Mr. Morrow on that subject. What was the amount that the wells put out that ran yesterday in number of gallons per minute? Smith: Well, I don't know the total gallonage Mayor, but Well No. 15 was running about 1,950 gallons per minute and Well No. 14 pumps about 1,550 gallons per minute. Kingsford: What is our total if all the wells were running what is their capacity? Smith: If we had Well No. 9 which has been off for awhile and 12 back on line those 2 wells back on line we would be at around 9,000 I think 9,100 gallons per minute total. Kingsford: So we were running it just over a 1 /3 of our capacity? Smith: Well, 14 didn't run, it ran only 4 hours out of the 24 hours. Kingsford: I mean when they were both running. Smith: When they were both running correct. As I mentioned earlier, I don't think that supply is a major problem, I think it is an issue. Well No. 16 which has been drilled and is out for bid right now for equipping the pump and pump house is a pretty important well for that end of town, for the east end of town. It is important from the standpoint of pressure on Eagle Road and East of Eagle Road in the commercial area which we are lacking in right now. 1t is important for fire flow demand, quantity of water. I wouldn't expect that Well No. 16 would be operational for maybe 45 days from the date that we open bids which would be the first week in July. I am still not absolutely comfortable that we have solved the pressure dilemma in the northeast part of town. I think though that we are going to see some positive change there by the different sequencing of the wells coming on. And I know that we are going to see some positive impact when Well No. 12 is reactivated in the northwest part of town. Exactly what that means in terms of numbers C~ Meridian City Council June 20, 1995 Page 13 • I don't know. I guess my conservative attitudes from engineering just kind of take over a little bit. Because we have been running pretty hard everywhere. Corrie: I think from that explanation I would feel more comfortable tabling this until the July, would the July 5th meeting help you a little bit more on that Gary? Smith: Yes sir, it would; it would give us a chance to see what is going to happen, how things are going to react. I think that we are going to have to play with this a little bit with the controls. The controls on the telemetry because it is controlled by our tank level the controls in the telemetry system are very touchy. A change in a tenth of a foot in the on and off sequence of a well makes a difference, it doesn't seem like it would but it certainty does because I can stand there at the board and watch it happen. I think we need to and talking with our Water Superintendent he says the same thing, it is very touchy it has very little change can make a difference. I am not sure that, I think that the demand on the system has an effect on that change too. How soon the change takes place in the tank the water level changes in the tank. There are several things that we are looking at to modify our control system. One of them is to modify the telemetry such that part of the wells would be operated off of the water level in the tank and part of the wells would be operated off of pressure set points within an area such as the northeast part of town that would have a well on or off only by pressure in that region on that area. So we would have a pressure zone out there. But some of these things that we talked about we need to look at harder and find out all the intricacies of what kind of changes would need to be made. to accomplish it and how beneficial it would be to do that. Kingsford: I think personally I recognize Gary's concerns but as we look at last year's flows in the wells cycling on and off I agree we have a problem with pressure, but even last year during the hottest season all the wells did not run anywhere near all the time. Smith: There were days when they were all running. Kingsford: But not anywhere near all the time. Smith: Not all the time no sir, we have the peak periods of time that they were all on. Kingsford: The other thing that I think the Council needs to look at is we are looking at 45 days to 50 days to have that well on in the eastern part of town. These subdivision if approved tonight are not likely to have a house built and on line for that prior to that well being on line. Whatever your guys comfort level is. Tolsma: Question for Gary, when is our next (inaudible) comer of Ustick and Locust Grove area are we going to (inaudible) when is that up for bid (inaudible). • • Meridian City Council June 20, 1995 Page 14 Smith: Yes, it would be started quite soon, I have already placed and order with Idaho Power, a work order with them to generate the power being brought into the lot. We do have the deed for the lot, basically we have the specifications from the last well put together with some minor changes that thing can go out the door in pretty short order for drilling. Tolsma: What is the time frame on that roughly, six months? Smith: No it wouldn't be that long, I would say that well at a minimum we would have before a driller, once we start advertising it would be a minimum of probably a month before we had a driller on the site to start drilling. If we had another 2 months well, let's see. If we had a driller on the site for a month that would be 2 months and I don't think he would be there that long depending on the type of drill rig that he has. But a reverse rotary drill for example can drill a well in a week, they are in and out of there in a hurry. But assuming that we had a cable tool rig come in and drill it then that could take a while and anymore I can't tell you how long a cable tool takes to drill, it seems like forever. I would think that a month to get a contract through a month to get them in there and out of there for drilling, 2 months to equip it, so we are probably 4 months. Tolsma: So we are still into September, late September. Smith: Yes Tolsma: After the peak water usage anyway. Smith: It would be getting in on the tail end of the peaks correct. Then we have another well to drill south of town on Locust Grove at the Los Alamitos site. That is kind of important over there too just based on the development that is going on plus the fact that we only have one well on that side of the interstate and we have one water line crossing of the interstate. Tolsma: (Inaudible) Locust Grove and Ustick. Smith: Right. Morrow: Mr. Mayor, I think from my standpoint it is my preference that 2 weeks is not or July 5th is not a major time frame to wait. I think that I would feel more comfortable in terms of our staff if we tabled both item 10 and 11 until July 5th. So I would move that we table items 10 and 11 until July 5th. I hope they understand that this is being taken very seriously by me because for the welfare of the people that are already here utilizing water. I hope I am not over-reacting I just felt like I needed a few minutes to get a good assessment on what the situation is and give you the best information possible for decisions. ITEM #12: PUBLIC HEARING: REQUEST FOR ANNEXATION AND ZONING OF 39.87 ACRES TO R-4 BY PNE/EDMONDS CONTRUCTION (PACKARD SUBDIVISION): Kingsford: At this time I will open that public hearing and invite the owner or his designee to speak first. Ted Hutchinson, Tealy's Land Surveying, 109 South Fort Street, Boise, was sworn by the City Attorney. Hutchinson: Thank you Mr. Mayor and members of the Council, we are requesting, annexation of about just under 40 acres of ground, we are adjacent to the city limits on 2 sides. We have Wingate Place subdivision on the west side and the next phase whenever it comes before you of Dove Meadows on the south as well as the Capital Christian Center on the south. We are located west of Eagle Road there is a 1l4 mile separation between Eagle Road and our site. We are also a 1/4 mile north of Fairview. We do stretch, we are about that square 1/4 in there. There is a subdivision application which was delayed at the Planning and Zoning level we believe we have everything ironed out at their last meeting they recommended approval and passed that on. That subdivision request will be coming before you. The area surrounding the site is predominantly residential zones, there is R-8 to the west which has the smaller lot sizes and R-4 I believe to the south. We are proposing that this be annexed for residential development with an R-4 density. The lots will be at least the minimum lot size would meet the R-4 zoning standards. The lot sizes that we are proposing range from 8,000 to almost 20,000 square feet. We have reviewed the findings of fact and conclusions of law that were issued by the Planning and Zoning Commission. We agree with those basically I believe they were recommending that this be annexed and that there were several requirements that were included. However there seem to be some confusion because we are also submitting Packard Subdivision No. 2 which is going to be north of this site and north of that or adjacent to that - • • Meridian City Council July 5, 1995 Page 5 know CH2M Hill said we needed a 5% reserve capacity or something like this. Smith: No I haven't. Tolsma: But with the other wells how many GPM we could pump if we had to. Smith: With Well No. 12 and Well No. 16, 16 will be on line in September, we'll have about 10,700 GPM capacity. Out of that you need to eliminate your large well in order to call it firm capacity assuming that you have one well down. Our large well is No. 15 which is pumping 1900 and some gallons per minute. Smith: Mr. Mayor, Councilman Morrow, this issue came to light from a developer contacting me by telephone and subsequently came to visit. The lending institution FHAVA that he was trying to get his loan secured through for his home buyer was very • Meridian City Council July 5, 1995 Page 6 uncomfortable and apparently would not finalize the loan because of their uncertainty as to the regulation of the water user fees for the pressurized irrigation. The reason for this was because apparently the developer was going to operate and maintain the pressurized irrigation system. I told the developer that I didn't know how the rates were to be regulated or who was to regulate the rates. I also told him that there was no connection allowed by the homes to the City system for sprinkler water because their system is being provided with water from a well. Our policy has been that if well water is used for pressurized system there is no connection to the city system for sprinkler, yard sprinklers. The reason for that is because well water is always available and there is no reason for a connection to the City system. If it is a ditch water provision for the sprinkler systems then we are allowing a single point connection to the city system so that we can keep track of number one the water back flow prevention device, that is the most critical thing. We don't have a whole handful of devices to monitor and keep track, we have one at the pump station. Kingsford: On that light Counselor, in order for that developer to be the purveyor of irrigation water he would have to have PUC approval. I am talking about over 20 users and those rates would have to be regulated by the Public Utilities Commission. Crookston: Mr. Mayor I am not quite certain because it is not domestic water. It is basically irrigation water and I don't believe that the PUC let's say controls the various irrigation district. Their rates are not overseen by the PUC. Kingsford: But they were set up prior to the State. Crookston: Some of them. Kingsford: All the ones for this valley were. Crookston: t don't know, but that would be my only guess as to that question. Tolsma: It would not be that each lot has bought its own individual water rights that this developer once he sells the lot is not in control of the water rights anymore. He has to actually the sell the water rights back to the people (inaudible) if he is charging a fee for delivering irrigation water. Crookston: It is my understanding in this subdivision that he is using well water of which there would be no water rights, surface water rights at least to each lot. If it is well water then it comes from his source. Kingsford: I think even further he contended that at least in one or other of both of these subdivisions that there was not irrigation water available, that they weren't a part of any 1. J Meridian City Council July 5, 1995 Page 7 irrigation districts. Crookston: That is my understanding in one of either Los Alamitos or Salmon Rapids. Kingsford: Well, certainly that is something I would like to have ironed out prior to approval. I would caution the Council on getting involved in allowing businesses starting in the area of irrigation water distribution. Our intent is to limit the need of our domestic system, it is not to set up businesses for people out there. Morrow: I think there is a lot of gray area here. The other thing with respect to the PUC some years ago they did away the ability of an owner to resale regulated utilities such as water, power and those kinds of things in multi-unit complexes. So I think that all of these questions need to be addressed before we move on on either one of these. The other, Gary's site specific comments on item 1 it seems as of June 19th the plat doesn't conform with the previously approved preliminary plat. The acreage reported in the application appears to be an error because of this error the density of lots per acre are also in error. The preliminary plat that we have on record as approved is titled Sagehen Estates Subdivision a revised preliminary plat hasn't been submitted to the City as a result of public hearings and our comment process. Now that would seem to indicate to me everything that was done before the public forum or in the public arena here and hearings before us and the P & Z, if I understand this correctly has not been acted upon by the developer, is that correct Gary? Or just exactly what is being said here? Smith: The plat that was originally submitted as Sagehen Estates bears some resemblance, or the final plats being submitted now bear some resemblance to the preliminary plat. But there are some major differences that have taken place in lot arrangement, street alignment and so forth. Morrow: Thank you, Mr. Mayor, from my standpoint and for point of discussion I am not prepared to move forward on this item at all until all of these issues are resolved and resolved in witting and addressed. Particularly the inconsistencies with the plat and with the irrigation and the water issue. It doesn't make sense to me if we proceed forward. Kingsford: Under item 7, Gary, the FEMA floodplain, have you received any correspondence from FEMA on that. I know we have gotten 3 or 4 that I don't remember one specific to this subdivision. Smith: Mr. Mayor, the Nine Mile Creek, Nine Mile Drainage that basically bisects this property was not studied, was not included in the study area by FEMA. They have done some study work downstream and in fact found that it would be necessary to replace a culvert just to the north of Los Alamitos in order to get Nine Mile Creek through that • Meridian City Council July 5, 1995 Page 8 • roadway crossing. That has been done by this developer, he did commission a hydrologist to do that. It is kind of standard comment that we put on these subdivisions so we don't, so we do address the floodplain issue if it does exist. Kingsford: You started with something else Gary? Smith: I just wanted to mention that I have not heard from the developer or their representative concerning my comments at least. Kingsford: Have you heard from them Shari on your comments? Stiles: I have not had any response from the applicant or his representative on any of my comments. Most of them are relatively minor. I did talk to Marty Goldsmith today and I didn't realize he was on the agenda tonight. I didn't have the agenda with me so he wasn't aware. But since Dave Roylance was at the last meeting I would have thought he would have informed him of what happened last meeting. Kingsford: Councilmen? Morrow: Mr. Mayor I would move that we table this proposal until our July 18th meeting. The lending institution FHAVA that he was trying to get his loan secured through for his home buyer was very • Meridian City Council July 5, 1995 Page 6 uncomfortable and apparently would not finalize the loan because of their uncertainty as to the regulation of the water user fees for the pressurized irrigation. The reason for this was because apparently the developer was going to operate and maintain the pressurized irrigation system. I told the developer that I didn't know how the rates were to be regulated or who was to regulate the rates. I also told him that there was no connection allowed by the homes to the City system for sprinkler water because their system is being provided with water from a well. Our policy has been that if well water is used for pressurized system there is no connection to the city system for sprinkler, yard sprinklers. The reason for that is because well water is always available and there is no reason for a connection to the City system. If it is a ditch water provision for the sprinkler systems then we are allowing a single point connection to the city system so that we can keep track of number one the water back flow prevention device, that is the most critical thing. We don't have a whole handful of devices to monitor and keep track, we have one at the pump station. Kingsford: On that light Counselor, in order for that developer to be the purveyor of irrigation water he would have to have PUC approval. I am talking about over 20 users and those rates would have to be regulated by the Public Utilities Commission. Crookston: Mr. Mayor I am not quite certain because it is not domestic water. It is basically irrigation water acid I don't believe that the PUC let's say controls the various irrigation district. Their rates are not overseen by the PUC. Kingsford: But they were set up prior to the State. Crookston: Some of them. Kingsford: All the ones for this valley were. Crookston: I don't know, but that would be my only guess as to that question. Tolsma: It would not be that each lot has bought its own individual water rights that this developer once he sells the lot is not in control of the water rights anymore. He has to actually the sell the water rights back to the people (inaudible) if he is charging a fee for delivering irrigation water. Crookston: It is my understanding in this subdivision that he is using well water of which there would be no water rights, surface water rights at least to each lot. If it is well water then it comes from his source. Kingsford: I think even further he contended that at least in one or other of both of these subdivisions that there was not irrigation water available, that they weren't a part of any •. Meridian City Council July 5, 1995 Page 7 irrigation districts. Crookston: That is my understanding in one of either Los Alamitos or Salmon Rapids. Kingsford: Well, certainly that is something I would like to have ironed out prior to approval. I would caution the Council on getting involved in allowing businesses starting in the area of irrigation water distribution. Our intent is to limit the need of our domestic system, it is not to set up businesses for people out there. Morrow: I think there is a lot of gray area here. The other thing with respect to the PUC some years ago they did away the ability of an owner to resale regulated utilities such as water, power and those kinds of things in multi-unit complexes. So I think that all of these questions need to be addressed before we move on on either. one of these. The other, Gary's site specific comments on item 1 it seems as of June 19th the plat doesn't conform with the, previously approved preliminary plat. The acreage reported in the application appears to be an error because of this error the density of lots per acre are also in error. The preliminary plat that we have on record as approved is titled Sagehen Estates Subdivision a revised preliminary plat hasn't been submitted to the City as a result of public hearings and our comment process. Now that would seem to indicate to me everything that was done before the public forum or in the public arena here and hearings before us and the P & Z, if I understand this correctly has not been acted upon by the developer, is that correct Gary? Or just exactly what is being said here? Smith: The plat that was originally submitted as Sagehen Estates bears some resemblance, or the final plats being submitted now bear some resemblance to the preliminary plat. But there are some major differences that have taken place in lot arrangement, street alignment and so forth. Morrow: Thank you, Mr. Mayor, from my standpoint and for point of discussion I am not prepared to move forward on this item at all until all of these issues are resolved and resolved in witting and addressed. Particularly the inconsistencies with the plat and with the irrigation and the water issue. It doesn't make sense to me if we proceed forward. Kingsford: Under item 7, Gary, the FEMA floodplain, have you received any correspondence from FEMA on that. I know we have gotten 3 or 4 that I don't remember one specific to this subdivision. Smith: Mr. Mayor, the Nine Mile Creek, Nine Mile Drainage that basically bisects this property was not studied, was not included in the study area by FEMA. They have done some study work downstream and in fact found that it would be necessary to replace a culvert just to the north of Los Alamitos in order to get Nine Mile Creek through that Meridian City Council July 5, 1995 Page 8 roadway crossing. That has been done by this developer, he did commission a hydrologist to do that. It is kind of standard comment that we put on these subdivisions so we don't, so we do address the floodplain issue if it does exist. Kingsford: You started with something else Gary? Smith: I just wanted to mention that I have not heard from the developer or their representative concerning my comments at least. Kingsford: Have you heard from them Shari on your comments? Stiles: I have not had any response from the applicant or his representative on any of my comments. Most of them are relatively minor. I did talk to Marty Goldsmith today and I didn't realize he was on the agenda tonight. I didn't have the agenda with me so he wasn't aware. But since Dave Roylance was at the last meeting I would have thought he would have informed him of what happened last meeting. Kingsford: Councilmen? Goldsmith: I do Morrow: What does I do mean? Goldsmith: I own the pressurized irrigation system? Morrow. And for how long? Goldsmith: Until I choose to give it to the homeowners or just maintain the system. Morrow. What is the line of thinking behind that? Goldsmith: Potentially making some money there, I would be providing a service, somebody is going to have to provide that service. Morrow: Who regulates the rates? Goldsmith: No one that I am aware of. Morrow. So in other words the homeowners that buy in there will be held hostage by the pressurized irrigation system that you own and subject to-the rates that you choose to charge? Goldsmith: I vuould sure be willing to set a rate, until this point I haven't charged anything, I was trying to get homes, like say 45 in the first phase set up so that I can establish what the running costs were off of records as opposed to a swag figure. Kingsford: Have you checked with the powers that be, is that not something that would be need to be regulated by the public utilities commission? Goldsmith: That is a distinct possibility, it is as you guys know in a gray area there. I will conform to the powers that be. Kingsford: I don't know about the Council's feeling, but it was certainly not the intent of us requiring pressurized irrigation to set up a bunch of entrepreneurs in the water system. I think that is something that ought to belong to the homeowners, but that is a Council decision. Morrow. I think very candidly from my perspective is that I am not willing to approve any • Meridian City Council July 18, 1995 Page 4 • further action on either this subdivision Los Alamitos or Salmon Rapids until the issue is resolved. I think there is a whole lot of gray area here, I did meet with Bill Henson and visited with him concerning this. The question is with respect to water and irrigation water. availability there is surplus water within the Nampa Meridian Irrigation District that can. be filed upon and supplied to these grounds. Between the two I am not willing to have a private, my suspicion is that also that the PUC probably does not regulate irrigation water issues. Having said that I think that we need to have as a Council and as a City more than adequate background information checked out by legal counsel. The other thing is that I am not willing to put the homeowners in there at somebody's mercy in the future with respect to those water issues. Quite candidly could the price of water become high enough that they no longer use it, the answer is yes. It defeats the purpose of pressurized irrigation ordinance. So, those folk would be coming back on to using City water that is becoming a very precious commodity to irrigate lawns if the price is too high. It sounds to me like in this issue there is no point of control and so I am not willing at this point to move either one of these projects further along until these issues are resolved. Goldsmith: What issue exactly did you want resolved there Walt? Morrow: I want the issue of the pressurized irrigation resolved so that it is not privately owned and so that it is administered either by Nampa Meridian Irrigation District or by the homeowners association of the subdivision. The same as any other subdivision within the City of Meridian. I am not going to support any privately owned pressurized irrigation system. And that states my position. Goldsmith: Are there any other issues on Los Alamitos? Morrow. Only those issues brought forth by staff and those types of things. Kingsford: I believe you have that letter from staff outlining the conditions that they have, what had not been met. Goldsmith: Is staff happy with Los Alamitos other than the pressurized irrigation I guess would be one of my questions. Kingsford: Gary, have all of those conditions been met to your satisfaction on Los Alamitos? I suppose we could speak to Salmon Rapids in the same breath. Smith: Their engineer has addressed the comments that I made. Kingsford: To you satisfaction, Shari do you have anything? • Meridian City Council July 18, 1995 Page 5 (Inaudible) Kingsford: So at issue then seems to be the water. • Smith: One other thing I might mention Mr. Mayor, Council, Public Works Department has taken a policy, established a policy that on the pressurized irrigation situation the subdivision is supplied water in their pressurized irrigation system from a well we have not been allowing any connections of the lots to the City domestic system for water. The reason for that is the well water is always available or should always be available. It is not a seasonal thing like ditch water is. So in order to help us with the back flow prevention devices and monitoring all of those things we just said you have well water in your subdivisions for a pressurized system, to the City system for water Kingsford: For irrigation water? Smith: Correct. there is no reason that you should be connecting Kingsford: Any other comments then on the pressurized irrigation issue? It seems to be the only issue then. Goldsmith: The only thing we have to work out is the pressurized irrigation for both of those subdivisions. Kingsford: And of course before the plat is signed all of those things that your engineer has agreed to would have to be accomplished. Goldsmith: I think that they were basic. At this time I can commit to you to signing your non-development agreement or your development agreement that I would give that pressurized irrigation system over to the homeowners. Kingsford: Any other questions of Council? What is the Council's pleasure? Corrie: Mr. Mayor, I would, seeing that there are no other problems with this subdivision with staff and ourselves other than this I would move that the final plat for Los Alamitos Park Subdivision be approved with the following conditions, that all the conditions set forth by staff have been met. My question is that under item 5 it says all buildable tots for single family dwellings only, each dwelling unit shall have a minimum floor area of 1400 square feet excluding the garage area. Any houses within 500, what is the rest of that paragraph, within 500 what? Stiles: That would be any within 500 of Meridian Greens which was a condition of the phase 1 plat. Morrow. Does that apply to this also? Stiles: Yes Morrow: And what does the within 500 feet mean, that Stiles: Five hundred feet of the boundaries of Meridian Greens. MOTION CARRIED: All Yea ITEM #26: DOVE MEADOWS HOMEOWNERS: CONCERNS ABOUT NON- COMPLETION OF LANDSCAPING: Kingsford: Are there representatives of Dove Meadows here, can we hear that presentation please. Riley, Rob Riley, I am a homeowner in Dove Meadows Subdivision. The reason why we are here as residents of the Subdivision of Dove Meadows and have some concerns about the entryway to our subdivision. Basically it is not completed at all, I had wanted to buy a home in that subdivision around August of last year and was told by my realtor and builder what would be done with the subdivision and the entryway and everything (End of Tape) It was stated that the church would be the first entryway and then as it gets back to the subdivision that the developer would continue on that. Winter came I bought the house, not too much was being done. Spring came and trees were put in along the berm on the east side of Hickory Road that is the entry way there and also on the west side. Irrigation was put in on the east side but not anything on the west. I am surprised the trees survived but water was not actually turned on until it was pretty close to the middle to the end of August. We as residents contacted our developer many times to try and determine what was going to be and when it was going to be done. I think primarily our concern was the appearance of the subdivision. Obviously resale value is an important thing, taxable items, things like that. We were kind of put on the back burner, nothing was really ever done. About two weeks ago sod was laid on the east side berm on Hickory, it looks great. The west side however still does not have irrigation, there is no water, weeds continue to grow, they have a team come out once a month to pull the weeds. There are islands as you enter into both streets, Grapewood and Apricot and there are little islands, it is about 4 or 5 feet wide, about 20 to 30 feet long. He came in the other day and he put in two different kinds of rock, there are no trees, there are no plants, no grass. There is a water meter in the middle of that, both islands where we thinking he may be able to tap into that and get some kind of irrigation, some kind of growth could happen there. A couple other concerns that we have is the entrance from the church and coming forward, they have hydroseeded some of that and then they try to plant the rest and is overtaken with a lot of weeds and that: I guess the appearance to otu' subdivision is really important to us. You drive around and actually listening to the previous testimonies here a lot of landscaping is important. We would like to have that evaluated. Whether our developer Dave Leader is really doing what he has promised to the City Council would be done. A couple of other items, to the north of the homes on Apricot to the south of the homes on Grapewood there are open fields where new development will eventually take place. Those are just filled • Meridian City Council November 8, 1995 Page 16 Morrow. Mr. Mayor, I would move that the City Council of the City of Meridian approve the conditional use permit requested by the applicant for the property described in the application with the conditions set forth in the findings of fact and conclusions of law or similar conditions as found justified and appropriate by the City Council and that the property be required to meet the water and sewer requirements, the fire and life safety codes, uniform fire code and other ordinances of the City of Meridian. Morrow. Yes Mr. Mayor, I v~rould like to hear a presentation on behalf of the developer for the record, what phasing means. McCall: Mr. Mayor and City Council, the developer in this case because of a water conditions primarily had elected to phase .the development and hold back out of development approximately 10 lots. As I understand the developer is in negotiations with the City where all of this would be fine as long as we entered into anon-development agreement. Consequently I have prepared about a week and a half ago anon- development agreement and sent it over to the City Attorney for his review. He and I visited on it today, he indicated that there were a couple of changes, they were all in the nature of typographical errors. There was no Exhibit A attached and we had Los Alamitos No. 1 instead of No. 2 and there was an s, something was in the plural when it shouldn't have been. Those changes have all been made and I have provided the City Attorney with the non-development agreement. It is the City's form non-development agreement, it says in essence that these identified 10 lots will not be developed without subsequent approval by the City Council. Otherwise the agreement is pretty self explanatory. Crookston: I have approved it Mr. Mayor. Kingsford: And of course the issue there is with regard to the number of lots that they could irrigate off the well, is that right. And then these exempted so that they couldn't go beyond that, am I on the right target with these? McCall: That was the reason why we opted to hold these 10 out because right now we are irrigating out of the well that has a certain capacity and based on the engineering study that we had indicated that if we brought on this entire phase it might be over taxing it. Kingsford: And that well is supposed to be monitored and so forth? McCall: That is correct. Kingsford: Does the Council have any other questions for Mr. McCall? Morrow. Gary Smith had some comments in his letter dated October 11, I think he had five issues. Are you satisfied Gary that those five issues were covered correctly? Smith: Mr. Mayor, Councilman Morrow, I believe that the plans have been revised and resubmitted let's see, October 27 the plans went back to Roylance with the, some red lines were not addressed, but they were being requested to be addressed. I don't know whether • Meridian City Council November 8, 1995 Page 18 those have come back or not, have they? We were interested in getting some proof that the pressurized irrigation was being turned over to the homeowners or Nampa Meridian Irrigation District. We did obtain a recorded copy of the covenants and the covenants speak to it being operated by the declarant or the homeowners association. I don't know whether my assistant has had any conversation with Marty or Brian concerning a clarification of that or not. McCall: While the project is being developed we anticipate that we'd have to develop the irrigation system, it is a fairly complex irrigation system involving two different wells and two different sources of surface water when it is completely developed then the CC&R's indicate it will be turned over to either the homeowners association or Nampa Meridian Irrigation District. Smith: The record copy that we have doesn't discuss the Nampa Meridian unless there has been a revision to that CC&R, it just talks about the declarant or the homeowners association. The declarant I guess that is the developer/subdivider. McCall: That is correct, I thought we had, the final draft was in the alternative when the CC&R's for the next phase come in we can certainly make that, I think the developer would like to have that option of if the homeowners association doesn't want it then we want to give it to the Nampa Meridian Irrigation District. Smith: That is fine, the Public Works Department doesn't have a problem with that. As long as it is of record that is what is going to happen. The copy that we have, the recorded copy that we have is I guess the No. 1 subdivision has been recorded. McCall: We have now filed of record supplemental declarations for phase 2. Smith: Does that speak to Nampa Meridian then for the homeowners? McCall: No, I don't believe it does because I thought that phase 1, I am sorry, I don't have a copy of those in front of me but if my memory serves me correctly we have, this issue came up originally the pressurized irrigation system was going to be maintained by the declarant and then we decided that probably wasn't in everybody's best interest so we did make the change. The exact language I am not sure of, we ran it by City Council at some point. Smith: Well, I guess we need that clarified because we just received, we obtained a copy from the Recorders office just this week and it speaks only to the declarant or homeowners association in that pressurized irrigation section. The other thing that we talked about in our transmittal back to Roylance and a copy of this went to Marty also was a City Council • Meridian City Council November 8, 1995 Page 19 approval of anon-development agreement. The Corps of Engineers approval of the Nine Mile Drain water and sewer crossing and an approved license agreement with Nampa Meridian for the water and sewer and pressurized irrigation crossings. I believe Marty indicated to me tonight the Corps of Engineers agreement has come back to him for the Nine Mile Creek pipe. Goldsmith: I do have the Army Corps of Engineers application and it has been approved by the Army Corps of Engineers. The Nampa Meridian Irrigation District we have an easement in place there to wrork on the crossing right there. Smith: Is there a crossing agreement that has been approved? Goldsmith: Yes sir. Smith: There is a crossing agreement for that pressurized irrigation line? Goldsmith: Yes sir. Kingsford: We need to have a copy of those Marty. Goldsmith: I have sent those over, and Ridc Clinton does have those. He also has the copies of Los Alamitos No. 1 and 2 phases CC&R's that talk directly to the homeowners or the Nampa Meridian Irrigation District owning the pressurized irrigation. Smith: Well, we did not have a copy of that Marty and we had to go to the Ada County Recorders and obtain a recorded copy to make sure we have something of record. That is what we have. Goldsmith: I spoke to Shari and she brought me in on it that Rick had pulled a copy of Salmon Rapids No. 1, they do talk about the declarant, we are going to change that and would like to go on record as stating that we are going to change Salmon Rapids, but that Los Alamitos No. 1 and No. 2 you do have current copies of the CC&R's that are recorded and those copies talk about Nampa Meridian Irrigation District or the homeowners. So prior to us or prior to the City accepting the non-development agreement I v~uld think that would be a condition if you can do that for us is that we will meet Gary Smith's requirements. Smith: We will need a copy of that in hand, the recorded copies from the Recorders office and the other thing is has there been anon-development agreement submitted to us?
