BENTLEY P & Z COMMISSION JIM JOHNSON, Chairman TIM HEPPER JIM SHEARER GREG OSLUND MALCOLM MACCOY February 13, 1997 I have reviewed this submittal and offer the following comments, for your information and consideration as Conditions of the Applicant for final plat approval: GENERAL COMMENT 1. Any existing irrigation/drainage ditches crossing the property to be included in this project, shall be tiled per City Ordinance 11-9-605.M. Plans will need to be approved by the appropriate irrigation/drainage district, or lateral users association, with written confirmation of said approval submitted to the Public Works Department. 2. Any existing domestic wells and/or septic systems within this project will have to be removed from their domestic service per City Ordinance Section 5-7-517. Wells may be used for non-domestic purposes such as landscape irrigation. 3. Determine the seasonal high groundwater elevation, and submit a profile of the subsurface soil conditions, as prepared by a soil scientist, with street development plans. 4. Provide a statement as to whether the pressurized irrigation system in this development is to be owned and maintained by the irrigation district or the Homeowners Association. 5. Submit letter from the entity having jurisdiction over design and construction of the pressurized imgation system. A letter of credit, cash, or appropriate bonding will be required for these improvements prior to signature on the final plat. C: \OFFICEI W P W EV\GENERAL\I.OSALpIy3. Indicate on the final plat map any FEMA Flood Plains affecting the area being platted, and detail plans for reducing or eliminating the boundary. 7. Submit to the Public Works Department verification that the net square footage of all lots meets or exceeds the minimum 8000 square feet required in an R-4 Zone. The net square footage shall be determined exclusive of streets, highways, alleys, roads, rights-of--way, imgation easements and land which is used for the conveyance of irrigation water, drainage water, creek or river flows. Pleas address in writing, all items contained in this memorandum, both General and Site Specific, and submit to the City Clerk's office before the February 18, 1.997 meeting of the Meridian City Council. Prior to development plan approval, 3 copies of the revised plat must be reviewed by the Public Works Department for compliance with the conditions of plat approval. SITE SPECIFIC COMMENTS 1. This final plat generally conforms to the approved preliminary plat. 2. Please submit a copy of the Ada County Street Name Committee's approval letter for the Subdivision name, lot and block numbering, and street names. Make any corrections necessary to conform. 3. Permanent perimeter fencing is required to be in place along the exterior subdivision boundary and along both sides of the Hunter Lateral easement/lot line. The exterior subdivision boundary fencing along the Ridenbaugh Canal shall be of anon-combustible type. All fencing is to be in place prior to obtaining building permits. A letter of credit, cash, or appropriate bonding will be required for these fence, items prior to signature on the final plat. 4. Call out on the plat the existing 40 foot wide easement for the Hunter Lateral. The boundary lines of the lots adjacent to the Hunter Lateral shall be adjusted out to the existing easement line, unless Nampa & Meridian grants an encroachment agreement for the area within their easement. 5. Is Nampa & Meridian rec~tive to the idea of them taking ownership and maintenance of the lots created for the Hunter Lateral and Ridenbaugh Canal?. How are these lots going to be improved (IE.. Compacted gravel surface...etc.)? A:\L.OSAI,AM3.FP Mayor and City Council February 13, 1997 Page 3 L_J 6. Add an arrow symbol to the plat legend that depicts front of house orientation. Place arrow symbol on Lot 26, Block 6 towards S. Black Beauty Wy., and on Lot 1, Block 8 towards S. Gold Bar Wy., and on Lots 10 & 12, Block 8 towards E. Seattle Slew St., and on Lot 4, Block 9 towards E. Triple Plum Dr., and on Lot 1, Block 9 towards S. Red Cloud Ave. 7. Lot 6, Block 9 doesn't meet the minimum 80 foot frontage required in an R-4 zone. 8. Developer shall construct the pedestrian path on Lot 5, Block 9. Path shall be fenced on both sides with removable bollards placed on the southerly end along E. Triple Plum Drive. The above improvements are to be in place prior to obtaining building permits. A letter of credit, cash, or appropriate bonding will be required for these items prior to signature on the final plat. 9. All street signs, road base, pressurized irrigation system, domestic water system (activated fire hydrants), and the items mentioned in the above Site Specific Comment No. 3 & 8 are to be installed prior to obtaining building permits. 10. Correct the subdivision boundary line bearing/distance error between the face of the plat and the second page legal description. The discrepancy is in the 4th line of the legal description body (S 40°22'33" W, 174.04') and the corresponding line on the face of the plat (S 40°23' 15" W, 174,00'). 11. Why are some of the corners cut off on a 45 ° angle, and some have 20' radius curves? 12. Add or revise the following note(s); (2.) Building setbacks and dimensional standards in this subdivision shall be in compliance with the applicable zoning regulations of the City of Meridian. (4.) The developerand/or owner shall corrcply with Idaho Code Section 31-3805 or its provisions that apply to irrigation rights. (9.) (Revise if necessary pending favorable review by the Nampa & Meridian Irrigation District per Site Specific Comment #5) (10.) (Revise if necessary pending encroachment agreement with Nampa & Meridian Imgation District per Site Specific Comment #4. ) (12.) (Submit Restrictive Covenants Addendum documents for review and approval by the City Attorney for the addition of this phase of the Los Alamitos Park Development) (13. } ...site (Lot 10, Block 9}. Plum Drive 60 feet? Was this required by the Ada County Highway District? Is this roadway going to have a collector status?, if so, isn't there a restriction on direct lot access? 14. Remove the temporary turnaround shown on the east end of E. Triple Plum Dr. John Priester, the Ada County Surveyor, has recently indicated that it is not desirable to show these temporary turnarounds on the plats, because it is then a dedicated public right-of- way that must later be vacated. Mr. Priester stated that the best solution to this problem is to record an instrument, either prior to or after plat recordation, providing an easement for ,this purpose. The document would have a provision that the easement would automatically be rescinded once the streets are able to go through. 15. Revise the plat as necessary to the provide for tangent curves on the right-of--ways and centerline of S. Black Beauty Way and E. Party Jet Street. We do realize that the minimum centerline radius at this corner is 100 feet per Ada County Highway District's design criteria, however we do not feel that designing the streets with curves that are non- tangent, because of having to "fit" the minimum 100 foot radius, is a good sound design alternative. There appears to be a couple of alternatives that would facilitate the design change: (1) Seek a variance from the Ada County Highway District for a centerline radius less than the prescribed 100 feet. (2) Seek enough area in the Hunter Lateral Encroachment Agreement with the Nampa 8c Meridian Irrigation District to allow for the extra area that would be required to fit the 100 foot radius (tangent) curve. Under this alternative, the square footage of the lots can be calculated including the area within the encroachment since it is usable to the property owner. A:\LOSALAM3.FP
