Since there appears to be some question as'to our position on additional connections to the sewer system, vve would like to clarify the matter at this time. Apparently, our department has no jurisdiction on subdivisions or land within the City t•;hich eras platted prior ~o Jerry Yoder's letter of P-lay 2, 1973; consequently these subdivisions may ~e,_ con- nected to the sanitary se~•aer if the City of P•Ieridian has no objections. However, we mould like to point out that Meridian could violate its NPDES discharge permit if it continues to allow additional connections to the sever system, and that once such violations occur, bringing ' the sewage treatment plant effluent back into compliance frith the permit might be difficult, l~le would also point out that your letter • of January 9, 1975 concerning a certificate of adequacy for the ,~;-.`-;' Meridian ser~age treatment system stated that additional connections f= `~ to the sewer system ti;rould not be allowed. Rased on this letter we ~1' a=, r } concluded that the proposed improvements to the water system would have little impact on the A~eridian ser~age treatment system. If `~ additional connections to the seti•rer system are allowed, ~~:° will have ~_ ~ ~ ' to reevaluate our statement concerning the certificate of adequacy. The original owner is Wood, Roy C. & Emma Lucille. Tine parts were sold to Gem Estates Incorporated. Gem Estates Incorporated sold part to the City of Meridian far roads. MERIDIAN, IDAHO 83642 AREA CODE 208 March 3, 1980 T0: Mayor and City Councilmen City of Meridian RE: Dave Reeves and Gem Estates Council- Actions: April 14, 1975 - Gem Estates was approved by Planning & Zoning and City Council for multifamily 19 lots as originally presented--two story. May 19 , 19 7 5 - City Council accepted the plans and specifications of .Gem Estates, including drawings, development plans, .street plan, profile and storm details, standard details sewer plan, profile and plat. August 14,,1975 - Council accepted Dowdle`s proposal not to plat at the present time and there. were to be four ownerships until platted. Dowdle agreed to plat when required to do so (.Dowdle letter, .December 28, 1-979) . 1. The first item to consider is a difference between construction and the plans of Gem Estates. It appears. that the City Council had before it on. May 19, 1975, the "Ultimate Development Plan" of Gem Estates, when it approved Gem Estates, It does not appear, however, that a .copy of the. development plan was maintained in the files or forwarded to Vern Schoen.. Therefore,' the City had no way of knowing .construction had not been in conformance with the development plan, Mayor and City Councilmen March 3, 1980 Page Two The discrepancy between the development plan .and the actual construction, as concerns Mr. Reeves, is that the driveway for the fourplex on the corner of Pine and .7th Streets was flip-flopped. In other words, the plans show the driveway on the south side of the unit whereas the drive- way is on the north side as actually constructed. .This is an unusual situation, in that normally exact layouts of where buildings and driveways are to be placed on lots are not submitted for approval. Ordinarily such minor details of subdividing are .left to the desires of the developer, builder, or lot purchaser, and. are not "set in concrete" by the approval of the City Co uncil. If the developer of Gem Estates had, at. the time of construction, approached the Council requesting the flip-flop, it could have been summarily granted. .Therefore, as to the difference in construction and the plans, it is my recommendation that the City Council, on their own motion, approve the plans as they pertain to the fourplex unit of Gem Estates on the corner of Pine 'and 7th Streets, as actually constructed.' 2. The second item to consider is the platting of Gem Estates. At the Council meeting of August 14, 1975, Jack Dowdle, the developer of Gem Estates, requested that he not be required to plat the subdivision at that time. Both the City ordinances and the State statutes required that the subdivision be platted. Mr. Dowdle did agree and apparently presently agrees to plat the subdivision.
