Idaho Ave. Meridian, Idaho 83642 RE: TlrnberfallsSubdivision Variance Request-Letterof Inteait Dear Mayor and Council; As representative for Dan Wood, please accept this application for a variance within the proposed Timberfalls Subdivision, located on the south side of E. Usdck Road, west of Locust Grove Road in Meridian, Idaho, Section 06, Township 3 North, Range 1 East of the Boise-Meridian. The request is for a variance to Section 12-4-5 of the Meridian Subdivision Ordinance requiring that blocks shall not be less than five hundred feet (500') nor more than one thousand feet (1,000') in length. This letter is included with the application for the variance, together with Sling fees in the sum of $310.00 and various exhibits. The applicant is requesting the variance to Section 12-4-5 to allow Block 2 of the preliminary plat to exceed the one thousand feet (1,000') maximum block length requirement, and 131ock 1 to be less than the five hundred feet (500') m;rrirm,m block length requirement. The hardship that exists with this properly that would enable the applicant from complying with the requirements in the Ordinance is a result of the design of the development with relationship to existing natural topographic constraints, and previously approved developments on adjacent property. Block 2 is located along Ustick Road and is bordered by an existing stub street from the Granite Creek Subdivision to the east and main entrance into TimLberfalls. With the future park azea designed in a central location and because of the existing slob street location, the breslang up of this block with a street is not practical with this design. Block 1 has the same constraint that is a result of the existing stub street from Bedford Place Subdivision to the west and the proposed entrance road to Timberfalls. As a result, Block 1 cannot meet the current minimum 500 fi;et requirement. With the above described constraints, only with a major rede~gn would this subdivision be able to meet the requirement of Section 12-4-5. It is the opinion of the applicant that the liters[ irtterpretation of the provisions of the ordinance would deprive the applicant rights because the development of the property would be difficult if no flexibility on block lengths were allowed. An applicant has a right to expect that arty and all required improvemerrts associated with a development request will benefit the public health, safety, or welfare. That right would be wmpromised by a literal interpr~ation of the law. Additionally, the wnditions that exist adjacent to and in the area of the property are not all necessarily conditions that exist as a result of the applicant's own actions. Further, granting the variance wo~ sin rights, which would be afforded, to others in the same situation. Matry previous subdivisions in the city have been granted similar variance requests with similar circumstances that exist on this property. The variance would convenience the applicant, but to provide for the same ability to develop the land with the specified limitations that other property owners in the district could achieve without such variances. The variance would not constitute any special privilege for the property owner that could not be sought by owners of other land. The granting of the requested variance will not be detiimemal to the Public's welfare or injuripus to other property in the area of the proposed plat. ff approved, the granting of the variance would not be in conflict with the inter of the Meridian Comprehensive Plan, which recognizes, among other things, that certain circumstances exist, and that land development regulations shall be revised from time to time. Therefore, we would request at this time approval of the above described variances to the Meridian Zoning Ordinance as it relates to the Timberfatls Subdivision applications currently being processed by your staff.
