I have made a redline change to make clear that the pathway will satisfy both the Pathways Plan requirement and the road pathway/sidewalk requirement. Please let me know if you have any further concerns. Otherwise, we will go with the proposed language as agreed in the attached clean version file. Would it be possible for you to forward this for Council consideration or do we need to forward this ourselves? David 1 /7/2008 Kleiner DA Terms Clarification and Request Requested clarification: 1. Agricultural use, including production of crops, shall continue to be allowed after annexation as an urban farm use, which is a principal permitted use under 11-4-3-28 and 11-2B-2. See below for requested terms regarding pathway requirement. This is requested so that Owner will construct two north-south pathways, instead of three north-south pathways for the West Parcel. One pathway will be constructed along Eagle Road and a second pathway between 1 /8 and '/ mile west of Eagle Road. 2. Pathway requirement for West Parcel: Owner shall provide a second pathway running generally north-south from Fairview Avenue to River Valley Road in addition to the 10' multi-use pathway along Eagle Road. Owner shall not be required to construct a third north-south pathway for the West Parcel. This second pathway shall serve as the multi-use pathway required by the Pathways Plan and shall be generally situated in the western one half of the West Parcel, from the general vicinity of the 1/8 mile line west of Eagle Road, with allowance made for the final location of the 1/8 mile access on Fairview Avenue, to the west boundary at roughly '/o mile from Eagle Road.. The pathway may run separate from or in connection with a drive aisle or road; and will satisfy both the Pathways Plan requirement and the road sidewalk/pathway requirement if it is run in connection with the road. The pathway may be constructed as a detached 5' sidewalk with 5' landscape strip or as a 10' multi-use pathway.
