The City of M`eridian's interest- in road right of way width is based on the ACHD being able "to provide an .:adequate width of future travel w,ay without disrupting adjacent property owners. We have been consistent in our request for 40'feet of road right of way, each side of center line. for a 'section lin e road, however, we have also been in:a transition zone working with the ACRD for them to requare this; right- of way width. It is my understanding the ACHD now recognizes the importance of preserving a right of way for future use and is now requiring a Enclosed is a copy of my review comments for the preliminary plat of this project and.. for the final plat of `'Phase No. 1. Please note in both instances a 40 foot right of way request for this roadway was made by me. minimum of 40 feet each side of center line for section line roads. Since the ACHD previously required 33 feet of right of way from centerline for this section of roadway and I approved and signed the plat for Unit No. 1 showing only 33 feet, I will withdraw my request for 40 feet of right of way on Unit No. 2 of Maws Addition. Gary Lee, JUB Engineers, representing the developer for Properties West. Tract Subdivision #3 of course is the third phase of the preliminary plat that was approved about a year ago on this project. There are some differences however from the original preliminary plat. We've combined what was identified as Phase three and four on the approved preliminary plat. The reason for doing that was 1) we wanted to make that street connection at Lark Avenue, Meridian Place #3 has been completed so now we can tie our traffic flow into that street and have our second access; 2) The second reason for the combinations of the subdivision is that the project is going fairly well and phase four was fairly small in numbers of units so the developer felt that it would be better to combine the two of them at this time and make it one plat. So the plat you see before you consists of 64 lots for combined phases three and four. Another point of interest, the marketing team has convinced the developer to go with a few larger lots in this phase and we have reduced the number from the original approved preliminary plat. We are taking out five lots in this general area than what was originally presented to the Council. It's been reduced in number and so of course the density has gone down some. If you have any questions I'd be happy to answer them at this time. Giesler: Have you seen the comments from the City Engineer? Lee: I have reviewed those comments today and we will address the issues that he has brought up. This is the second phase of the Parkwood Meadows Subdivision and it contains 24 lots and is in compliance with all conditions of the preliminary plat approval. Currently working with the City Engineer to get our construction plans approved and start construction within the next month. We have read the Engineer's comments and will comply. Hunemiller: I have not. - Corrie: Item #7 of Engineer's comments concerning house size, you wouldn't have a problem with this would you? Clerk Niemann: That's the way it is designated on the plat. Giesler: Gary has all the irrigation run-off problems out there been taken care of with the neighbors? Eng. Smith: I've been in contact with Mr. Hunemiller and he has posted a bond us to see that that work does get done. He has full intentions of completing the work your speaking of. Motion Carried: All Yea: ITEM #6: REVISED FINAL PLAT ON HAVEN COVE SUBDIVISION #1: Dave Collins, representing the developer of Haven Cove Subdivision. We have changed a couple of lots. Explained reasons for changes. The Motion was made by Yerrington and seconded by Giesler to approve final plat on Haven Cove Subdivision #1: Motion Carried: All Yea: ITEM #7: REQUEST BY REAL ESTATE GROUP FOR TEMPORARY SALES OFFICE AT GOLF VIEW ESTATES SUBDIVISION: Debbie Brown, Real Estate Group in Meridian, representing the developer. We are requesting permission to have a temporary sales office on site in the development until which time we complete our first home. We then would be using the garage area for the temporary sales office, we estimate .that to be no later than September 1st. Construction schedule is showing that we will be considerable sooner than that but not knowing what may come up with construction we wanted to give ourselves a little more lead time there. Tolsma: So your looking at about eight months. • i MERIDIAN CITY COUNCIL FEBRUARY 3, 1993 PAGE 5 phase and marketing has gone well on that phase and we proceeded with the second phase. We do have a problem with the right of way in the second phase - explained. 33 feet of right of way was what ACRD originally required. Clerk Niemann: How come we didn't require forty on the first phase? Eng. Smith: Typically what I had been requiring was the 33 foot of dedicated right of way and a seven foot future road right of way easement and the County Engineer recently has not allowed this seven foot easement to be placed on the plat and specifically called out as a future road right of way easement. As I understand it he won't sign the plat with that notation on it. My previous review of Maws #1 Subdivision included that seven foot easement but when the plat came back for signature it wasn't on there so it got signed as a 33 foot right of way. Highway District has swung over to our side on requiring 80 foot right of way on section line roads and I don't know what their comments were on this subdivision. The credit to the developer from ACRD had to do with whether or not the improvements were made on the roadway and whether that section of roadway was in their capital improvement plan. Tealy: Just as a matter of information they will pay for any right of way over 25 feet. We'll get paid back for the 8 feet that we are dedicating here so either they buy it now or they buy it later. As far as the impact fees being used for improvements both on Pine and Locust Grove, we've gotten a letter back since then and we've been quizzing them about this using the impact fee and they've put Locust Grove on their capital improvement program. We will be building all the improvements both on Pine and Locust.Grove but at least we'll get paid back for the ones on Locust Grove. Tolsma: This is just the 40 foot right of way on Locust Grove that they are requiring right now? Tealy: They are not requiring a 40 foot right of way on Locust Grove, they are requiring 33 feet. We haven't gotten comments back from th em for final plat but on their preliminary one they went through preliminary approval on this, they request ed the 33 feet on our s ide. The requirement of 40 feet was from the City of Meridian. Probably the best thin g to come up with a solution is for myself ' and/or Gary to meet with ACRD and come up with a solution.
