RE: Bonito Subdivision No.3 Lot 15 Water Service Line Easement Vacation
We are requesting vacation of the water service line easement, which is located on Lot 15 Block
Block 1, Bonito Subdivision No.3 as depicted in the attached exhibits. The vacation of the
easement is due to the relocation of the water service line for Lot 15. The water service line
required relocation and the easement vacated because of a change in the building footprint, which
placed the building foundation within the recorded water service line easement.
It is our understanding that there are no relinquishment letters required for this vacation because
the only entity with an interest in this easement is the City of Meridian Water Department.
A neighborhood meeting was held on December 19, 2006 for this easement vacation. Six people
attended the meeting however there were no particular comments or objections. The attendants
presumed that the meeting was regarding a proposed building on another lot within the
subdivision, which is unrelated to this application. See attached neighborhood meeting summary
notes dated December 20, 2006.

WATER LINE AND WATERMETER EASEMENT
THIS INDENTURE, made this -4 day of A4 , 2005, between William Dovid Eve and Caroline V.
Evans, husband and wife, the parties of the first part, and hereinafter called the Grantors, and the City of
Meridian, Ada County, Idaho, the party of the second part, and hereinafter called the Grantee;
WITNESSETH:
WHEREAS, the Grantors desire to provide a water main right-of-way across the::premises and
property hereinafter particularly bounded and describer!; and
WHEREAS, the water main is to be provided for through an undeiground pipeline to be constructed
by others; and
WHEREAS, it will be necessary to maintain, service and subsequently connect to said pipeline from
time:to time by the Grantees
NOW, THEREFORE, in consideration of the benefits to be received by the Grantors, and other good
and valuable, consideration, the Grantors do hereby give, grant and convey unto the Grantee the right-
of-way for an easement for the'construction, operation, maintenance, repair, replacement of a water
main over and across the following described property:

The easement hereby granted is for the purpose of construction and operation of a water line and their
allied facilities, togetherwith their maintenance, additional connection thereto, repair and replacement
at the convenience of the Grantee, with the free right of access:to such facilities at any and all times.
TO HAVE AND TO HOLD, the said eastdzia rand right-of-way unto the said Grantee, its successors
and assigns forever.
IT IS EXPRESSLY UNDERSTOOD AND AGREED, by and bctwt6n the parties hereto, that after
construction, making:repairs, performing other maintenance or making subsequent connection to the
water line, Grantee shall restoretherarea ofthe easement and 8tljACont property to that existent prior to
unddttaking such construction, repairs and maintenance; However, Grantee shall not be responsibli for
repairing, replacing or restoring anything placed within the area described in this easement that was
placed there in violation of this easement.
THE GRANTORS hereby covenant and agree that they will not place or allow to be placed any
permanent structures, trees, brush, or perennial shrubs or flowers within the area described for this
easement, which would interfere with the use of said easement, for the purposes stated herein.
THE GRANTORS Hereby covenant and agree with the Grantee that should any part of the right -of.
way and easement hereby granted shall become part of, or lie within the boundaries of any public
street, then, to such extent, such right-of-way and easement hereby granted which lies within such
boundary thereof or which is a part thereof, shall cease and become null and void and of no further
effect and shall be completely relinquished.

Notes from the neighborhood meeting held December 19, 2006
The meeting was held at 6:00 p.m. at the site. There were approximately six people who showed
up for the meeting. There was some confusion as to the purpose and location of the meeting.
They thought that the meeting was being held in regards to the building being constructed on lots
18 and 19 within the subdivision. Their concerns were mainly centered around that building
which has nothing to do with the easement vacation that the meeting was intended for. I
explained the purpose of the meeting to them and what we were proposing, which is merely the
vacation of an easement due to the relocation of a water service line. They didn't really have any
concerns specifically relating to the water service line easement. There questions were primarily
centered around whether the building would be two story and what was happening with the
building being constructed on lots 18 and 19. They also expressed concern that they had been
lied to by the developer and city in the past regarding issues with this subdivision. Consequently
they didn't seem to trust that the meeting was only about the easement vacation. I walked them
over to the lot in order to show them where the water service was and where the service would be
moved to. They also had questions about the building square footage and parking requirements
which I was unable to answer. However in the end they seemed to understand that the issues
they were brining up were unrelated to the purpose of the meeting. I talked with them some more
and indicated that there would also be a public hearing where they would be able to testify, or
that they were free to contact me at any time regarding the easement vacation. The meeting
lasted until approximately 6:30 p.m.
COMMITMENT OF PROPERTY POSTING
Per Unified Development Code (UDC) 11 -5A -5D, the applicant for all applications requiring a
public hearing (except for a UDC text amendment, a Comprehensive Plan text amendment
and/or vacations) shall post the subject property not less.,than ten (10) days prior to the hearing.
The applicant shall post a copy of the public hearing notice of the application(s) on the property
under consideration.
The applicant shall submit proof of property posting in the form of a notarized statement and a
photograph of the posting to the City no later than seven (7) days prior to the public hearing
attesting to where and when the sign(s) were posted. Unless such Certificate is received by the
required date, the hearing will be continued.
The sign(s) shall be removed no later than three (3) days after the end of the public hearing for
which the sign(s) had been posted.
I am aware of the above requirements and will comply with the posting requirements as stated in
UDC 11-5A-5.
