At the meeting on November 27~' Mr. Bird made a statement that" changing the color is
not going to make these people happy ." Mr. Zaremba stated that "as long as we are tied
to the 171 units we have little choice but to approve the project."
Both of these statements are true and are premised on the assumption that Mr. Nary's
opinion is the correct one . I am a bit surprised that no one questions this as it is in fact
one man's opinion .I am sure that Mr. Nary is a competent attorney ,well versed in the
laws regarding the city charter and the laws of the State of Idaho .
In recent events the Supreme Court overturned the Attorney General's opinion on the
Geneva convention .
Often the Supreme Court justices after hearing the same oral arguments ,reviewing the
legal briefs and reading the same sections of the Constitution ,come to the opposite
opinions as to its meaning .
If some of the best legal minds in the country ,with the best of intentions ,need the
majority rule (many are five to four) to determine the proper course ,would it not be
wise to get a second opinion ?
There are enough extenuating circumstances that everyone is familiar with to warrant a
second opinion .
The Councils decision in this matter will have a direct impact on hundreds of lives in this
community and can only be based on the best advice available .
