Caleb Hood Subject: Woodland Springs Thank you for the opportunity to comment on the staff report for the Wooldland Springs application. First of all, I wonder like to express my thanks to the staff in assisting us in making this application. They have always acted in a professional and helpful manner. They have done a great job of expressing to me the goals of the comprehensive plan , as well as other planning advice. This input has led to numerous chances in the concept plan with an end result of what I feel is a better development layout. I just have a couple of quick comments regarding the staff report: 1) Staff's recommendation of a map designation of Mixed Use Neighborhood and C-N Zone: We support this recommendation. The uses allowed in the C-N Zone conform with our anticipated users. And as a whole the CN Zone is a better neighbor in a residential area than the CC Zone. 2) Limiting the hours of operation from 6:00-11:00 p.m. We feel that this recommendation is valid for the buildings abutting the residential areas, however we would ask that the hours for the C-store would be determined later during the Conditional Use Permit process. Because of the layout of the development, distance from residential dwellings and being adjacent to the intersection of two arterial streets, we feel additional hours of operation are appropriate for the C-store. 3) Permitted uses for the 10,000-11,000 sq. ft. building. The staff reports mentions medical and other professional office uses. In additional to these uses we would like to have the possibility to have some retail. 4) Fencing. The staff report for the Planning Commission stated that I should enter into the public record that we will build a fence along the abutting residential properties. During the hearing (approximately 12:30 a.rn.) I stated that we would build a vinyl fence. Mistakenly, I said that the fence would be 8 ft high. Later in the meeting when I tried to correct the measurement to the standard Eft fence, the planning commission said that I already made a commitment. Since then I have tried several sources including Home Depot and Lowes to special order the 8ft fence, but have been informed that they do not sale fencing material taller than 6 ft. One problem with a 8 ft fence is increased chance of wind damage. I would ask that the City Council would allow a 6 ft high fence for the following reasons: a. The proposed zoning has been restricted to a zone that makes a better neighbor for residential uses, b. The site layout uses the buildings to buffer the adjacent neighbors from noise and headlights created by the commercial activities and the arterial street. c. The hours of operation for the buildings abutting the residential properties are restricted to 6:00 a.m. -11:00 p.m. d. The site would normally be required to have 34 perimeter trees, however because of mitigation of existing trees the required perimeter trees have been increased to 86 trees. The developer can work with the City Forester to use many of these trees to create an effective buff that is superior to an 8 ft high fence.
