(Application AZ 07-015 of Marshall Williams). We the undersigned residents of Dunwoody Subdivision strongly object to the annexation and zoning change for the property located at 1650 Dunwoody Court and to any further subdivision or easements of property thereon. The proposed zoning change is in violation of the Declaration of Covenants Conditions Restrictions and Easements for the Dunwoody Subdivision dated November 1, 1990,Section 5.13, Subdividing. The above noted CC and R's are a legal and binding contract agreed upon by the owner of said property at the time of.purchase. The City of Meridian should honor a legal and binding document and not permit this annexation and zoning change. In addition to the violation of the CC 8c R's as stated above, a change in zoning to R-2 from RUT would allow two to three homes to be built on that site which would be inconsistent with the existing neighborhood of single family homes on large parcels and would change the continuity of the Dunwoody Subdivision. This zoning change, if approved, would infringe upon the rights of current residents, who want to maintain the rural, country atmosphere to which we have become accustomed.
