Staff has reviewed this submittal and offers the following comments and conditions of the applicant:
APPLICATION SUMMARY & LOCATION
The applicant, Tuscany Development, Inc., has applied for a final plat modification to revise a portion of
the approved fencing plan and to remove the requirement to construct gates with attached trellis
structures located on the common areas in Messina Subdivision No. 1. The fencing proposed to not be
installed is located adjacent to the southern boundary of this phase of the subdivision; it is not on the
project perimeters (see Landscape Plan in Exhibit A). On the approved landscape plan the fencing is
shown as five-foot tall vinyl fence. The gates with attached trellis structures are amenities that were
approved at three-foot tall and proposed to be constructed of a vinyl material. Messina Meadows
Subdivision No. 1 is located west of Eagle Road, approximately % mile south of Victory Road in the SE
of T. 3N., R. lE., Section 29. The site has already been platted. The City Council approved the final
plat on February 7, 2006.
STAFF ANALYSIS & RECOMMENDATION
The applicant is requesting to remove the requirement to construct 5-foot tall vinyl fencing adjacent to
Lots 1 - 3 Block 13, Lots 1- 4, and 14 Block 14, Lots 2 - 5 Block 16, and Lots 2 -6 Block 17 . These lots
are interior lots of the subdivision and will be adjacent to future platted lots within future phases of
Messina Meadows. The applicant states that the interior fencing is a luxury and they cannot afford the
upgrade at this time. The UDC does not have a requirement to construct fencing adjacent to interior lot
lines. Further, staff believes that this internal fencing brings no substantial value to the project.
Therefore, staff supports the request to remove the requirement to construct the fencing adjacent
to Lots 1 - 3 Block 13, Lots 1- 4, and 14 Block 14, Lots 2 - 5 Block 16, and Lots 2 -6 Block 17.
The applicant is also proposing to revise the approved landscape plan to remove the requirement to
construct three-foot tall gates with trellis structures on common area Lots 1, 24, and 59, Block 4 and Lots
1, 27, and 53, Block 5 (see Exhibit A for locations). Instead, the applicant is proposing to construct
attractive mailbox structures, which will replace the three-foot tall gates with trellises as an amenity. The
mailbox structures will be constructed out of decorative stone, stucco around the mailboxes, an asphalt
shingle roof with an exposed truss, and a bench as shown. The trash receptacle shown will not be
constructed with the mailbox structures (see Exhibit B). Staff believes these mailbox structures will
create an attractive and functional amenity for the residents. Therefore, Staff supports the request to
replace the requirement of constructing three-foot tall gates with trellis structures, with mailbox
structures that are identical to the ones in Exhibit B.
Staff recommends that the Council approve the applicant's request to modify the approved landscape
plan and fencing for Messina Meadows Subdivision No. 1 (MFP-07-006), as proposed by the
applicant and conditioned by Staff above.
