The City of Meridian Planning and Zoning Staff has sent me copies of their report for our
project and (for the record) I would like to comment regarding the letter of October 24,
2007 that the City of Eagle sent to the City of Meridian, Pete Friedman.
On page 2 the letter states "At this point the City of Eagle is less than 4,000 feet from the
site requiring the annexation of less than 5 parcels to be come contiguous." I believe that
the "4,000 feet" is a typo for the following reasons:
On November 13, 2006 (almost a year ago), I attended a Eagle Sewer District, Regular
Monthly Meeting and was given permission to testify as to where our land was located to
determine the feasibility of the City of Eagle servicing our area. Lynn Moser told me that
he would have to initiate a study to determine the cost and also the timing of providing
services to us.
The first part of December (slides are dated December 4, 2006) Lynn Moser met with the
City of Eagle Mayor, plus others and presented the slides. The slides indicate that it is
14,900 LF of Force Main to provide services to our area.
I called Lynn Moser this morning to see if construction of a sewer line had been built
since our meeting with him last year, and he assured me that they are no closer than they
were last year. He sent me copies of his slides again.
This is not mentioned in the City of Eagle's letter, but Lynn Moser's slides also indicate
that the cost to serve our area was estimated at $2,733,000 compared to the City of
Meridian's cost of $525,000.
If you would like to have a copy of the slides that I have referenced in this letter, I would
be happy to provide them to you.

Project: Phyllis Canal Project
Location, size of property and existing zoning: The subject area is located north of the Phyllis Canal and south of the
Boise River, from Linder Road to approximately %a mile west of Black Cat Road. The property consists of 645 acres and is
currently zoned RUT in Ada County.
Adjacent Land Use and Zoning:
I. North: Rural residential/agricultural properties, zoned RUT (Ada County)
2. South: Rural residential/agricultural properties, zoned RUT (Ada County); Spurwing Subdivision, zoned R-8;
approved Jayker Subdivision, zoned R-2, R-8, R-15, C-N, & C-C
3. West: Rural residential/agricultural properties, zoned RUT (Ada County)
4. East: Rural residential/agricultural properties, zoned RUT (Ada County)
Applications:
• CPA-07-010
Request to amend the Comprehensive Plan Future Land Use Map to include the subject property within the
Area of City Impact with a River Residential future land use designation.
• CPA-07-015
Request to amend the Text of the Comprehensive Plan to create a new land use designation (River Residential)
for the subject area that would include common area/open space, low -density residential, medium low -density
residential, and medium -density residential uses with an anticipated average density of 3 dwelling units per
acre.
Summary of Proposed Streets and/or Access: The Applicant states that access can be provided to this area from the east:
Duck Alley connecting to Linder Road; from the south: Basco Lane connecting to Chinden, Black Cat connectin to
Chinden and possibly Highway 16; and from the west: possibly Palmer Road. g
Existing Constraints and Opportunities:
Public Works:
Location of sewer: The Public Works Department is confident that all necessary services can be provided to
this area based upon the proposed densities and projected population.
Location of water: Water will be served by United Water.
The City of Meridian's FEMA (Federal Emergency Management Administration) mapping shows the northern
portion of the subject property along the Boise River as being in the AE flood zone and also within the floodwa
the central portion of the property is within the AE flood zone but is not in the floodway; and the southern o
along the Phyllis Canal is in the X5 flood zone and is also not in the floodway. Per City of Meridian resolution,y,

Staff Recommendation: Staff recommends that the Commission and Council carefullyconsider
determine if approval of the proposed CPA's is in the best interest of the City. If the Commis

RE: North Phyllis Canal Project — Comprehensive Plan Text Amendment
(CPA-07-015)
Staff is requesting that the City Council consider refunding the application fees that the
applicant, Sherrie Ewing, paid for the Comprehensive Plan Text Amendment for the
North Phyllis Canal Project. The reason for the request is that Staff advised the applicant
to apply for a text amendment when a map amendment would have been sufficient to
accomplish the applicant's purpose. Staff did not spend a substantial amount of time
reviewing the text amendment request and the noticing fees only amounted to $5.88. The
applicant originally paid $606.00 in application fees for the text amendment. Staff is
requesting that the applicant receive a refund of $600.12, the amount paid less the
noticing fees.
