5. We are unable to comply with Ordinance Title 12-3-8 requiring the
filing of a subdivision plat within 12 months.
6. The owners of this development, Bob Angell and Larry Stevens
contracted with Thomas Development Company to process, obtain
and fulfill all of the City of Meridian requirements associated with the
Conditional Use Permit and re-subdividing the land in accordance
with the City of Meridian requirements. Thomas Development
received a Conditional Use Permit with conditions on January 15,
2002 with a timeframe of 18 months (July 15, 2003) that all
conditions are met and actual construction has begun. At the time of
the Conditional Use Permit approval the City of Meridian approved
the subdivision prelimary/final plat application and by this
requirement the owners had 12 months to record the subdivision plat,
on January 15, 2003, which was not a requirement in the Conditional
Use permit by the City of Meridian.
In mid-December of 2002, the Tramore ownership requested that IC3,
Inc. take over the role of Thomas Development related to Conditional
Use permit requirements, recording of the subdivision plat and all
other public agency requirements needed to construct this project. By
oversight and the rapid transfer of information, IC3, Inc. was not
aware of the subdivision application deadline of January 15, 2003. As
of this writing, IC3, Inc. has obtained a building permit with all
necessary approvals from the City of Meridian, approval of the Idaho
Department of Environmental Quality and has submitted the
subdivision plat complete and ready for signatures by the City of
Meridian. The only outstanding signatures that are required prior to
recording the plat is the Ada County Treasurer and the Ada County
Surveyors approval, which cannot be granted until the City of
Meridian has approved and signed off on the plat. It is anticipated
that other signatures and recordation will require approximately 45
days to be obtained and we are respectfully requesting that we receive
a 60-day time extension beyond the March 11, 2003 hearing on this
matter which would extend the process from January 15, 2003 to May
10, 2003.

8. Extreme difficulty and hardship will result if the subdivision process
has to begin anew, and nothing will be gained by the delay. In fact, a
delay may result in the abandonment of the project. As it now stands,
the financing is in place, the general contractor is ready to build, and,
with the exception of this item, all requirements of the City of
Meridian, Idaho Department of Environmental Quality, Ada County
Highway District, and Central District Health Department are met. If
the owner is forced to begin this process again, the resulting delays
would not benefit the City of Meridian, or it's citizens. The property
will sit vacant, providing neither housing nor the increased tax base
the Senior Community would provide.

12. As noted in Item 6, the owners contracted in good faith with Thomas
Development Company to have their application processed. As soon
as they began to have doubts about this arrangement, they hired IC3,
Inc. to get the project back on track.
13. The granting of an extension will not confer any special privilege on
the applicant. They are not requesting any variance in zoning, use, or
other change that would be construed as conferring a special privilege.
14 Granting of this extension will make it possible for the applicant to
proceed with a project which will benefit not only the
applicant/owner, but the City of Meridian and it's citizens.
15. The project complies with the Meridian Comprehensive Plan. Our
request is for a time extension on plat filing only.
