We could not locate the condition that "Full" landscaping design of the site common areas was required in those approvals. The development agreement condition #5.1.8 requires the street buffers and land use buffers be constructed and we have presented our Pine Street landscape design and perimeter fence around the entire property in compliance with that condition. We have progressed our design with this project's new ownership, design and engineering team to this point under the previous approvals of AZ-OS-013, PP-06-011, CUP-06-006 and PS-06-005. Our landscape architect team has been the same and in talking wit Eric Jensen, there is only minor additions to the project from what was originally proposed. Several of these additions have already been presented to and accepted by Caleb Hood, so our design maturity has been meeting with acceptance of the planning staff. It is impractical to suggest that the project's interior 'common area' landscaping and improvements be done when there are no houses built and massive construction activities yet to come. Trees and shrubs and play equipment will have to be projected white we build the project they serve around it. Why build paths and common areas for the project use when there is no one to use them? We have presented to Meridian engineering our first phase engineering to build the roads and utilities. We cannot get engineering to start review and approval of the roads/utilities til we submit the plat. We cannot file for building permit until we have final constructed sign-off on these improvements. A vicious circle indeed. We recognize Meridian's position to seek assurance from developers than the improvements they say they will construct are actually constructed. As we discussed last week, out first building permit application will ore than likely be for as many as 60-residential units and the clubhouse. We ask that you allow the plat to be heard and make a condition that the common area landscaping and improvements be made part of the first building permit application and not the division of land. The land will be improved with the buildings and we believe tying these together is the more appropriate solution. If necessary, we are willing to meet with you and discuss this process. Unfortunately time seems to be ticking away and we may have already lost our fall site work window. Please call to discuss if this email does not allow us to be heard without full landscape plans.
