We have reviewed this submittal and offer the following comments, as conditions of the applicant. These cnuditions shall be rnnsidered in full, unless expressly modified or deleted by motion of the Meridian City Council: APPLICATION SUNIINARY & LOCATION The Applicant, Capital Development, Inc., proposes to convert one bay of an existing, attached, three car garage to a temporary sales office use in Baldwin Park Subdivision No. 1. The office will have two to four staff members on site for seven days a week, 12:OOpm to 6:OOpm. No specific time period was proposed in the application. A copy of the building elevation and floor plan was included in the application. The bay that would be utilized as the sales office is shown with a single man-door and two sets of multi-pane windows. The other two bays are proposed to have a standard, double overhead door. The remainder of the dwelling unit floorplan is shown to be a standard single family layout. The lot (Lot 2, Block 5) is zoned R-8 and is located just east of Baldwin Park Subdivision's primary entrance off of N. Linder Road. Title 11, Chapter 8 of the Meridian City Code (Schedule of Use Control) prohibits Professional and Sales Office uses is the R-8 district. Temporary buildings are allowed as conditional uses in the R-8 district. Unless a Planned Development specifically proposes a sales office as part of the application, the MCC does not permit these uses outright. The City has allowed sales office uses that are restricted to the sale of residential lots and/or dwelling units within the subdivision for which the sales are intended. For example, Ashford Greens, Heritage Commons and Touchmark are recent examples that have been allowed a temporary sales office that is associated with sales for those developments. Baldwin Park Subdivision was a straight plat - not a Planned Development. Therefore, staff required a MI application be submitted for the otherwise prohibited or conditional use. OWNER OF RECORD The subject lot is owned by Todd Campbell Construction & Development Co., LLC our of Boise, Idaho. The owner has submitted notarized consent for Capital Development to submit the application. MI-03-002 Baldwin Pazk Tanyrorary Office Mayor and Council March 13, 2003 Page 2 SITE SPECIFIC REQUIREMENTS If City Council recommends approval of the temporary sales office use, Staff recommends the following conditions be placed upon the application: a. The subdivision is permitted to have no more than one temporary use b. The front yard shall be 1>tr-dscaped and imgated prior to occupancy. c. The applicant shall be responsible for providing adequate off street parking for the employees. d. One wall sign is allowed for the temporary sales office. The sign shall be limited in size to 18% of the wall area. No other signs shall be permitted. e. Sanitary sewer service and domestic water service shall be hooked-up for the proposed use. An assessmern for sewer and water service will be determined during the building permit application process. f. The timeframe for the sales and information use is for a period of 24 months. If the Applicant requires an extension of this permitted period, Staff recommends they submit a status of their plans to the P&Z Department after 24 mornhs of operation (starting from date of occupancy). City Council must approve of any time extension beyond 30 months. MI-03-002 Baldwin Park Te~oruy Onice
