Dear Brad,
It has come to our attention that the Meridian City Council did not require the extension of Teare
Avenue with the Fairview Lakes planned development. However, on July 10, 2002, the ACHD
Commission approved the planned development, as proposed, that included extending Teare Avenue
to Fairview Avenue. In addition, the applicant requested approval to construct a traffic signal at the
proposed main entrance on Fairview Avenue. The ideal signal location in this area is at Jericho
Street, but because the applicant was proposing to extend Teare Avenue into the site, ACHD agreed
to allow the signal in the proposed location because it would still provide signalized access to the
residential properties located north of this development.
If Teare Avenue is not going to be extended, the applicant will need to provide a revised site plan to
ACHD, and the Commissioners will have to review the extension of Teare Avenue, as well as the
location of the proposed traffic signal. It is unlikely that staff will support a traffic signal that serves a
single development, and does not provide neighborhood connectivity.
I understand that the applicant has submitted a preliminary plat for approval. I would request that the
City of Meridian delay any further action regarding this plat until the Teare Avenue matter has been
resolved.

We have reviewed the above referenced submittals and offer the following comments, as
conditions of approval. These conditions shall be considered in full, unless expressly
modified or deleted by motion of the Meridian City Council:
APPLICATION SUMMARY
The applicant, Tamura and Associates, has applied for Preliminary Plat approval of a seven (7)
lot commercial subdivision on 14.31 acres of land, located on the north side of Fairview
A venue, approximately [/2 a milewest of Locust Grove.
The City of Meridian recently approved a planned development on this piece of land (Fairview
Lakes) that consists of a mix of commercial and high density residential uses. The proposed
preliminary plat is a subdivision of all of the commercially zoned land within the planned
development.
LOCATION
The property is located on the north side of Fairview approximately a V,mile west of Locust
Grove Road.
SURROUNDING PROPERTIES
North: The Willows Subdivision, zoned R-8.
South: Commercial property, zoned CoG and R-8 (a car lot).
East: Settlers Village and a car wash, zoned CG and R-8.
West: A mobile home park and commercial property, zoned R-8 and C-G

PRELIMINARY PLAT FINDINGS AND REQUIREMENTS
Sections 12-3-3 J.2 and 12-3-5 D read as follows: "In determining the acceptance of a proposed
subdivision, the Commission/Council shall consider the objectives of.this title and at least the
following:
a. The conformance of the subdivision with the Comprehensive Development Plan;
Staff finds the subdivision to be in conformance with the City's adopted Comprehensive
Plan. The Future Land Use Map depicts the property as "Mixed Use Regional" which
allows for the commercial uses proposed within the subdivision.
b. The availability of public services to accommodate the proposed development;
Staff finds that public services are available to accommodate the proposed development.
c. The continuity of the proposed development with the capital improvement
program;
Staff fmds that the subdivision will not require the expenditure of capital improvement
funds.
d. The public financial capability of supporting services for the proposed
development;
Staff finds that the development will not require mllJor expenditures for providing
supporting services.
e. The other health, safety or environmental problems that may be brought to the
Commission's attention.
Staff fmds that there should not be any other health, safety or environmental problems
associated with this subdivision that may be brought to the Councilor Commission's
attention.
ADDITIONAL CONSIDERATIONS
The Development Agreement signed prior to the City's annexation of this parcel of land
included a requirement to place bollards across the south end of Teare A venue to prevent
vehicular traffic from entering or exiting the existing Settlers Village Subdivision (pg 8 F.2.).
The decision to bollard the Teare Street right-of-way was made at the City Council level and
was based on public testimony in opposition of the connection of the two streets. The proposed
plat does not graphically depict the bollards; nevertheless, the bollards will need to be installed
in accordance with the Development Agreement (barring any changes to the Development
Agreement).

ACHD did not have an opportunity to review the City COW1cil' s action to require the bollards
within their right-of-way and invalidates their requirement to connect the proposed project to
the existing neighborhood. ACHD approved a traffic light at the entrance of this subdivision
based upon the connection of Teare Avenue to the proposed project. The interconnectivity
provided by connecting Fairview Lakes to Teare Avenue justified the placement of a traffic
light at the entrance of Fairview Lakes rather than at Jericho Street (ACHD's preferred
location for a traffic light) further to the east. ACHD does not typically approve stoplights for
single projects that do not provide interconnectivity. Furthermore, ACHD's original
requirement to connect the two streets was also incorporated within the Development
Agreement for the annexation of this property (pg 6, B.IS).
ACHD has submitted a letter; dated February 10, 2003 (attached) requesting the opportunity to
review the revised plans. They have also requested that the City of Meridian delay action on
the preliminary plat until the Teare A venue matter has been resolved. The traffic study that
was submitted as part of the original Fairview Lakes application does not reflect the current
roadway configuration and traffic patterns of the submitted Devon Park preliminary plat. The
final outcome of the Teare Avenue connection also needs to be taken into consideration.
SITE SPECIFIC COMMENTS I PRELIMINARY PLAT
1. Sanitary sewer and water service to this site shall be via main line extension from the
existing mains adjacent to the property. Subdivision designer to coordinate main sizing
and routing with the Public Works Department.
2. The applicant has indicated that the pressurized irrigation system within this development
is to be owned and maintained by The Nampa Meridian Irrigation District, however the
preliminary plat map doesn't indicate the source. Please revise the plat to show how the
system is going to be served (ie connection to the existing Settlers Park Subdivision's
system, or independent pwnping facilities) UndergroW1d vear-roW1d pressurized
irrigation must be provided to all lots within this development. The City of Meridian
requires that pressurized irrigation systems be supplied by a year-roW1d source of water.
Applicant shall be required to utilize any existing surface or well water for the primary
source. If a surface or well source is not available, a single-point connection to the
culinary water system shall be required. If a single-point connection is utilized, the
developer shall be responsible for the payment of assessments for the common areas prior
to signature on the final plat by the Meridian City Engineer.
3. A revised and detailed landscape plan shall be submitted with the Final Plat application.
The revised landscape plan shall include the following changes:
A.
A ten foot (10') wide landscape buffer shall be provided on all local streets within
the subdivision.
B.
No more than twelve (12) parking stalls shall be linearly arranged without a
landscape island containing a minimwn of fifty (50) square feet, containing at

least one tree and being at least five feet (5') wide.
C. The landscape buffer on the western property line where the property backs up to
residential property (the mobile home park) shall be a minimum of twenty feet
(20') wide.
4. Add or revise the following preliminary plat notes:
(10.1 Anv re-subdivision of this plat shall be in compliance with the most recentlv
approved subdivision standards of the Citv of Meridian.
(11.) The thirtv-five foot (35 ') wide landscape buffer on Fairview Avenue and the ten
foot (10') wide landscape buffers adiacent to the local streets within the subdivision shall
be maintained bv the Business Owners Association.
(12.1 All development within this subdivision shall be in accordance with Conditional
use Permit File No. CUP-02-0U
4. Any drainage areas (detention/retention basins) must be designed to ensure that water is
retained only duringlOO-year storm events, and for a period of time not to exceed 24
hours. Side slopes within drainage areas shall not exceed 3: 1.
5. Water held within the ponds shall be continuously circulated or shall be treated in another
manner to prevent the ponds from becoming stagnant.
6. Applicant shall revise the plat to graphically depict a five foot (5') wide landscape
easement along the south side of Lot 2, Block 6, adjacent to the railroad right-of-way.
7. Applicant shall revise the plat to correct the placement of the arrows depicting the 35'
wide landscape buffer so that they do not include 45' (the extra ten feet is a right-of-way
dedication).
8. A drainage plan designed by a State of Idaho licensed architect or engineer is required
and shall be submitted to the City Engineer (Ord. 557, 10-1-91) for all off-street parking
areas. Storm water treatment and disposal must be designed in accordance with
Department of Environmental Quality 1997 publication Catalog of Storm Water Best
Management Practices for Idaho Cities and Counties and City of Meridian standards and
policies. Off-site disposal into a surface water is prohibited unless the jurisdiction which
has authority over the receiving stream provides written authorization prior to
development plan approval. The applicant is responsible for filing all necessary
applications with the Idaho Department of Water Resources regarding Shallow Injection
Wells.

1. Please submit a copy of the Ada County Street Name Committee's approval letter for the
subdivision name, and the lot and block numbering. Make any corrections necessary to
conform.
2. Coordinate fire hydrant placement with the City of Meridian Public Works Department
and the City of Meridian Fire Department.
3. A letter of credit or cash surety in the amount of 110% will be required for all fencing,
landscaping, pressurized irrigation, sanitary sewer, water, etc., prior to signature on the
final plat.
4. All irrigation ditches, laterals or canals, exclusive of natural waterways, intersecting,
crossing or lying adjacent and contiguous to the area being subdivided shall be tiled per
City Ordinance 12-4-13. Plans will need to be approved by the appropriate
irrigation/drainage district, or lateral users association (ditch owner's), with written
approval or non-approval submitted to the Public Works Department. If lateral users
association approval can't be obtained, plans will be reviewed and approved by the
meridian City Engineer prior to final plat signature
5. Developer shall coordinate mailbox locations with the Meridian Post Office.
6. Any existing domestic wells and/or septic systems within this project will have to be
removed from their domestic service per City Ordinance Section 9-1-4 and 9-4-8. Wells
may be used for non-domestic purposes such as landscape irrigation.
7. 100-watt, high-pressure sodium streetlights will be required at locations designated by the
Public Works Department. All streetlights shall be installed at subdivider's expense.
Typical locations are at street intersections and/or fire hydrants. Final design locations
and quantity are determined after power designs are completed by Idaho Power
Company. The street light contractor shall obtain design and permit from the Public
Works Department prior commencing installations.
8. Compaction test results must be submitted to the Meridian Building Department for all
building pads receiving engineered backfill, where footing would sit atop fill material.
9. Applicant's engineer will be required to submit a signed, stamped statement certifying
that all street finish centerline elevations are set a minimum of three feet above the
highest established normal groundwater elevation.
10. Provide five-foot-wide sidewalks in accordance with City Ordinance Section 12-5-2.K.
RECOMMENDATION
Staff recommends approval of the proposed preliminary plat and finds that it is in conformance
the approved planned development (File No. CUP-02-014) and Development Agreement (lnst.
No.120143306).
Staff believes that issues revolving around the placement ofbollards on Teare Avenue, the need
for a public street that does not connect and the approval of a stoplight for the overall

development will need to be resolved prior to the City Council approval of the preliminary plat,
but should not hinder the processing of the proposed preliminary plat at the Commission level. If
significant changes are made to the plat the Planning and Zoning Commission will have another
opportunity to review the plat.

The following will be the requirements and/or concerns to provide minimum levels of fire
protection for the proposed project:
1. Commercial occupancies will require a fire-flow consistent with the Uniform Fire
Code to service the proposed project. Fire hydrants shall be placed an average of
400' apart. 1997 UFC Appendix III-A
2. The fire department requests that any future signa1ization installed as the result of
the development of this project be equipped with Opticom Sensors to ensure a safe
and efficient response by fire and emergency medical service vehicles. This cost of
this installation is to be borne by the developer.
3. Acceptance of the water supply for fire protection will be by the Meridian
Water Department.
4. Final Approval of the fire hydrant locations shall be by the Meridian Fire
Department. The proposed fire hydrant locations will be submitted to the Public
Works for plan review.
5. All roads and fire lanes shall have a turning radius of28' inside and 48' outside.
6. Insure that all yet undeveloped parcels are maintained free of combustible vegetation
per section 1103.2.4 of the Uniform Fire Code.
7. All access roads within the project shall have a clear driving surface with a minimum
width of20' available at all times. The typical street width of34' will be allowed to
have parking on both sides. The typical street with a minimum width of 29' will be
required to have restricted parking to only one side. UFC 902.2.2.1
8. Operational fire hydrants and temporary or permanent street signs are required before
combustible construction begins. UFC 901.4.2 & 901.3
9. The phasing plan may require that any roadway greater than 150' in length that is
not provided with an outlet shall be required to have a turn around.
10. The proposed 7-lot subdivision will have an unknown transient population and will
have an unknown impact on Meridian Fire Department call volume.

Should this development be planning a pressure urban irrigatibn system that will be owned,
operated and maintained by the Irrigation District, I strongly urg~ you to coordinate with John P.
Anderson, Water Superintendent for the Irrigation District, co~cerning the installation of the
pressure system. Enclosed is a questionnaire that you must fill ~ut and return in order to initiate

STORM WATER MANAGEMENT RECOMMENDATIONS
It is recommended that storm water be pre-treated through a grassy swale
prior to discharge to the subsurface to prevent impact to ground water and
surface water quality. The engineers and architects involved with the design
of this project should obtain current best management practices for storm
water disposal and design a storm water management system that is
preventing groundwater and surface water degradation. Manuals that could
be used for guidance are:

034).
We have reviewed the above referenced submittals and otTer the foRowing comments, as
conditions of approval. These conditions shall be considered in full, unless expressly
modified or deleted by motion of the Meridian City Council:
APPLICATION SUMMARY
The applicant, Tamura and Associates, has applied for Preliminary Plat approval of a seven (7)
lot commercial subdivision on 14.31 acres ofland, located on the north side ofFairview Avenue,
approximately Y2 a mile west of Locust Grove.
The City of Meridian recently approved a planned development on this piece ofland (Fairview
Lakes) that consists of a mix of commercial and high density residential uses. The proposed
preliminary plat is a subdivision of all of the commercially zoned land within the planned
development.
LOCATION
The property is located on the north side of Fairview approximately a Y, mile west of Locust
Grove Road.
SURROUNDING PROPERTIES
North: The Willows Subdivision, zoned R-8.
South: Commercial property, zoned CoG and R-8 (a car lot).
East: Settlers Village and a car wash, zoned CG and R-8.
West: A mobile home park and commercial property, zoned R-8 and CoG

PRELIMINARY PLAT FINDINGS AND REQUlREMENTS
Sections 12-3-3 J.2 and 12-3-5 D read as follows: "In determining the acceptance of a proposed
subdivision, the Commission/Council shall consider the objectives of this title and at least the
following:
a. Tbe conformance of tbe subdivision witb tbe Comprebensive Development ptan;
Staff finds the subdivision to be in conformance with the City's adopted Comprehensive
Plan. The Future Land Use Map depicts the property as "Mixed Use Regional" which
allows for the commercial uses proposed within the subdivision.
b. The availability of pub tic services to accommodate tbe proposed development;
Staff finds that public services are available to accommodate the proposed development.
c. Tbe continuity of tbe proposed development witb tbe capital improvement
program;
Staff finds that the subdivision will not require the expenditure of capital improvement
funds.
d. Tbe public financial capability of supporting services for tbe proposed
development;
Staff finds that the development will not require major expenditures for providing
supporting services.
e. Tbe other bealth, safety or environmental problems tbat may be brougbt to tbe
Commission's attention.
Staff finds that there should not be any other health, safety or environmental problems
associated with this subdivision that may be brought to the Councilor Commission's
attention.
ADDITIONAL CONSIDERA nONS
The Development Agreement signed prior to the City's annexation of this parcel of land included
a requirement to place bollards across the south end of Teare Avenue to prevent vehicular traffic
from entering or exiting the existing Settlers Village Subdivision (pg 8 F.2.). The decision to
bollard the Teare Street right-of-way was made at the City Council level and was based on public
testimony in opposition of the connection of the two streets. The proposed plat does not
graphically depict the bollards; nevertheless, the bollards will need to be installed in accordance
with the Development Agreement (barring any changes to the Development Agreement).
ACHD did not have an opportunity to review the City Council's action to require the bollards
within their right-of-way and invalidates their requirement to connect the proposed project to the
existing neighborhood. ACHD approved a traffic light at the entrance of this subdivision based

upon the connection of Teare Avenue to the proposed project. The interconnectivity provided by
connecting Fairview Lakes to Teare Avenue justified the placement of a traffic light at the
entrance ofFairview Lakes rather than at Jericho Street (ACHO's preferred location for a traffic
light) further to the east. ACHO does not typically approve stoplights for single projects that do
not provide interconnectivity. Furthermore, ACHO's original requirement to connect the two
streets was also incorporated within the Development Agreement for the annexation of this
property (pg 6, B.15).
ACHO has submitted a letter; dated February 10,2003 (attached) requesting the opportunity to
review the revised plans. They have also requested that the City of Meridian delay action on the
preliminary plat until the Teare Avenue matter has been resolved. The traffic study that was
submitted as part of the original Fairview Lakes application does not reflect the current roadway
configuration and traffic patterns of the submitted Devon Park preliminary plat. The final
outcome of the Teare Avenue connection also needs to be taken into consideration.
SITE SPECIFIC COMMENTS I PRELIMINARY PLAT
1. Sanitary sewer and water service to this site shall be via main line extension from the
existing mains adjacent to the property. Subdivision designer to coordinate main sizing
and routing with the Public Works Department.
2. The applicant has indicated that the pressurized irrigation system within this development
is to be owned and maintained by The Nampa Meridian Irrigation District, however the
preliminary plat map doesn't indicate the source. Please revise the plat to show how the
system is going to be served (ie connection to the existing Settlers Park Subdivision's
system, or independent pumping facilities) Underground year-round pressurized
irrigation must be provided to all lots within this development. The City of Meridian
requires that pressurized irrigation systems be supplied by a year-round source of water.
Applicant shall be required to utilize any existing surface or well water for the primary
source. If a surface or well source is not available, a single-point connection to the
culinary water system shall be required. If a single-point connection is utilized, the
developer shall be responsible for the payment of assessments for the common areas prior
to signature on the final plat by the Meridian City Engineer.
3. A revised and detailed landscape plan shall be submitted with the Final Plat application.
The revised landscape plan shall include the following changes:
A. A ten foot (10') wide landscape buffer shall be provided on all local streets within
the subdivision.
B. No more than twelve (12) parking stalls shall be linearly arranged without a
landscape island containing a minimum offifty (50) square feet, containing at
least one tree and being at least five feet (5') wide.
C. The landscape buffer on the western property line where the property backs up to
residential property (the mobile home park) shall be a minimum of twenty feet

4. Add or revise the following preliminary plat notes:

foot (JO ') wide landscqpe buffers adiacent to the local streets within the subdivision shall
be maintained bv the Business Owners Association.
02.) All development within this subdivision shall be in accordance with Conditional
use Permit File No. CUP-02-0J 4
4. Any drainage areas (detention/retention basins) must be designed to ensure that water is
retained only duringl00-year storm events, and for a period of time not to exceed 24
hours. Side slopes within drainage areas shall not exceed 3: 1.
5. Water held within the ponds shall be continuously circulated or shall be treated in another
manner to prevent the ponds from becoming stagnant.
6. Applicant shall revise the plat to graphically depict a five foot (5') wide landscape
easement along the south side of Lot 2, Block 6, adjacent to the railroad right-of-way.
7. Applicant shall revise the plat to correct the placement of the arrows depicting the 35'
wide landscape buffer so that they do not include 45' (the extra ten feet is a right-of-way
dedication).
8. A drainage plan designed by a State of Idaho licensed architect or engineer is required
and shall be submitted to the City Engineer (Ord. 557, 10-1-91) for all off-street parking
areas. Storm water treatment and disposal must be designed in accordance with
Department of Environmental Quality 1997 publication Catalog of Storm Water Best
Management Practices for Idaho Cities and Counties and City of Meridian standards and
policies. Off-site disposal into a surface water is prohibited unless the jurisdiction which
has authority over the receiving stream provides written authorization prior to
development plan approval. The applicant is responsible for filing all necessary
applications with the Idaho Department of Water Resources regarding Shallow Injection
Wells.
GENERAL COMMENTS
1. Please submit a copy of the Ada County Street Name Committee's approval letter for the
subdivision name, and the lot and block numbering. Make any corrections necessary to
conform.
2. Coordinate fire hydrant placement with the City of Meridian Public Works Department
and the City of Meridian Fire Department.

3. A letter of credit or cash surety in the amount of 110% will be required for all fencing,
landscaping, pressurized irrigation, sanitary sewer, water, etc., prior to signature on the
final plat.
4. All irrigation ditches, laterals or canals, exclusive of natural waterways, intersecting,
crossing or lying adjacent and contiguous to the area being subdivided shall be tiled per
City Ordinance 12-4-13. Plans will need to be approved by the appropriate
irrigation/drainage district, or lateral users association (ditch owner's), with written
approval or non-approval submitted to the Public Works Department. If lateral users
association approval can't be obtained, plans will be reviewed and approved by the
meridian City Engineer prior to final plat signature
5. Developer shall coordinate mailbox locations with the Meridian Post Office.
6. Any existing domestic wells and/or septic systems within this project will have to be
removed from their domestic service per City Ordinance Section 9-1-4 and 9-4-8. Wells
may be used for non-domestic purposes such as landscape irrigation.
7. 100-watt, high-pressure sodium streetlights will be required at locations designated by the
Public Works Department. All streetlights shall be installed at subdivider's expense.
Typical locations are at street intersections and/or fire hydrants. Final design locations
and quantity are determined after power designs are completed by Idaho Power
Company. The street light contractor shall obtain design and permit from the Public
Works Department prior commencing installations.
8. Compaction test results must be submitted to the Meridian Building Department for all
building pads receiving engineered backfill, where footing would sit atop fill material.
9. Applicant's engineer will be required to submit a signed, stamped statement certifying
that all street finish centerline elevations are set a minimum of three feet above the
highest established normal groundwater elevation.
10. Provide five-fool-wide sidewalks in accordance with City Ordinance Section 12-S-2.K.
RECOMMENDATION
Staff recommends approval of the proposed preliminary plat and finds that it is in conformance
the approved planned development (File No. CUP-02-014) and Development Agreement (Inst.
No. 120143306).
Staff believes that issues revolving around the placement ofbollards on Teare Avenue, the need
for a public street that does not connect and the approval of a stoplight for the overall
development will need to be resolved prior to the City Council approval of the preliminary plat,
but should not hinder the processing of the proposed preliminary plat at the Commission level. If
significant changes are made to the plat the Planning and Zoning Commission will have another
opportunity to review the plat.

Dear Brad,
It has come to our attention that the Meridian City Council did not require the extension of Teare
Avenue with the Fairview Lakes planned development. However, on July 10, 2002, the ACHD
Commission approved the planned development, as proposed, that included extending Teare Avenue
to Fairview Avenue. In addition, the applicant requested approval to construct a traffic signal at the
proposed main entrance on Fairview Avenue. The ideal signal location in this area is at Jericho
Street, but because the applicant was proposing to extend Teare Avenue into the site, ACHD agreed
to allow the signal in the proposed location because it would still provide signalized access to the
residential properties located north of this development.
If Teare Avenue is not going to be extended, the applicant will need to provide a revised site plan to
ACHD, and the Commissioners will have to review the extension of Teare Avenue, as well as the
location of the proposed traffic signal. It is unlikely that staff will support a traffic signal that serves a
single development, and does not provide neighborhood connectivity.
I understand that the applicant has submitted a preliminary plat for approval. I would request that the
City of Meridian delay any further action regarding this plat until the Teare Avenue matter has been
resolved.
