BY COUNCIL MEMBER ~1~~ ~ ~~~ ~~~~ RECQ OFD • REQlJEST 0 of ~'EE DEPUTY 3~- 9975531 AN ORDINANCE OF THE CITY OF MERIDIAN, IDAHO, REPEALING ORDINANCE NO. 775 VACATING THE PUBLIC RIGHT-OF-WAY IQVOWN AS GENTRY WAY AND THE EXISTING 10 FOOT WIDE PUBLIC UTILITY, DRAINAGE AND IRRIGATION EASEMENT ADJACENT TO GENTRY WAY IN LOT 12 AND LOT 13, AMENDED MAGIC VIEW SUBDIVISION, A SUBDIVISION IN ADA COUNTY, IDAHO AND RECORDED IN THE RECORDS OF ADA COUNTY, STATE OF IDAHO; AND PROVIDING AN EFFECTIVE DATE; AND DIRECTING THE CITY CLERK TO RECORD THIS ORDINANCE. NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF MERIDIAN, ADA COUNTY, IDAHO: SECTION 1: That Ordinance No. 775 vacating the public right-of-way known as Gentry Way and the existing 10 foot wide public utility, drainage and irrigation easement adjacent to Gentry Way in Lot 12 and Lot 13, Amended Magic View Subdivision, a Subdivision in Ada County, Idaho and recorded in the records of Ada County, State of Idaho, as instrument #97092909, be and the same is hereby repealed. SECTION 2: All ordinances, resolutions, orders or parts thereof in conflict herewith are hereby repealed, rescinded and annulled. SECTION 3: SAVINGS CLAUSE: This ordinance does not affect an action or proceeding commenced or right accrued before this ordinance takes effect. SECTION 4: DATE OF EFFECT. This ordinance shall be in full force and effect within one (1) month after its passage, approval and publication, according to law.
