AN ORDINANCE FINDING THAT THE OWNER OF CERTAIN REAL PROPERTY HAS NLA,DE A WRITTEN REQUEST FOR REZONE OF THE ZONING CLASSIFICATION FOR REAL PROPERTY THAT LIES WITHIN THE BOUNDARIES OF THE CITY OF MERIDIAN FROM R-15 (MEDIUM HIGH DENSITY RESIDENTIAL) ZONING DISTRICT TO L-O (LIMITED OFFICE DISTRICT) AS DEFINED UNDER §11-2-408B(7) OF THE MUNICIPAL CODE OF THE CITY OF MERIDIAN, REPEALING ALL ORDINANCES, RESOLUTIONS ORDERS OR PARTS THEREOF IN CONFLICT HEREWITH; AND DIRECTING THE CITY ENGINEER TO ADD SAID REZONING DESIGNATION TO THE OFFICLAL MAPS OF THE CITY OF MERIDIAN, IDAHO. BE IT ORDAINED BY THE MAYOR AND THE COUNCIL OF THE CITY OF MERIDLAN, COUNTY OF ADA, STATE OF IDAHO: SECTION 1. FINDINGS: 1. The owner of the following described property has made a written request for a re-zone of the zoning classification for the subject Real Property herein described from R-15 (Medium High Density Residential) District to L-O (Limited Office) District as defined under §11-2-408B(7) of the Municipal Code of the City of Meridian; and 2. The City of Meridian Planning and Zoning Commission and City Council having given notice SCOTTSDALE SUBDIVISION RE-ZONE ORDINANCE - 1 r, . 1. and conducted all public hearings in accordance with law and having issued its findings of fact and conclusions of law and Decision and Order granting the application for rezone; and 3. The real property which is the subject of this ordinance is legally described as: A parcel of land located in the NE 1/4 of the NW 1/4 of Section 13, Township 3 North, Range 1 West of the Boise Meridian, Ada County, Idaho, being more particularly described as follows: Commencing at the north i/4 corner of Section 13, T. 3N., R. 1W., B.M., thence S 0°04'01" E 40.00 feet to a point on the south right-of--way of W. Franklin Road, the REAL POINT OF BEGINNING of this description; Thence N 89°49'00" W 155.50 feet along said south right-of--way to a point; Thence S 45°11'00" W28.28 feet to a point; Thence S 0°11'00" W 265.00 feet to a point; Thence N 89°49'00" W 195.85 feet to a point on the east boundary of Crest Wood Estates Subdivision No. 1, filed in Boolc 3 6 of Plats, at page 3060, records of the Ada County Recorder's Office; Thence S 9° 10'00" E 125.49 feet along said east boundary to a point; Thence S 0°05'00" W along said easterly boundary SCOTTSDALE SUBDIVISION RE-ZONE ORDINANCE - 2 r, ~ - 58.10 feet to the northeast of Fenway Park No. 3 Subdivision, filed in Boolc 66 of Plats, at page 6890, records of the Ada County Recorder's Office; Thence S 0°04'03" E 124.73 feet along the east boundary of said Fenway Parlc No. 3 Subdivision to an angle point; Thence S 65°51'33" E 386.92 feet along the northeasterly boundary of said Fenway Park No. 3 Subdivision and Fenway Parlc No. 2 Subdivision to a point on the west boundary of Franklin Square Subdivision, filed in Boolc 44 of Plats, at page 3587, records of the Ada County Recorder's Office; Thence N 0°04'01" W 748.77 feet along said west boundary to the REAL POINT OF BEGINNING of this description. This parcel contains 4.296 acres, more or less. SECTION 2. That the above-described real Property be, and the same is hereby re-zoned and designed (L-O) Limited Office District. SECTION 3. That the City Engineer is hereby direct to alter all use and area maps as well as the official zoning maps depicting the City of Meridian land use zones in accordance with this ordinance. SECTION 4. All ordinances, resolutions, orders or parts thereof in conflict herewith are hereby repealed, rescinded and annulled. SECTION 5. This ordinance shall be in full force and effect from and after its passage, approval and publication, according to law.
