AMENDED ORDINANCE NO. 774
AN ORDINANCE OF THE CITY OF MERIDIAN AMENDING AND CHANGING
THE ZONING OF CERTAIN REAL PROPERTY IN THE CITY OF MERIDIAN
WHICH IS DESCRIBED AS A PORTION OF THE SOUTHWEST Y4 OF THE
SOUTHEAST Y4 OF SECTION 2, TOWNSHIP 3 NORTH, RANGE 1 WEST OF
THE BOISE MERIDIAN, IDAHO; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, the City Council and the Mayor of the City of Meridian, Idaho,
have concluded that it is in the best interest of said City to change the zoning
from R-4 Residential to Limited Office (L-O), for the following described parcel in
Section 1 below:
NOW, THEREFORE, BE IT ORDAINED by the Mayor and City Council of
the City of Meridian, Ada County, Idaho:
Section 1: That the aforementioned real property which is described as
follows:
A parcel of land lying in a portion of the SW Y4 of the SE Y4 of Section 2,
T. 3N., R 1 W., B.M., Meridian" Ada County, Idaho and more particularly
described as follows:
Commencing at a point marking the one-quarter corner common to
Section 11 and the said Section 2;
thence South 89033'16" East, (formerly described as South 89051' East)
758.87 feet along the southerly boundary of the said SE Y4 of Section 2,
which is also the centerline of Cherry Lane, to a point, also said point
being the REAL POINT OF BEGINNING;
thence continuing South 89033'46" East (formerly described as South
89051" East) 500.87 feet along the said southerly boundary of the SE Y4 of
Section 2 to a point;
thence North 2008'39'~West, 224.92 feet to a point;
thence North 89033'46" West, 491.43 feet along a line northerly of and
parallel with the said southerly boundary of the SE Y4 of Section 2 to a
point;

thence South 0015'38" West, 224.69 feet to the Point of Beginning,
comprising 2.56 acres (111,480 square feet), more or less.
be, and the same is hereby rezoned from R-4 Residential to Limited Office (L-O)
and Section 11-2-425, Official Zoning Maps is hereby amended to reflect the
same. This rezoning is subject to the conditions referenced in the Findings of
Fact and Conclusions of Law as adopted by the Meridian City Council on the
request for rezone.
Section 2. The Applicant shall comply with all of the Ordinances of the
City of Meridian including Fire Code, Life Safety Code, the Uniform Building,
Electrical, Plumbing Codes and all of the Ordinances of the City of Meridian.
That the Applicant shall enter into a Development Agreement and/or the property
shall be developed under the conditional use permit process.
Section 3. That if the Applicant shall fail to meet the above conditions
the property shall be subject to rezone back to R-4.
Section 4. EFFECTIVE DATE: There being an emergency, which
emergency is hereby declared to exist, this Ordinance shall be in full force and
effect from and after its passage and approval as required by law.
PASSED by the City Council and approved by the Mayor of the City of
