AN ORDINANCE OF THE CITY OF MERIDIAN AMENDING TITLE 1, CHAPTER 7,
THE COUNCIL, OF THE REVISED AND COMPILED ORDINANCES OF THE CITY OF
MERIDIAN BY THE ADDITION OF NEW SECTION TO BE KNOWN AS SECTION 1-
708 TO SET FORTH AND ESTABLISH A PRESIDENT AND VICE-PRESIDENT OF
THE CITY COUNCIL; ESTABLISHING THE TERMS OF OFFICE OF BOTH THE
PRESIDENT AND VICE-PRESIDENT; ESTABLISHING THE DUTIES OF EACH; AND
PROVIDING AN EFFECTIVE DATE.
WHEREAS, Section 50-701, Idaho Code, states that the
legislative authority of each City in the State of Idaho shall be
vested in a council and that such council shall have such powers
and duties as are now or may hereafter be provided under the
general laws of the State of Idaho.
WHEREAS, Section 1-701, of the Revised and Compiled Ordinances
of the City of Meridian, states that councilmen shall perform all
duties by the nature of their office that they should reasonably
perform.
WHEREAS, the Mayor and the City Council of the City of
Meridian, State of Idaho, have concluded that it is in the best
interest of the City to amend Title 1, Chapter 7, of the Revised
and Compiled Ordinances of the City of Meridian, by amending that
Title and Chapter, to add a new Section thereto to set forth and
establish a President and Vice -President. The President and Vice -
President shall have the duties, rights and obligations as set
forth in Section 1 below, and others as established by the City
Council.

NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL
OF THE CITY OF MERIDIAN, ADA COUNTY, IDAHO:
SECTION 1: That Title 1, Chapter 7, CITY COUNCIL, is
hereby amended to add and enact Section 1-708, which shall read as
follows:
1-708: PRESIDENT AND VICE-PRESIDENT OF THE CITY COUNCIL SHALL
HAVE THE FOLLOWING DUTIES, RIGHTS, AND OBLIGATIONS:
A• The City Council, by their own action, shall elect
a City Councilman to serve as the President of the City
Council. The vote shall be a majority vote by the City
Council. The vote shall be at the second City Council
meeting of the year, in January. The City Councilman
nominated to be elected as the President shall have the
right to decline the nomination and shall have the right
to vote to approve or reject his own nomination; if the
Councilman nominated to be elected as President is
rejected by the vote, the City Council shall make another
nomination and they shall continue to do so until a
Councilman is elected as President.
B• The President shall serve a one year term. He may
serve two consecutive terms but not more than two
consecutive terms of one year each term; a Councilman may
serve as President again but shall not serve as President
for more than two consecutive terms.
C• The President shall have the authority to, and
shall, act as the Mayor of the City during the absence or

disability of the Mayor until the Mayor returns, as
required under 50-608, Idaho Code.
D • The President may sign warrants along with the other
required City officers.
E. The President, with City Council concurrence, shall
establish and set the agenda for budget, legislative, and
strategic planning issues at City Council meetings; he
shall assign duties of all the City Councilmen and
oversee all of the City Council affairs.
F. The City Council, by their own action, shall elect
a City Councilman to serve as the Vice -President of the
City Council. The vote shall be a majority vote. The
vote shall be at the second City Council meeting in
January. If the Councilman nominated to be elected as
Vice -President is rejected by the vote, the City Council
shall make another nomination and they shall continue to
do so until a Councilman is elected as Vice -President.
G. The Vice -President shall have the authority to, and
shall, act as the President of the City Council during
the absence or disability of the President. If both the
Mayor and City Council President are absent from the
City, the Vice -President shall have the authority to, and
shall, act as the Mayor of the City during the absence of
the Mayor and Council President.
H. The President of the City Council shall act as the
liaison between the City Council and the City Attorney on

legislative matters.
I• The President and the Vice -President shall have any
duties, other than those mentioned above, stated by the
City Council.
SECTION 2: EFFECTIVE DATE: WHEREAS, there is an emergency
therefor, which emergency 9 y is hereby declared to exist, this
Ordinance shall be in full force and effect from and after its
passage, approval and publication according to law.

AN ORDINANCE OF THE CITY OF MERIDIAN ANNEXING AND ZONING CERTAIN
REAL PROPERTY WHICH IS DESCRIBED AS A PARCEL OF LAND LOCATED IN THE
SOUTHEAST 1/4 OF SECTION 36, TOWNSHIP 4 NORTH, RANGE 1 WEST, BOISE
MERIDIAN, ADA COUNTY, IDAHO; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, the City Council and the Mayor of the City of
Meridian, Idaho, have concluded that it is in the best interest of
said City to annex to the said City real property which is
described in Section 1 below:
NOW, THEREFORE, BE IT ORDAINED by the Mayor and City
Council of the City of Meridian, Ada County, Idaho:
Section 1. That the real property described as:
See attached Exhibit "A" for the full legal description.
is hereby annexed to the City of Meridian, and shall be zoned L-0,
Limited Office; that the annexation and zoning is subject to the
conditions referenced in the Findings of Fact and Conclusions of
Law as adopted by the Meridian Council on the request for
annexation and zoning.
Section 2. That the property shall be subject to de -
annexation if the owner shall not meet the following requirements:
a. That the Applicant for this annexation shall be required
to connect to Meridian water and sewer at its expense
and resolve how the water and sewer mains will serve the
land.
b. That the development of the property shall be subject to
and controlled by the Subdivision and Development
Ordinance and the Meridian Comprehensive Plan adopted
January 4, 1994.

C. That the development of annexed land must meet and
comply with the Ordinances of the City of Meridian and
in particular Section 11-9-616, which pertains to
development time schedules and requirements, 11-9-605 M.
which pertains to the tiling of ditches and waterways,
and 11-9-606 B 14. which pertains to pressurized
irrigation.
d. That these conditions shall run with the land and bind
the Applicant, the titled owners, and their assigns.
e. That these requirements and conditions of the Findings
of Fact and Conclusions of Law and the Ordinances of the
City of Meridian be met.
Section 3. That the City Clerk shall cause one (1) copy
of the legal description, and map, which shall plainly and clearly
designate the boundaries of said property, to be filed with the Ada
County Recorder, Ada County Assessor, and the State Tax Commission
within ten (10) days following the effective date of this
Ordinance.
Section 4. EFFECTIVE DATE: There being an emergency,
which emergency is hereby declared to exist, this Ordinance shall
be in full force and effect from and after its passage and approval
as required by law.
