This matter coming on regularly before the City Council on September 18, 2007, upon the
Applicant's time application for an additional six month extension within which to record the
McNelis Subdivision Final Plat ,which was originally approved on June 8, 2004, as provided in §
11-6B-7C, and good cause shown.
IT IS HEREBY ORDERED AND THIS DOE5 ORDER THAT:
1. The above name Applicant is granted an additional six month extended period of time
beginning October 1, 2007, until April 1, 2008, of this Order within which to record the
Final Plat for the above entitled subdivision application.

Request fora 6-month Time Extension (File# TE 07-012) to Record the Final Plat for
McNelis Subdivision, by Falcon Creek, LLC.
We have reviewed this submittal and offer the following comments:
APPLICATION SUMMARY
The applicant, Falcon Creek, LLC, has requested approval of a 6-month time extension to record the fmal
plat for McNelis Subdivision. The preliminary plat (PP-04-004) for McNelis Subdivision was approved
by the Meridian City Council on June 8, 2004. The fmal plat was approved on August 9, 2005. A
previous time extension (TE-OS-003) was approved by the Director and will expire on August 9, 2007.
(Note: The applicant submitted the subject time extension application prior to this expiration date).The
subject plat consists of 16 commercial building lots and 4 common lots in the I-L, L-O, and C-G zones on
32.55 acres.
The applicant states the reason for the delay is because of issues with the pressurized imgation system
and agencies still reviewing the plat. Therefore, they are unable to meet the time requirements specified in
Unified Development Code (UDC) 11-6B-7 and 11-SB-6.
The City of Meridian's Unified Development Code (UDC 11-5B-6 and 11-6B-7) allows the Director to
authorize a single extension of time to record the fmal plat, not to exceed 18 months, when the applicant
files a written request for an extension prior to the expiration of the Preliminary Plat, which the applicant
did. As mentioned above, the applicant is now requesting an additional 6-month time extension.
Additional time extensions up to 18 months as determined and approved by the Council maybe granted.
With all extensions, the City may require compliance with the current provisions of the UDC as a
condition for granting a time extension (UDC 11-6B-7C and 11-SB-6F4). Staff believes that there are no
additional conditions that should be added to those approved by the City Council with the final plat for
this subdivision, at this time.
LOCATION
The property is located on the northwest corner of N. Ten Mile Road and W. Ustick Road, in the SE % of
Section 34, T.4N., R.1 W.
STAFF RECOMMENDATION
Staff recommends approval of a 6-month time extension until January 9, 2008 to record the fmal plat for
McNelis Subdivision.
