HomeMy WebLinkAbout778 Lee Centers RZORDINANCE NO. 7 78 AN ORDINANCE OF THE CITY OF MERIDIAN AMENDING AND CHANGING THE ZONING OF CERTAIN REAL PROPERTY IN THE CITY OF MERIDIAN WHICH IS GENERALLY DESCRIBED AS A 1.00 ACRE PARCEL LOCATED IN THE SOUTHEAST 1/4, NORTHEAST 1/4, NORTHEAST 1/4 OF SECTION 13, TOWNSHIP 3 NORTH, RANGE 1 WEST, BOISE MERIDIAN, ADA COUNTY, IDAHO; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City Council and the Mayor of the City of Meridian, Idaho, have concluded that it is in the best interest of said City to change the zoning from R-15 Medium High Density Residential to R-40 High Density Residential, for the following described parcel in Section 1 below: NOW, THEREFORE, BE IT ORDAINED by the Mayor and City Council of the City of Meridian, Ada County, Idaho: Section 1. That the aforementioned real property which is described as follows: A 1.00 acre parcel located in the SE 1/4, NE 1/4, NE 1/4, Section 13, Township 3 North, Range 1 West, Boise Meridian, Ada County, Idaho, more particularly described as follows: Beginning at the Southeast 1/4 of the Northeast 1/4, Northeast 1/4 of Section 13, Township 3 North, Range 1 West, Boise Meridian, Meridian, Ada County, Idaho; thence North 35.8 feet along the section line (the centerline of S. Meridian Street) to a point; thence North 89° 41' West 25.00 feet to a point; thence North 120.00 feet along the west side of said Meridian street to a point, the real point of beginning; r0905 thence North 89° 41, West 363.00 feet along the north side of record of survey No. 3497 whose, bearing is North 89° 18, 25" West 363.00 feet (even though these bearings are different, the angles & distances remain the same) to a point; thence North 120.00 feet to a point; (�� REZONE ORDINANCE - LEE CENTERS - PAGE 1 ,wel ' 1 1 LIit D6 FEE _��� / i is thence South 89° 41' East 363.00 feet to a point; thence South 120.00 feet to a point, the real point of beginning. Said parcel containing 1.00 acres, more or less, be, and the same is hereby rezoned from R-15 Medium High Density Residential District to R-40 High Density Residential District and Section 11-2-425, Official Zoning Maps, is hereby amended to reflect the same. This rezoning is subject to the conditions referenced in the Findings of Fact and Conclusions of Law as adopted by the Meridian City Council on the request for rezone, and even though the property is zoned R-40, no more than three (3) structures with a total of sixteen (16 ) units shall be constructed on the property as designated in the application of rezone. Section 2. The Applicant shall comply with all of the Ordinances of the City of Meridian including the Fire Code, Life Safety Code, the Uniform Building, Electrical, Plumbing Codes and all of the Ordinances of the City of Meridian. That the Applicant shall enter into a Development Agreement and/or the property shall be developed under the conditional use permit process. Section 3. That if the Applicant shall fail to meet the above conditions the property shall be subject to rezone back to R-15. Section 4. EFFECTIVE DATE: There being an emergency, which emergency is hereby declared to exist, this Ordinance shall be in full force and effect from and after its passage and approval as required by law.
