HomeMy WebLinkAbout767 Assembly of God RZORDINANCE NO. / � 7 AN ORDINANCE OF THE CITY OF MERIDIAN AMENDING AND CHANGING THE ZONING OF CERTAIN REAL PROPERTY IN THE CITY OF MERIDIAN WHICH IS DESCRIBED AS A PORTION OF THE SOUTHWEST 1/4 OF THE SOUTHWEST 1/4 OF SECTION 1, TOWNSHIP 3 NORTH, RANGE 1 WEST OF THE BOISE MERIDIAN, IDAHO; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City Council and the Mayor of the City of Meridian, Idaho, have concluded that it is in the best interest of said City to change the zoning from R-4 Residential to Limited Office (L-0), for the following described parcel in Section 1 below: 3 7 0 6 9 i 3 0 NOW, THEREFORE, BE IT ORDAINED by the Mayor and City Council of the City of Meridian, Ada County, Idaho: Section 1. That the aforementioned real property which is described as follows: ` A portion of the Southwest 1/4 of the SbdLli' Section 1, Township 3 North, Range 1 West. o t e .-Bois Meridian described as follows: -�8 KEf Beginning at a point that is N 0*28,101, W 350.00 feet and N 89041,101, E 45.00 feet from the Southwest corner of Section 1, Township 3 North, Range 1 West of the Boise Meridian (said point being on the East right-of-way line of North Linder Road) and running thence N 89*41,10" E 755.00 feet; thence N 0®28'10" W 456.79 feet; thence N 8904314511 E 72.35 feet; thence N 4°49'42" W 74.95 feet; thence N 3021129" E 146.99 feet; thence N 22041'06" W 30.63 feet; thence S 89045120" W 521.66 feet; thence S 0*321301, E 139.64 feet; thence S 89054153" W 298.41 feet to said East right-of-way line; thence S 0028,10" E 568.6.5 feet along said right-of-way line to the point of beginning. Parcel contains 11.71 acres. be, and the same is hereby rezoned from R-4 Residential to Limited Office (L-0) and Section 11-2-425, Official Zoning Maps is hereby amended to reflect the same. This rezoning is subject to the REZONE ANNEXATION ORDINANCE - MERIDIAN ASSEMBLY OF GOD - PAGE 1 conditions referenced in the Findings of Fact and Conclusions of Law as adopted by the Meridian City Council on the request for rezone. Section 2. The Applicant shall comply with all of the Ordinances of the City of Meridian including the Fire Code, Life Safety Code, the Uniform Building, Electrical, Plumbing Codes and all of the Ordinances of the City of Meridian. That the Applicant shall enter into a Development Agreement and/or the property shall be developed under the conditional use permit process. Section 3. That if the Applicant shall fail to meet the above conditions the property shall be subject to rezone back to R- 4. Section 4. EFFECTIVE DATE: There being an emergency, which emergency is hereby declared to exist, this Ordinance shall be in full force and effect from and after its passage and approval as required by law.
