Bown Way Boise, ID 83706 ~ ~~~3® An IDACORP Company ~~ v ~°~'~~~~ OCT 01 2007 City Of meridian Gity Clerk Office Re: Letter of Intent - Jaker Subdivision (Phase One) a parcel of land which is generally located within a portion of Section 22, Township 4 North, Range 1 West, B.M., Ada County, Idaho ' Dear Mr. Semple: This Letter of Intent is in response to your firm's application request to release a number of Idaho Power Company's (IPC) easements (Inst. #208515, Inst #185142 and Inst #9023013) that may impact the above-mentioned proposed Jaker Subdivision. I do understand that someone from your firm has met with IPC's Distribution Designer Glen Bafus to briefly discuss the subdivsion(s) needs. I further understand that one line has been rerouted and perhaps two of the existing overhead lines might be integrated into the new subdivision. However not all of the electrical load information is known at this time, so the statements below are general and may or may not impact the new construction at the above- mentioned site. 1. IPC has provided electrical service into the proposed Jaker Subdivision area for many years. Therefore, IPC can not disconnect service to existing customers except under certain circumstances, such as line relocation (for a limited time) or non-payment of account, etc. 2. IPC does not want to hinder this possible new development. IPC anticipates working with your client, as well as the professionals at RiveRidge Engineering (RiveRidge). 3. All work performed by IPC to provide new szr</ice and/or relocation of existing services and facilities will be performed in accordance with filed tariff, specifically Rule "H", which governs new service attachments and distribution line installation and/or any alterations for all development(s). 4. IPC is also aware that Ada County Highway District (ACHD) may determine a need for a wider public corridor along Chinden Boulevard. II'C has electrical facilities running along Chinden and recently relocated some of those facilities along Basco Roadway. Those existing overhead lines are the closest facilities to this site and are necessary in order to provide any electrical service (temporary or otherwise) into this proposed subdivision. 5. Only IPC or its contractors may remove and/or relocate any and/or all portion(s) of IPC's electrical facilities regardless if those facilities are located within the public corridor and/or within the proposed residential development site: P.O. Box 70 (83707) 1221 W. Idaho St. Boise, ID 83702 6. If necessary, IPC may expect or ask RiveRidge or any other firm representing the property owner to provide Mr. Bafus with specific work products. The expenses for those work products are borne by your client. 7. If IPC elects not to remove its existing overhead line for the proposed subdivision site, then IPC will expect your firm (or any other professional entity) that the property owner hires now or in the future to provide II'C a legal description Exhibit for any portion of that line that remains in place. If that should occur, and because both Inst #208515 and Inst #185142 are blanket easements, Mr. Bafus shall establish the necessary width of that corridor by whatever the length of existing line that remains in place. All Exhibits must bear the engineer's seal and signature. If that course of action should occur, then IPC shall prepare partial release document(s) retaining its rights for that specific existing utility corridor. IPC shall record its own release document(s) then provide you with a photocopy. 8. However, if Mr. Bafus redesigns the line as an underground line and if the plat depicts that same underground utility corridor, then IPC shall release rts easement(s). Those easement(s) shall only be released after the old line is removed; the new line is constructed, then energized through the subdivision and after receiving a concurrence from Mr. Bafus. IPC will specify those release document(s) shall only become effective upon recordation of the plat. IPC shall record its own release document(s) then provide you with a photocopy. 9. Based on your application request, IPC' has already released its rights on Instrument #9023013. I am enclosing a copy of that recorded document for your records. Please continue to work with Mr. Bafus regarding any of IPC's electrical facilities concerns into this proposed subdivision.
