Idaho Meridian, ID 83642 DECEIVED SEP 1 ~ 200 City of Meridian City Clerk Office RE: Conditional Use Permit for the Selway Multi-Family Development Dear Mr. Berg: Our names' are John & Rachel Nelson and we are homeowners' in the Kelly Creek Subdivision. We are writing to you to express our concerns regarding the proposed Selway Multi-Family Development. We are asking you to please consider our concerns when you are voting on the Conditional Use Permit. We have three issues that we are concerned about. 1. Aesthetics/Maintenance We are extremely concerned about the aesthetics and maintenance of the development. We feel that this is crucial, as it could affect the property value of our homes. The homes that are to the north and east of the proposed development cost $300K and up; we paid a lot of money for our homes and we would like to keep as much value as possible. The first issue is the aesthetics. After attending the neighborhood meetings facilitated by J-U-B Engineering and Rudeen Development, we are not satisfied with the proposed appearance of vinyl siding and faux rock/stone. We have asked them repeatedly to change their exterior appearance to match the rest of the Lochsa Falls Planned Development (see attached copy of Kelly Creek bylaw 4.8 and 4.9), and they have told us that it is not economically feasible for them. We were told at these meeting's that they are excluded from the CC&R's of the development, which has dumbfounded us since every letter we have received regarding this development has stated that the "ten acre site is located within the Lochsa Falls Planned Development." They claim that the development will be "self-contained"; however, to enter the development they must drive into the Kelly Creek Subdivision and they also have walking paths that will access the Kelly Creek Subdivision. The second issue is the maintenance of the property. A homeowner from Kelly Creek actually drove to Spokane, WA and took pictures of a few of the properties built and managed by Rudeen Development. The exterior of the developments were run down and dirty. As homeowner's in Kelly Creek, we value how our home's and community look and we take care of the exterior of our homes. In fact, it is stipulated in our CC&R's that we must maintain our exteriors or we will be fined. Our understanding is that Rudeen Development will be the management company for the development. We are concerned by this, because after seeing the pictures, we don't feel they have adequate resources to make sure the development is properly maintained. We strongly feel that the development should have to comply with either the Kelly Creek Subdivision master CC&R's or the Lochsa Falls Subdivision master CC&R's for the following reasons: 1. To have their exterior appearance be in compliance with the Kelly Creek and Lochsa Falls Subdivisions. 2. To have the Homeowners' Association watch over the maintenance of the development and hold Rudeen Development accountable for the upkeep of the development. 3. The developments only entrance and emergency entrance are located within the Kelly Creek Subdivision. 4. The fence lines along the development are only 5 feet on the side and 6 feet on the rear, which gives the Kelly Creek Subdivision plain view of the development. This gives the effect that they are actually a part of the Kelly Creek Subdivision. 5. The development has common sidewalk paths that join into the Kelly Creek Subdivision. 2. Schools We are also extremely concerned about the impact that this development will have on our elementary schools. We have an eight year old that is in third grade at the brand new Paramount Elementary School. The school is already way over capacity and the Paramount Subdivision is not completely built out or sold out. Almost every class has over 30 students. If the proposed development of 171 units comes to fruition, we are worried that the classroom sizes will increase even more and that our child's education will be affected. Hunter Elementary on McMillan is over capacity as well. At this point, there are no plans to build an additional Elementary School to accommodate all of the children living within Kelly Creek, Lochsa Falls, Paramount, and Bridgetower. Where are all of the kids from the unsold homes in Paramount, Bridgetower, and the proposed Selway Multi-Family Development going to go? The city needs to think long and hard about this issue. 3. Traffic We are concerned about the increase in traffic. The main street into our subdivision, Goddard Creek, is already a very busy street during the morning and afternoon rush hour. The proposed entrance to the development is within our subdivision off of Goddard Creek. If you average at least 1.5 cars per unit, then we are looking at an estimated 256.5 additional vehicles that will be entering and exiting our subdivision on a daily basis. The intersection of Goddard Creek and McMillan is already a hazardous intersection; it is very hard to see the traffic coming east or west. We feel that a stop light needs to be put at this intersection. Also, we feel that the traffic passing through to Chinden will increase as well. Vehicles passing through on Goddard Creek travel in excess of the speed limit constantly, because we only have one round-a-bout. We have many children that live in the Kelly Creek and Lochsa Falls subdivisions and we worry about their safety. We would like to see additional stop signs put up on Goddard Creek, to slow the traffic down. In conclusion, we feel that the city's zoning of R-4 was extremely misleading to the public. Had we known there was a separate "future zoning map", we would have looked at it and we probably would not have purchased our home. We are asking the city to make this error right with the homeowner's of Kelly Creek and Lochsa Falls, by making this 171 multi-family development something that looks good and fits in with our community. We fzxaaly believe it will be a detriment to property values as. well as quality of life. There will obviously be an increase in traffic, which is hardly sustainable at the current time. As a resident that uses Goddard Road to access McMillan every day I can irxform you that presently you have to practically pull out onto McMillan to be able to have a clear view of oncoming tratlcic in determining a safe exit off Goddard, Xf you add the hundreds and hundreds of vehicles that will come along with this development you will be asking for accidents to occur, Everyone knows the massive development along this corridor (as well as other areas of the valley} have been poorly managed in terms of t~'ture. The current road situation simply does not support additional development. Additionally, when ~,ve purchased our home in this neighborhood we wore told that area was reserved for commercial development. How convenient that it's now allowable for a huge apartment complex to be built there. What happened to honesty and integrity in government? As you have heard, I am not the only resident in this status. Nonetheless, I wanted to let you know that I, and my family, are opposed to the building of such a large number of multi-family housing units in the Locsha Falls Development. The reasons for my opposition are: 1. The number of units is too large for the community it would be apart of. 2. With the number of units, as currently listed, would adversely affect the schools to which the children would attend. 3. The plans for the entrance into the Selway Apartments is part of my community, which I oppose. There should be a direct entrance into the apartments from McMillan, not from Goodard Creek, which is the entrance into Kelly Creek. with this type of entrance not only is the development not fully contained, but it also puts Kelly Creek residents at risk with the increased traffic from the Selway residents. 4. There is not adequate parking inside the proposed development to handle visitors to the development, which would then affect the parking within Kelly Creek, mostly on Apgar Creek. The development only plans for 18 visitor spaces. With 171 units, 2 spaces per unit, there are 342 parking spaces for residents, and only 18 spaces for ALL OF THEIR VISITORS. He did not remember which paper, which day or which article. I told him to call the City Attorney's office with his concerns as well. The best way to answer your questions is to tell the story of development within the North Meridian area. Why is the property zoned R-4? In 2001, the City Council adopted an ordinance (Ordinance 01-919) amending the zoning code to allow planned developments. The purpose of such planned developments was to `provide opportunity for land development that preserves and utilizes natural topographic, geologic and scenic features; allows a more efficient pattern of residential, commercial and industrial uses; fosters innovative design concepts and promotes flexibility in site design; and provides for common open space of other amenities not found in traditional lot-by-lot development. " Furthermore, "The planned development process allows the Commission and Council to allow modifications from the development standards of the underlying zone in order to encourage mixed-use projects, and to permit secondary uses which are integrated with and support the primary use. " Nearly all of the larger North Meridian developments used the planned development process to create the neighborhoods we see today. The list includes: Lochsa Falls, Bridgetower, Paramount, Kelly Creek, Sundance, Heritage Commons, Havasu Creek, Cobblefield Crossing, Verona, Highgate, Redfeather, Saguaro Canyon, Sheridan Place, Razzberry, Settlement Bridge, Jaydan Village, Brockton, Alexandria, Sienna Creek, Ventana, Cedar Springs, Hacienda, Bainbridge, Zebulon Heights, Westborough, Hollybrook, Irvine, Volterra, and Durango Springs. As part of the planned development process, the developer could request "a variety of housing types ...within a single planned development, including attached units, detached units, single family and multi family, regardless of the underlying zoning classification of the site, provided that the overall density limit of the zone is maintained. " [Emphasis added.] In March of 2002, Farwest Development requested annexation and zoning of 354.38 acres of land south of Chinden, west of Linder, north of McMillan and east of Ten-Mile Road. The Applicants requested that upon annexation, all of the property be zoned R-4. Concurrently with the annexation request, Farwest Development sought approval of a planned development to allow 870 building lots (856 single- family detached building lots, a multiple family building lot, 11 office lots, a fire station lot and a commercial lot) and 61 "other" lots. The "other" lots include a 24.64-acre City park, a 6-acre private park, pedestrian pathways, landscape buffers, open space/drainage, 2 tot lots, private driveways and a central traffic rotary landscape/water feature. As part of the planned development application, the Applicant has also requested reduced development standards (including reduced setbacks, reduced lot size, reduced frontages, and reduced house sizes) and to exceed the maximum block length requirements. I've attached more details on the applicant's request at the end of this memo. When the item came before Council, they found that the proposed project was consistent and harmonious with the Comprehensive Plan which designated the site as both low density residential (up 7/5/2007 Page 2 of 4 to three units per acre) and medium density residential (three to eight units per acre). They also specifically stated that, `Although, the Schedule of Use Control (MCCI l -8-1) states that only detached single family dwellings are permitted within the R-4 zone, the Planned Development Ordinance allows a mixture of different housing types, (townhouses, duplexes and detached single family dwellings) within a single planned development, regardless of the underlying zone, so long as the overall density of the underlying zone is not exceeded (MCC12-6-4 A). " In considering the request, Council also found that the recent annexation and zoning of the Bridgetower Subdivision to the west and south of proposed Lochsa Falls is a significant change in the area, and that Bridgetower is a Planned Development similar to the proposed Lochsa Falls Subdivision. In general, the Council found that the proposed uses were consistent with the intended character of the area and that it would not create excessive additional requirements at public cost. Please note that the discussion included the following: "If approved, the developer will be financing the extension of sewer, water, local street infrastructure, utilities and irrigation services to serve the project. The primary public costs to serve the future residents will be fire, police and school facilities and services. Although a detailed analysis was not done specifically on Lochsa Falls, it is generally found that tax revenues generated by urban residential development do not pay for the long-term provision of these urban services. " With regard to traffic, Council made the following finding: "the proposed residential, office and commercial uses themselves will not be detrimental. However, Staff finds that the proposed uses will create additional traffic on Linder, Ten Mile, and McMillan Roads and Chinden Blvd. The Traffic Impact Study provided by the Applicant states that the development is estimated to generate 12,480 additional vehicle trips per day (20 existing). The Council noted that the mixed use nature of the proposed development will encourage a higher degree of trip capture within the square mile (estimated at 10% of total trips). In this regard, the "excessive production" of traffic is lessened versus a project without accessible neighborhood services. To summarize, Council approved the full concept of the planned development, including the reduced lot sizes, lot widths, parks, pathways, and landscaping that the existing single family homeowners already enjoy, and the future multi-family and commercial lots that are now developing that will make Lochsa Falls a complete and more self-sufficient neighborhood. As noted previously, because it was a planned development, the owner could request R-4 zoning on the entirety of the project. Why does the Comprehensive Plan show high density? When Planning Department staff updated the comprehensive plan for the North Meridian area, we designated properties according to previous approvals. In particular, we wanted to note the previous planned development approvals so that if the owners choose to rezone the property consistent with the approved use, the Comprehensive Plan would support that rezone. In the past, the City has not changed zoning designations without the request and/or consent of the property owners. Have you considered traffic patterns in the area? As noted previously, the Council did consider the traffic impacts for the Lochsa Falls planned development. Furthermore, the Ada County Highway District will review traffic impacts with the conditional use application for the Selway Apartments. We have not yet received an application. Adding 171 plus more cars from the Apartments and even more from the High School to this area is very unacceptable. I would suggest you try driving through this area around rush hour. I understand that you have plans for road improvements in the future but these need to be taken care of before these new Apartments go in. There is no way the current roads can handle this type of traffic. It take over 40 minutes to get to the interstate at 5pm so I can get to work at Micron. My wife and I have recently learned about the plans to build a 171 unit apartment complex off of McMillan Road and Goddard Creek. We are not opposed to growth and progress, but the location of the proposed apartment complex is a terrible one. We live in the Lochsa Falls subdivision which is not directly abutted to the apartment complex, but we are negatively affected in several ways. First, we are worried of the safety of our children and those of our neighbors. There are many children that plays in our parks and walk to Hunter elementary. How will our children be protected with the possibility of a high volume of traffic. There is a high chance that traffic from the apartment complex will go North on Goddard Creek, through Horse Loop Way, and on to Long Lake Way to get to Chinden and commute to Nampa or Downtown Boise. I have seen plenty of drivers driving carelessly around Horse Loop Way. They have either purposely driven the wrong direction to cut through from Goddard Creek to Long Lake or they drive at excessively high speeds around the park where many families with children gather. Second, the park which is owned by Lochsa Falls homeowners is getting more and more traffic from outsiders. I am not opposed to the use of the park, but people that do not live there do 6/21 /2007 Page 2 of 2 not take care of the park and the waterfalls which has been vandalized and trashed multiple times causing our HOA dues to be extremely high. There is a great chance that people from the apartment complex would create additional traffic and damages to the private park. Lochsa Falls already has a high volume of homes for sale (approximately 80+ or 10% of the total homes) due to high HOA dues and the unfair use of the community amenities by others outside of Lochsa Falls. The addition of an apartment complex could lower our proper values and increase the number of homes for sale in our community. My wife and I are both proud homeowners of Lochsa Falls and are also Realtors. We have had multiple conversations with neighbors that preferred to not have moved to Lochsa Falls and the market condition for the community is not very good. Many homes are sitting much longer than the market average. Third, with the scheduled Fall opening of the Paramount Elementary school, we understand that the school is already overcrowded. Paramount, Lochsa Falls, Kelly Creek, and Cory Barton Homes are still building lots of homes. We moved from the state of Arizona to Idaho several years ago due to the lower ratio of students to teachers here in Idaho. The approval of the apartment complex before a third elementary school is built will create lots of problems for students. Please consider these issues. It is of my strong opinion that an apartment complex in the proposed location would be a tragedy for Meridian and the residents that live nearby. The proposed area has some of the •finest subdivisions Meridian has to offer; most are new, well maintained, and have multiple parks and recreational facilities for the residents to enjoy. Unfortunately, a large apartment complex would very likely destroy the "Pride of Ownership" that these Meridian subdivisions have come to offer. Traffic, which is all but a nuisance now, will become more burdensome. Parks and recreations facilities will become over-crowded. The beauty of these nicely landscaped subdivisions and houses will be overshadowed by a large multiple city dwelling unit such as is the one proposed. It would be a mistake to allow this to happen. I believe that the City Council has an opportunity to send an important message to the residents of Meridian and the entire Treasure Valley. That Meridian is and always will be a desirable place to live. That the Meridian City Council and the residents will protect it's streets and recreational parks/facilities from over-crowding. That Meridian will continue to support residential and economical growth that makes sense. Our home is at 2479 W. Wapoot Dr. and is on the corner of Goddard Creek and Wapoot, which is kitty corner from the proposed Selway Apartment complex. We are writing to you to express our concerns regarding the proposed apartments and we are asking you to please consider our concerns when you are voting on the proposed development. We have three main concerns regarding this development. First, we are concerned about the increase in traffic. The main street into our subdivision, Goddard Creek, is already a very busy street during the morning and afternoon rush hour. The proposed entrance to the Selway apartment complex is within our subdivision off of Goddard Creek. As of now, the proposal is to add 171 units. If you average at least 1.5 cars per unit, then we are looking at an estimated 256.5 additional vehicles that will be entering and exiting our subdivision on a daily basis. There are several young children that live within the Kelly Creek & Locsha Falls subdivisions. We are worried about the safety of our children with the increase in vehicles. We also are concerned about the pollution and congestion that will accompany the increase in vehicles. We foresee that exiting our subdivision may be a nightmare. Second, we are concerned about the impact this development will have on our schools. We have an eight year old and a four year old. Our eight year old will be attending the brand new Paramount Elementary school that is opening in the fall. From our understanding, the school has not even opened and it is at capacity. If this is the case, the average classroom will have at least 25 children, which is already overwhelming for the faculty and staff. If the proposed apartment complex is approved, the children in the apartments will attend Paramount. We are worried that the classroom sizes will increase even more and that our child's education will be affected. Third, we are extremely concerned about diminished property values. We bought our home knowing that the property values in Meridian continue to increase each year. Before we purchased our home, we called the city to see what could possibly be put in the open field next to us. We were informed it was zoned R-8, which worst case would mean town homes or patio homes. Never did we think that apartments would be built next to $300,000-$600,000 homes. Another issue is the aesthetics of the apartment buildings. We were told that the apartments are not considered part of the Kelly Creek or the Locsha Falls subdivisions, and therefore do not have to have the same aesthetics as the homes in the neighborhood. We don't think that this is a fair conclusion, since you actually have to enter the Kelly Creek subdivision to access the one and only entrance of the proposed apartment complex and that the apartments will only be 20 feet from the property line of the homes on Wapoot Dr. In conclusion, we understand that apartments are an important part of our community and that there is a need for them. However, we don't feel that this is the appropriate location for an apartment complex. We are not centrally located to any type of shopping and we do not have any type of mass transit at this point. We feel that an apartment complex would be better suited on a busy thoroughfare, such as Eagle Rd., Franklin Rd., or Fairview Rd. where it is closer to shopping and transit. Our home is at 2479 W. Wapoot Dr. and is on the corner of Goddard Creek and Wapoot, which is kitty corner from the proposed Selway Apartment complex. We are writing to you to express our concerns regazding the proposed apartments and we are asking you to please consider our concerns when you are voting on the proposed development. We have three main concerns regazding this development. First, we are concerned about the increase in traffic. The main street into our subdivision, Goddard Creek, is already a very busy street during the morning and afternoon rush hour. The proposed entrance to the Selway apartment complex is within our subdivision off of Goddard Creek. As of now, the proposal is to add 171 units. If you average at least 1.5 cars per unit, then we are looking at an estimated 256.5 additional vehicles that will be entering and exiting our subdivision on a daily basis. There are several young children that live within the Kelly Creek & Locsha Falls subdivisions. We are worried about the safety of our children with the increase in vehicles. We also aze concerned about the pollution and congestion that will accompany the increase in vehicles. We foresee that exiting our subdivision may be a nightmare. Second, we are concerned about the impact this development will have on our schools. We have an eight year old and a four year old. Our eight year old will be attending the brand new Paramount Elementary school that is opening in the fall. From our understanding, the school has not even opened and it is at capacity. If this is the case, the average classroom will have at least 25 children, which is already overwhelming for the faculty and staff. If the proposed apartment complex is approved, the children in the apartments will attend Paramount. We are womed that the classroom sizes will increase even more and that our child's education will be affected. Third, we are extremely concerned about diminished property values. We bought our home knowing that the property values in Meridian continue to increase each yeaz. `~~-5~ ~- Before we purchased our home, we called the city to see what could possibly be put in the open field next to us. We were informed it was zoned R-8, which worst case would mean town homes or patio homes. Never did we think that apartments would be built next to $300,000-$600,000 homes. Another issue is the aesthetics of the apartment buildings. We were told that the apartments are not considered part of the Kelly Creek or the Locsha Falls subdivisions, and therefore do not have to have the same aesthetics as the homes in the neighborhood. We don't think that this is a fair conclusion, since you actually have to enter the Kelly Creek subdivision to access the one and only entrance of the proposed apartment complex and that the apartments will only be 20 feet from the property line of the homes on Wapoot Dr. In conclusion, we understand that apartments are an important part of our community and that there is a need for them. However, we don't feel that this is the appropriate location for an apartment complex. We are not centrally located to any type of shopping and we do not have any type of mass transit at this point. We feel that an apartment complex would be better suited on a busy thoroughfare, such as Eagle Rd., Franklin Rd., or Fairview Rd. where it is closer to shopping and transit.
